The initiation of the rule of law procedure against Hungary can be announced in the EP today

The President of the European Commission (EC) is expected to announce today at the European Parliament's plenary session in Strasbourg that the rule of law procedure against Hungary will be launched in two weeks, Népszava has learned from EU funds. According to our information, the body chaired by President Ursula von der Leyen will target the Hungarian government only, this time it will not deal with the Polish.
Ursula von der Leyen did indeed announce the start of the rule of law in the afternoon.
At the end of the process, which lasted about six to eight months, EU funds can be repaid or withdrawn from Hungary if it is considered that the EU budget has been damaged due to a violation of the rule of law. Withdrawals can apply to funds from both the EU budget and the Recovery Fund. Although the ECJ publicly denied that the timing of its decision was driven by political considerations, everyone was confident that it would only step in to “block the rule of law” after the Hungarian parliamentary elections.
The College of Commissioners is seriously concerned that the financial interests of the European Union are being harmed in Hungary and that high-level corruption is going unpunished. Von der Leyen raised questions and objections mainly in the administrative letter sent to the Orbán government last year regarding public procurement and the independent functioning of the judiciary, such as the prosecution. In this context, the ECJ requested information on cases and practices alleging irregular and unauthorized use of EU funds. The Hungarian government responded to the allegations a few days later this year, but it does not appear to have met the Commission's expectations. The formal launch of the rule of law procedure will be formally decided at a meeting of the College of Commissioners in two weeks.
The full regulation on the "General Conditions for the Protection of the EU Budget" has been in force since 1 January 2021, but has not been applied anywhere yet, pending a court ruling on its legality on 16 February. In this, the judges of the Court of Justice of the European Union upheld the rules, confirming that they complied with Community law. The regulation requires the European Commission to initiate proceedings if it considers that the EU's budgetary interests are seriously and demonstrably harmed. At the end of a long process, the EU Council of Member States' finance ministers will have to decide whether to impose financial sanctions on the country concerned.
From the outset, the two main targets of the regulation have been Hungary and Poland, the two Member States in which, according to critics, EU values and standards are being violated at systemic level and this is jeopardizing the proper use of Community funds. For the time being, Warsaw has survived the proceedings, according to Brussels sources, because of the burden on it as a result of the war in Ukraine and the difficulty of proving a link between breaches of the rule of law and the misappropriation of EU funds.
