Felon with armed robbery convictions still has 2nd Amendment rights and cannot be charged for possessing firearm‚ judge rules

A federal judge in Illinois has ruled that a felon did not lose his Second Amendment right to own a firearm‚ even after he had been convicted of multiple gun-related crimes.The astonishing ruling stems from an alleged robbery in Chicago in September 2021. At the time‚ Glen Price supposedly robbed three men on a CTA train. When police searched Price‚ they reportedly found a stolen credit card‚ cocaine‚ a 9mm handgun‚ and extra ammunition.As Price‚ now 37‚ had already been convicted of felony armed robbery three times in the past‚ federal law prohibited him from owning a gun. So officers charged Price with possessing a firearm as a felon‚ a federal statute with a mandatory minimum sentence of 15 years.On November 2‚ however‚ the federal case against Price was dismissed after U.S. District Judge Robert Gettleman‚ a Clinton appointee‚ determined that the statute prohibiting felons from possessing firearms was unconstitutional. That law "imposes a far greater burden on the right to keep and bear arms than the historical categorical exclusions from the people's Second Amendment right‚" Gettleman wrote in the 22-page decision.Gettleman said he based his ruling on the 2022 SCOTUS case New York State Rifle &; Pistol Association‚ Inc. v. Bruen. In that 6-3 decision‚ the justices struck down a New York state law requiring people to demonstrate "proper cause" when seeking a permit to carry a concealed handgun. Gettleman said that Bruen compelled the government to "provide evidence of a historical analogue that is both comparably justified and comparably burdensome of the right to keep and bear arms." The judge said he went all the way back to 1677 but couldn't find historical precedent for a similar prohibition on criminals possessing firearms.He also said that the "plague" of violence in some communities did not override the need for historical precedent that "authorized capital punishment and estate forfeiture for felonies" as demanded by Bruen. While there are "strong policy reasons" for trying to prevent violent crime‚ "lifetime disarmament" is not "rooted in our Nation’s history and tradition‚" Gettleman asserted‚ quoting from another 2023 federal ruling. Bill Kushner‚ a police affairs consultant for WLS-TV‚ argued that the statute preventing felons from possessing weapons came about in the 1930s and then expanded in the 1960s for good reason: it helps prevent violent crime. "The carjackings‚ the shootings‚ these are not just demonized youth‚" Kushner said. "These are people that feel that they have a free hand to do whatever they want without fear of repercussions."Even Richard Pearson‚ the executive director of Illinois State Rifle Association‚ disagreed with Gettleman's decision. "I'm opposed to criminals who have been charged with violent crimes and convicted of those violent crimes from getting a handgun or an FOID card or concealed carry permit of any kind‚" Pearson said.U.S. attorneys have already filed an appeal in the case‚ Law&;Crime reported. Armed robbery suspects leave message mocking Texas police in stolen car‚ but cops get the last laugh

Texas police said two suspects in an armed robbery and an attempted armed robbery left a message mocking them in a stolen car‚ but they were able to turn the tables on the pair. Investigators said the two had been targeting shoppers at a Walmart store in Rowlett on two different days. "Our first victim‚ he was loading his groceries here at the parking lot‚ and he was approached by a suspect at gun point. Pointed a gun at him and demanded to have his wallet‚" said Rowlett Police Corporal Jaqueline Vergara. The victim's dash camera captured the incident from Nov. 7 at about 8:54 p.m. Police said the pair drove away in a stolen black Hyundai Elantra and used the credit cards they had stolen from the victim. That vehicle was allegedly dumped by the thieves and recovered by police. Inside of the car‚ they found a message. "We had fun!" the message read. The suspects had been able to escape despite being chased by police from another city. Police said they drove up to 100 miles an hour during the chase. Another message on the car read‚ "3 Police Chase rly." Police believe that the two male suspects had been inside of the Walmart shopping with a female juvenile just prior to the time of the robbery. They released video of the suspects in hopes of obtaining help from the public to identify them. Vergara said that the same suspects were believed to have tried another armed robbery two days later at the same Walmart at about 10 a.m. "Same kind of of thing‚ the second victim was loading his groceries. He gets approached by the same suspect at gun point demanding his wallet‚ but this time they're in a red Hyundai Sonata‚" she explained. "That vehicle is also stolen‚ stolen out of DeSoto‚ and we see a pattern that they're aiming for Hyundai vehicles. The way we think that they are entering these vehicles are by smashing the back right rear window." The suspects drove off after that intended victim threatened to call 911‚ police said. Police later said that tips from the public led to the identification and arrest of one of the suspects‚ 17-year-old Patrick Taylor. They also identified the other suspect as 21-year-old Dwayne Broadnax‚ though he had not yet been apprehended. A school district in Georgia voted to uphold a ban on a graphic novel with sexual imagery from school libraries‚ and LGBTQ activists are outraged. The Marietta School District had issued guidelines for school library books in September‚ but any decision could be challenged by parents of students in the district. Kayla Sargent appealed the decision over the 370-page graphic novel "Flamer" and forced a special meeting to decide the issue on Thursday. "If you actually read the book‚ you see right away that it’s not sexually explicit‚" Sargent told WAGA-TV. "It’s certainly not pornographic." However‚ a review of the book found numerous questionable images involving a 14-year-old character engaging in masturbation and being attracted to naked‚ underage males. "This is extremely inappropriate. It goes beyond what is normal kids are saying‚" said Becky Simmons‚ a parent who supported the restrictions on the book. "Our tax dollars should not be paying for pornographic material." The school board agreed with Simmons and voted 6 to 1 to continue the restriction. School board member Jason Waters also objected to the book's depiction of suicidal thoughts. He went on to say that there will likely be other books banned from public schools. "Might there be more? Sure. Is it going to be a massive amount? I really don’t think so‚" Waters said. "That was never the intent of this."Sargent implied that the book might have helped queer and minority children to avoid mental illness."If you look at the statistics on adolescent mental health right now‚ the suicide rate are increasing. Not decreasing‚" she continued. "Particularly among queer and children of color."She claimed that her 10-year-old‚ a 5th grader‚ read the graphic novel comfortably with a few minor conversations about the controversial issues depicted. A poll in October found that 85% of Americans oppose controversial books with sexually explicit content in elementary schools. 79% said they were opposed to explicit books in middle schools while 69% said they were opposed to explicit content in high schools. Democrats have decidedly chosen to defend sexual content in books at public schools. "All books should be in the library. All books. This is America.
