Alleged to have done two too many - was charged with rape

DOMESTIC. A 20-year-old man who had consensual intercourse with a woman was charged with rape after the woman reported him for making two more "coital acts" after she withdrew consent. However, the woman's information was contradictory and the 20-year-old was therefore acquitted by a district court that disagreed, as Dagens Juridik first reported.

The parties had had two voluntary intercourses earlier in the evening, but the third – which the woman was not satisfied with – was what led her to report the man and make a claim for damages.

The accused man stated that he had followed the law of consent and explicitly asked the woman if he would "stuff it in" and then received an affirmative answer before intercourse began.

However, the woman claimed that she asked the man to stop and that he then performed two more sexual acts without permission before he stopped. For that, the prosecutor believed that the man should be sentenced to three years in prison.

The accusation was, as usual, unproven, but since no proof is required in rape cases, charges were brought anyway. However, the plaintiff's information in the district court turned out to deviate from the information she provided in police interrogations and which are recorded in journal entries so strongly that the accused man was acquitted.

Two jurors still wanted to sentence the man to three years in prison for rape.
