Earlier today I brought you this massive report that President Trump just declared all Biden actions signed with the Autopen NULL and VOID. That is estimated to be 92% of everything he did. Not just Executive Orders, and that’s what I want to unpack right now. It's actually quite large, but let's focus on two big areas. First up, Supreme Court Justice appointments. And how many did Biden appoint? Just one: the DEI hire, Ketanji Brown-Jackson in 2022. Is her seat now in jeopardy? In short, yes! No doubt there will be tons of litigation over this and it will eventually hit the Supreme Court itself (with Ketanji having to recuse herself from voting). And what happens then? Well, if you've been paying attention all year, President Trump is winning almost every Court case that hits the Supreme Court recently with the most common vote split being 6-3 for Trump. Of course, DEI Ketanji is in the group of 3, so when she recuses herself it would likely be a 6-2 vote to vacate her seat. Statutes dating back to 1792 (1 Stat. 281) and still in force (28 U.S.C. § 172, 5 U.S.C. § 2902, and others) require that commissions be “signed by the President” and “sealed with the Great Seal.” If a staffer used the autopen to “sign” Biden’s name without his authorization on the commission for Article III judges, the argument can (and should) be made that their rulings are not enforceable. Now let's examine the second huge category of things that are now potentially unwound, and that would be Pardons. UH OH....are Fauci, Hunter, Schiff and countless others right back in the hot water?
