If they wion’t, the system itself loses legitimacy in the eyes of millions of Americans who still believe in the country the Founders gave us. Some very good people and patriots may then feel they have no choice but to take matters into their own hands in ways that no decent person wants to see. That outcome can only be avoided by decisive action from within the system right now. The clock is ticking.

The Constitution itself gives us the weapons for this purge. Article VI requires every senator, representative, state legislator, and executive and judicial officer to be "bound by Oath or Affirmation, to support this Constitution." The standard oath adds the demand to "support and defend the Constitution of the United States against all enemies, foreign and domestic" and to do so "without any mental reservation or purpose of evasion." They recruit, indoctrinate, and discipline members to advance goals that require the ruining of the existing constitutional order. That law is still on the books. It can and must be updated and enforced against any group, by whatever name, that pursues the same end.

The Supreme Court has struck down some sloppy loyalty oaths from the 1950s and 1960s that punished mere membership without proof of active support for illegal aims. However, those rulings still left intact the basic requirement that people holding power must actually support the Constitution they swear to defend. They didn’t give socialists a permanent right to infiltrate and transform the government from within. Congress has the power under Article I to judge the qualifications and behavior of its own members. Each House can refuse to seat or can expel those who demonstrate by word and deed that they cannot faithfully support the document. Every one of these policies requires violating the Takings Clause, the Contracts Clause, the enumerated powers doctrine, and the fundamental American principle that government exists to protect rights, not to redistribute wealth and power by force.

These aren’t good-faith disagreements about tax rates or spending levels. These are attacks on the structure of the republic itself. When a sitting member of Congress or a candidate for office belongs to an organization that publishes a platform calling for a new constitution to replace the one we have, that person has already told you they are not here to work within the system. They are here to capture it and then burn it down from the inside. McCarthy tried to expose similar people when they were hiding their true allegiance.
