The police must protect young criminals from claims for damages from crime victims

The police must protect young people who are investigated for crime from being exposed to claims for damages from the victims - because it is "of particular importance" for those who are obliged to escape. The Administrative Court of Appeal in Stockholm has come to this conclusion, writes Dagens Juridik.
At the police, information about the suspect's identity is normally classified until prosecution is brought, but if the preliminary investigation is closed, there is a provision stating that a crime victim has the right to find out the identity of the suspect in order to be able to make a claim for damages.
The idea is that anyone who has committed a crime that for some reason does not lead to public prosecution should still be able to be demanded for damages if he is guilty.
However, the provision does not apply if it is "of particular importance" to the suspect that his identity is not revealed. And now the Court of Appeal has thus come to the conclusion that since it is of particular importance for the person who is guilty of a crime to avoid paying damages, the provision should not be applied, at least not in the case of young suspects.
The case was about a young suspect who exposed a Umeå company to a crime. The company wanted to claim damages and demanded the man's identity, but was refused by the police.
The Court of Appeal now follows the police's line and says that since the suspect was "very young" at the time of the crime, it is "extremely important" that he does not have to pay damages.
However, the court disagreed. In a different opinion, one member considered that there was no reason to believe that the suspect would be subjected to harassment and that the information could therefore be disclosed.
