The police exchanged the drug for sugar - therefore the criminal is acquitted

The police in Vännäs discovered where a drug den kept the drugs and decided to exchange them for sugar so as not to risk them getting on the market and so that the criminals could be caught more in the act. What they did not count on was that the court would acquit on the grounds that it is not illegal to possess sugar.
Just over a month ago, there was a well-known precedential ruling in the Supreme Court which determined that two serious gang criminals with a non-Western immigrant background would be acquitted of weapons offences. This after the police replaced the real weapons that were stored in a warehouse with dummies. A conviction in the district court and court of appeals with the accompanying long prison sentence was overturned.
Umeå district court now acquits at least one person in a drug gang in Vännäs with reference to the controversial HD sentence. In the current case, the police had exchanged the drug, ten kilos of amphetamine, for sugar. The criminal was later caught with what he himself thought were drugs. But because it was completely legal sugar, the court is forced to acquit him of the crime.

Additional defendants – likely to be convicted
Three more people were charged in the drug scandal and, in contrast to the fourth who was caught with the sugar, has not been set free after the trial. However, the district court has not yet announced its verdict, which will take place on Monday.
For a long time, the police have been working with the method of exchanging weapons and drugs for security reasons while scouting for the criminals is still ongoing before arrests. This has been done for security reasons so that the weapons and drugs do not end up on the street.
In the past, the patrol has not come across in court, but in April this year the Supreme Court ruled that the law should be interpreted differently. If it is not possible to securely tie a defendant to the original weapon or drug, but only to the dummy or sugar that the police exchanged them for, then the person should not be considered to have committed a crime.

The police are concerned - the government is investigating a change in the law
In the police drug cartel, people are concerned about the HD sentence and that they are now forced to let dangerous drugs and even more dangerous weapons remain with all the risks this entails. It also worries the government. Minister of Justice Gunnar Strömmer (M) has promised to "urgently" review the legislation so that this loophole can be closed if possible.
Several defense lawyers, including the one who represented the now acquitted drug offender, have announced that they have additional clients that they expect to be acquitted of weapons and drug offenses with the same defense tactics.
