‘Serious Crisis’: Hawley Says Congress Must Act To Combat Rising Abortion Rates
After a closed-door hearing this week with Food and Drug Commissioner Marty Makary, Senator Josh Hawley told The Daily Wire that Congress must take action against rising abortion rates largely fueled by the abortion drug mifepristone.
Hawley and other senators on the Senate Health, Education, Labor, and Pension (HELP) Committee met with Makary on Tuesday for a private briefing on mifepristone. The briefing focused on the FDA’s handling of mifepristone and an ongoing study of the drug’s safety.
Both Makary and Health and Human Services (HHS) Secretary Robert F. Kennedy Jr. committed to conducting the study last year, but Republican lawmakers have grown impatient.
“I think we’re at a dead end on this process with the safety review. I just don’t think it’s going anywhere, and I think the fact that 70% of abortions in this country now are done with the chemical abortion drug, there are more abortions in America now than there were when Roe was still the law of the land just a few years ago,” Hawley told The Daily Wire. “We have a serious, serious crisis around the chemical abortion drug, and we’ve got to do something about it.”
Data released in December by the pro-abortion Society of Family Planning revealed that the number of monthly abortions continued to increase in 2025 from 2024, which was itself an increase from 2023. Many of the pills have been sent through the mail to states where medication abortions are technically illegal.
Hawley said he has not heard back from the FDA on any of the letters sent on the abortion pill and said he didn’t receive any new information on Wednesday. He said there was no “sense of urgency” to take any action.
“I think this study is just a dead end,” he said. “I think Congress needs to act.”
Hawley said he was still contemplating what the action might look like, but any pro-life proposal would face an uphill battle in the Senate.
“I think Congress needs to be involved. Congress shouldn’t be a spectator and just outsource this to other people. I think it’s time for Congress to get involved,” he said.
At a minimum, Hawley says the FDA should reverse a Biden-era decision that allowed mifepristone to be shipped through the mail without an in-person doctor visit. Pro-life advocates say that the policy effectively nullifies the laws of states that have cracked down on abortion pills.
