In a huge win for the pro-life movement, a federal appeals court has drastically restricted access to the widely-used abortion pill (mifepristone.) The court sided with Louisiana in its case against the FDA, ruling that the in-person screening requirements for the abortion pill must stay in place while the legal fight continues. That effectively halts the practice of prescribing and shipping mifepristone through the mail without a physical doctor’s visit, a workaround that became widespread after the FDA loosened its rules in recent years. This is one of the most consequential rulings on abortion access since Dobbs. Mail-order mifepristone has been the primary path for women in states with strict abortion laws to still obtain the pill, and the Fifth Circuit just closed that door, at least temporarily. For decades, this has been the most common method for women killing their unborn babies. And, since many red states began cracking down on the evil baby-murdering practice, women in those states have increasingly (and unlawfully) exploited the system to get abortion pills through the mail from out-of-state providers where it’s still legal. Many patriots have been pushing for the Trump administration to outlaw abortion pills completely. And, the Trump administration may do just that. As we speak, a review of mifepristone is currently underway. For the time being, women can only get the abortion pill through an in-person visit to their doctor. Many babies lives will be saved by this ruling. NBC News reported further: A federal appeals court on Friday granted the state of Louisiana’s request to reinstate a nationwide requirement that abortion pills be dispensed in person. The ruling represents a victory for opponents of abortion rights, since it limits access by blocking people’s ability to obtain mifepristone — one of the two pills used in medication abortions — through telehealth and by mail. Telehealth prescriptions have been key to maintaining abortion access in states that outlawed or restricted the practice after the Supreme Court overturned Roe v. Wade in 2022. “Anti-abortion politicians have just made it much harder for people everywhere in the country to get a medication that abortion and miscarriage patients have been safely using for more than 25 years,” Julia Kaye, senior staff attorney for the Reproductive Freedom Project of the ACLU, said Friday in a press release. During the Covid pandemic, the Food and Drug Administration under President Joe Biden temporarily eliminated a requirement for mifepristone to be dispensed only in clinics, medical offices and hospitals. The change was made permanent in 2023. Louisiana challenged that FDA regulation in federal court last year, alleging that it created safety risks and that the data to support it was flawed or nonexistent. Multiple studies have found that medication abortion, which accounts for more than half of all abortions in the U.S., is safe and effective when taken at home after a consultation with a clinician. Peer-reviewed research has long shown that serious adverse reactions from abortion pills are rare. In January, the FDA requested in court that Louisiana’s lawsuit be paused until the Trump administration finished conducting its own safety review of mifepristone. A district court judge granted that request last month, and also denied a request from the state of Louisiana to reinstate the in-person dispensing requirements while the case plays out. Louisiana appealed the decision to the Fifth Circuit, which ruled Friday in its favor. However, the ruling isn’t final. The case is likely to escalate to the Supreme Court, with mifepristone manufacturers planning to appeal. The New York Times has more: On Friday night, Danco Laboratories, a mifepristone manufacturer and defendant in the lawsuit, filed a motion asking the Fifth Circuit to stay its ruling for a week for time “to seek relief in the United States Supreme Court.” The motion asked the court to rule on that request by 9 p.m. Central time “because the panel’s order threatens Danco with immediate harm.” If a weeklong stay is not issued, the company said it will file an emergency appeal with the Supreme Court. It was unclear Friday night whether the Trump administration would seek a similar stay or appeal the ruling to the Supreme Court. Administration officials did not immediately respond to requests for comment. In court filings, the Trump administration had argued that the F.D.A. was already conducting a review of mifepristone that would determine whether any regulatory changes were needed.
