After President Trump sought to drastically cut foreign aid spending earlier this year, two non-profit groups sued his administration. A district court took their side and ordered the Trump administration to continue making payments. But, that ruling has just been overruled! No longer will your tax dollars be shipped overseas to fund these ‘organizations.’ Here’s what you should know about the ruling: A divided U.S. Court of Appeals for the D.C. Circuit issued a 2–1 ruling in favor of the Trump administration, granting authority to freeze, cut, or terminate billions in foreign aid previously approved by Congress. The decision overturns a lower court injunction that had required the administration to continue disbursing aid and pay out nearly $2 billion to international programs. The plaintiffs—nonprofit groups such as the AIDS Vaccine Advocacy Coalition and Journalism Development Network—were found to lack legal standing to challenge the executive action under the Impoundment Control Act; only the U.S. Comptroller General can challenge such impoundment of funds. Judge Florence Pan dissented, warning that the ruling could weaken judicial oversight of executive power and upset the constitutional checks and balances. The case will now return to district court, factoring in the appeals court’s guidance and the limitations on who may legally challenge impoundment decisions. The ruling aligns with Trump’s broader push starting with an executive order on his second inauguration day to freeze most U.S. foreign aid, including USAID and State Department programs, which had prompted multiple legal challenges over promised or pending aid.
