An illegal immigrant in Järfälla outside Stockholm has cheated himself of a pension and other benefits to which he was not entitled for almost twelve years. Now the Pensions Authority is trying to recover most of the wrongly paid money.
It is in June 2010 that a migrant in the Stockholm area applies for a general pension, housing allowance and support for the elderly. The pension authority approves the application, without discovering that the person lacks a residence permit in Sweden and is thus an illegal immigrant.
The immigrant then receives a guaranteed pension and other benefits for almost twelve years, without being entitled to it, before the payments end in May last year. In that case, more than SEK 1.6 million was wrongly paid out.
During the thirteen years that have passed since 2010, the illegal pensioner has tried to get a residence permit in Sweden, but was refused by the Migration Agency.
Claimed on refund
Now, in a decision from March this year, the Pensions Authority wants the illegal immigrant to pay back the money that has been wrongly paid out since March 2013 - SEK 1,232,869. However, the money that was wrongly paid out before then is not recovered, as more than ten years have passed since the statute of limitations was interrupted by the decision. According to the Prescription Act, a claim is written off after ten years.
In total, the illegal migrant is estimated to have swindled over SEK 1.6 million in guarantee pension, housing allowance and elderly support, according to a calculation made by the newspaper Mitt i, which first drew attention to the case.
Lisa Nordenhäll, head of the control unit at the Pensions Authority, tells Samnytt that the migrant had a Swedish social security number and not just a coordination number. This has made it more difficult to discover that the person concerned was not entitled to a pension.
Can't pay
The migrant states in a letter that he believed he had the right to a tax-paid livelihood in Sweden, just like all other pensioners, despite the illegal stay. He believes that it is the Pensions Authority that made a mistake in granting the payments. Furthermore, the migrant's daughter states that the parent has no income, and therefore cannot repay the debt.
However, the authority believes that it is "obvious" that a person who is staying illegally in Sweden is not entitled to pensions or other benefits, and therefore must pay back when the error is discovered. The migrant is also deemed to have provided incorrect or incomplete information in his application, and it is therefore considered that there are no conditions to exempt him from the repayment requirement.
