ABC News has more details on the charges: The suspect in the fatal stabbing of a Ukrainian woman on Charlotte’s light rail system late last month is now facing federal charges that would make him eligible for the death penalty, according to the Justice Department. Decarlos Brown Jr., 34, who was arrested on Aug. 22 after he fatally stabbed 23-year-old Iryna Zarutska, was charged by the U.S. Attorney’s Office in the Western District of North Carolina with committing an act causing death on a mass transportation system, which could make him eligible for the death penalty, the DOJ said on Tuesday. “This brutal attack on an innocent woman simply trying to get to her destination is an attack on the American way of life. Of course, crimes like this affect the victim the most — Iryna deserves justice, and we will bring justice to her and her family,” U.S. Attorney Russ Ferguson said in a statement on Tuesday. During a press conference on Tuesday, Ferguson described the incident as a “terroristic act” and said he and North Carolina FBI Special Agent James Barnacle Jr. spoke to Zarutska’s mother and uncle to alert them of the federal charges. Ferguson said the family is “suffering like any of us would be.” “No one should sit in fear while on the light rail,” Ferguson said as he held back tears. The FBI Charlotte Special Agent leading the investigation spoke out after Brown Jr. was federally charged. Fox News shared his statement: James C. Barnacle Jr., the FBI Charlotte special agent in charge, said he hopes the federal charge will “help bring her family a measure of justice.” “Iryna Zarutska had likely taken that train ride many times before. She was probably tired after a day at work and just wanted to go home, but tragically she never made it,” he said Tuesday. “We hope this federal charge will help bring her family a measure of justice and the courts will hold the subject charged in this horrific act accountable. Everyone in this country deserves to go to work, to school or just across town without fear of being attacked.” Brown was previously charged with first-degree murder in state court for allegedly stabbing Zarutska, 23, to death aboard a Charlotte light-rail train on Aug. 22. n a Tuesday press conference, Barnacle highlighted Zarutska’s story as an immigrant who fled war only to meet tragedy in America. “Even more tragic, she chose to come to Charlotte to escape the violence of her war-torn home in Ukraine. She made friends. She immediately got a job the first day she was allowed to work, and she got a work permit here. She worked at a senior citizens center, at a pizza place, and she took care of animals in the neighborhood. She was building her young life. She had recently moved in with her partner. Her family let us know she graduated from college in Kiev with a degree in art and restoration.
