In a recent memorandum, the Swedish government is "generally positive" that the EU will take over the Swedish administration of justice with regard to what is defined in Brussels as climate crime. In contrast to murderers, rapists and terrorists, according to the EU's new environmental crime directive, those who are classified as climate criminals must also be able to be deprived of the right to stand in general elections.

Due to the global climate crisis, which from a certain political point of view is considered to exist, the European Commission now wants to tighten its environmental crime directive. This is a series of revisions compared to what applies today.

The EU wants the penalties for climate crime to be significantly increased. They also want the administration of justice in the climate area to be more supranational and "cross-border" so that, for example, Swedish environmental criminals can be prosecuted and convicted in EU federal court.

Citizens can be deprived of political rights
The most striking proposal, however, is that the EU wants to be able to deprive those found guilty of a climate crime of their political rights. A party politician who in government or opposition pursues a policy that an EU federal court considers to be climate threatening could with the proposal be prevented from standing for re-election and possibly be deprived of his existing political positions of trust.

The European Commission's proposal for a revised environmental crime directive is commented on by the Swedish Government Offices and the Ministry of the Environment in a memorandum posted on the government's website . In a summary, the government clarifies that it “generally is in favor” of the proposal in all its parts and that Swedish legislation is “harmonized” so that the revisions are reflected.

May require constitutional amendment in Sweden
When it comes to depriving people in Sweden of the right to stand in political elections, the government believes that it may end up in conflict with the Swedish constitution as it is written today. However, all parliamentary parties except the Sweden Democrats have given the thumbs up to give Brussels a mandate to take over the administration of justice in the area. It is believed that there are no grounds of subsidiarity or proportionality to say no. It also opens up for a constitutional amendment in connection with this autumn's parliamentary elections.

In Sweden, even imprisoned terrorists, murderers and child rapists are not deprived of the right to vote or stand in elections. With the revised Environmental Crimes Directive fully implemented, however, such measures can be taken against those who are considered to cause damage to the climate.
