Because vague or broadened definitions have historically been used to target motorcycle clubs and riding groups. This bill is moving NOW for the 2026 session. 1. What the bill proposes (exact or near-exact changes) The bill in the House, HB 429 (“Criteria for Determining Criminal Gang Membership”) would amend the definition of “criminal gang member” in §874.03 of the Florida Statutes. Florida House of Representatives+2FastDemocracy+2 The companion bill in the Senate, SB 536 (“Criminal Gang Members; Revising the definition…”) was filed 11/17/2025. Next steps in the legislative process Here are the general steps for a Florida bill like this, and where this one currently appears to be: The bill has been filed in its respective chamber (House and Senate). For example: HB 429 was filed 11/14/2025. Florida House of Representatives SB 536 filed 11/17/2025. The Florida Senate+1 Next, it would go to committee(s) in that chamber (e.g., House committee(s) that oversee criminal justice or judiciary, Senate committee(s) likewise). After committee(s) review and possibly amendments, it must pass its originating chamber (House or Senate). Then the companion bill (or the same bill) must pass the other chamber. Once both chambers pass the same version, it goes to the governor for signature (or veto). If signed (or allowed to become law), the act takes effect on the effective date (October 1 or July 1, 2026 as listed). After that date, the amended law becomes enforceable under the new definition. For this specific bill: it is still early (filed but no recorded votes yet) so it needs to move through committees, floor debate, voting, and then cross-chamber concurrence. 3. What citizens can do to oppose or prevent the bill’s passage If you (or a group) do not want this bill to become law (or want to alter it), here are actions you can take: Contact your legislators: Identify who your state House representative and state Senator are in Florida. Share your concerns about the bill (HB 429 or SB 536). Explain what parts you oppose and why. Request they vote against it or propose amendments. Submit public comments: When the bill is in committee, many committees allow public testimony (in‐person or in writing). You can provide written comments or testimony to that effect. Engage civic or advocacy organizations: Join or coordinate with civil‐liberties groups, criminal-justice reform advocates, or local community organizations that share your concerns.
