Marvin Morales-Ortez, 23, was released from custody in Fairfax County on Tuesday. He was in jail for brandishing a gun and assault with injury to someone. ICE filed a detainer which Fairfax County ignored. The judge dismissed the charges and released him from custody. One day later, he allegedly fatally shot a resident of Reston, Virginia. His rap sheet included at least 7 crimes in Fairfax County.

Fairfax County FAILED the victim by refusing to work with ICE and releasing this criminal alien onto Virginia streets instead of safely into ICE custody. If Fairfax County would have simply worked to uphold our nation’s laws, then this tragedy may have never happened.” ICE Statement

Fairfax County Police said on the social media site X, Wednesday evening, there was an emergency order to take Morales-Ortez back into custody after he was released Tuesday, but they were unable to locate him.

“After his release, a Community Services Board (CSB) clinician obtained an Emergency Custody Order (ECO) for Morales-Ortez. An ECO is valid for eight after issuance by a magistrate,” FCPD wrote. “FCPD Reston District patrol officers were then dispatched to serve the ECO and take Morales-Ortez into custody. FCPD patrol officers responded to the address of record for Morales-Ortez and did not locate him at his residence. The ECO expired shortly thereafter…FCPD’s Special Operations, Fairfax 1, Drone Unit, K9 and the Real Time Crime Center worked to find Morales-Ortez. He fled the scene on a bicycle before abandoning it and fleeing on foot.” ABC7

Had the County followed the ICE detainer, the death of the Reston resident would not have occurred. How many more Americans will have to die?
