Sandra Day O’Connor Shattered Glass Ceilings. And She Inspired Lawyers Like Me.

For me‚ and for generations of female lawyers like me‚ Sandra Day O’Connor inspired our entrance into the legal field. The service of O’Connor‚ the first female justice ever to sit on the U.S. Supreme Court‚ made possible the subsequent appointment of the five female Supreme Court justices to serve after her. I mourn her passing not because of her jurisprudence. Rather‚ I mourn who she was as a trailblazer and what her service at the Court did for women in a field to which I had long aspired. O’Connor called herself an “Arizona cowgirl‚” growing up in the hardscrabble southwest on a cattle ranch in a markedly inhospitable climate that averaged only 10 inches of rain per year. The house lacked both indoor plumbing and electricity until she was seven. In her memoir‚ “Lazy B: Growing up on a Cattle Ranch in the American Southwest‚” O’Connor wrote that by the age of eight‚ she could ride with the cowboys‚ mend fences‚ drive a truck‚ and fire her own .22 rifle. She wrote that prior to her riding with the cattle drives‚ “it had been an all-male domain. Changing it to accommodate a female was probably my first initiation into joining an all-men’s club‚ something I did more than once in my life.” O’Connor was appointed by President Ronald Reagan in 1981 and served until 2006‚ when she retired to care full-time for her husband who was suffering from Alzheimer’s. Her presence on the Court was so powerful that in 2001‚ now-Dean of University of California Berkley Law School Erwin Chemerinsky wrote that while Chief Justice William Rehnquist occupied the bench’s center seat‚ “Lawyers who argue and write briefs to the court know that often they are‚ for all practical purposes‚ arguing to an audience of one.” Forbes ranked her in 2004 as among the most powerful women in the world. But despite the acclaim‚ O’Connor was possessed of her characteristic “Arizona cowgirl” humility and discipline throughout her career on the bench. She was known to be prodigiously energetic‚ her close friend Nancy Ignatius once saying of O’Connor that her ability to accomplish such a great deal was owing to her ability to compartmentalize her many responsibilities. As the daughter of a rancher‚ O’Connor understood too‚ that work was a seven-days-a-week proposition. Few could outwork her—a trait she carried with her throughout her professional career. O’Connor’s brother once noted that “All her life‚ whatever she did‚ whether it was important‚ or unimportant‚ or semi-important‚ or very important‚ she just would do it to perfection . . . If you said‚ ‘The job is to wash dishes well‚’ she would do it better than anyone else.” Even O’Connor’s breast cancer diagnosis she took on as a personal challenge‚ with her sister saying once that the justice was “learning everything she could about it‚ reading every book‚ talking with people and making the necessary decisions about her treatment and options.” In a 2001 article‚ law professor Jeffrey Rosen criticized certain tendencies‚ writing that by her “refusal to commit herself to consistent principles‚ O’Connor forces the court and those who follow it to engage in a guessing game about her wishes in case after case. Each of her decisions is a ticket for one train only.” While she was appointed by a Republican president with the understanding that she would be a conservative justice‚ O’Connor proved soon after her confirmation to be a swing vote on the William Rehnquist Court (and first few months of the John Roberts Court). She surprised many who had backed her confirmation by often voting with the liberal justices. I vehemently disagreed with much of what she wrote. Her opinions addressing controversial social issues such as Grutter v. Bollinger and her co-authorship of the lead opinion in Planned Parenthood v. Casey rankled a good many conservatives. In her 2003 majority decision in Grutter v. Bollinger‚ for example‚ the Court held that state colleges and universities could use race-based admissions policies to promote the educational benefit of a racially diverse student body without violating the Equal Protection Clause of the Constitution so long as they employed a “holistic approach” for each applicant. That opinion was abrogated by the Supreme Court’s recent opinion in the Students for Fair Admission v. Harvard College and a companion case involving the discriminatory admissions practices at the University of North Carolina in which the Court ruled the use of racial preferences in college admissions was unconstitutional. Of particular heartbreak to me was her joint opinion with fellow Republican appointees Justices Anthony Kennedy and David Souter in Planned Parenthood v. Casey‚ an opinion that affirmed Roe v. Wade’s central holding—that the Constitution conferred a right to abortion. In Casey‚ the Court clarified that a state could not impose an “undue burden” on a woman’s right to abortion‚ while dispatching with Roe’s trimester framework in favor of the “viability” demarcation line in determining when a state could constitutionally regulate abortion.   But in a poetic turn‚ O’Connor’s retirement opened the door to Samuel Alito’s confirmation in 2006. Alito went on to author the majority opinion in the watershed Dobbs v. Jackson Women’s Health Organization‚ overturning both Roe v. Wade and O’Connor’s joint opinion in Casey. Those cases‚ Alito wrote‚ “represent an error that cannot be allowed to stand.” In the 17 years following O’Connor’s retirement‚ the Court has overturned some of her best-known decisions‚ owing in large part to the appointment of Alito‚ and more recently‚ the appointment of Justices Neil Gorsuch‚ Brett Kavanaugh‚ and Amy Coney Barrett under former President Donald Trump. But while the effects of her judicial legacy have been significantly blunted over time‚ her presence on the Court has left an imprint that won’t soon fade. In the Supreme Court’s press release Friday‚ Chief Justice Roberts said of O’Connor: “Sandra Day O’Connor blazed an historic trail as our Nation’s first female Justice. She met that challenge with undaunted determination‚ indisputable ability‚ and engaging candor.” For herself‚ though‚ O’Connor never saw her gender as either an impediment to her service‚ or of any particular relevance‚ once saying‚ “The power I exert on the court depends on the power of my arguments‚ not on my gender.” Yet before the gains of the feminist movement the rest of the male-dominated legal profession was largely closed off to women—and especially so for married women who were encouraged to stay home. Though she had graduated from Stanford Law School at the top of her class‚ O’Connor could not find work as lawyer in any of the law firms to which she applied. The California-based firm of Gibson Dunn did offer O’Connor a job—but as a legal secretary. O’Connor was so eager to work as a lawyer that she instead applied for a job with the San Mateo County government as deputy county attorney and agreed to work for free until the office could find funding to support her position. Then‚ when her first son Brian was born‚ O’Connor made the decidedly un-feminist decision to leave her legal practice and stay home for five years to focus on raising her children. O’Connor recognized the significance of her appointment as the first female Supreme Court Justice and its impact on future women lawyers. In a 2003 interview‚ O’Connor said‚ “Let me tell you one reason why I think it’s important‚ and that is for the public generally to see and respect the fact that in positions of power and authority‚ that women are well-represented. That it is not an all-male governance‚ as it once was.” As a lawyer‚ mother‚ jurist‚ and wife‚ she was‚ as Reagan said when first introducing her to the American people‚ a woman for all seasons. MSNBC's Message To MSM: Forget Polls‚ Focus On Danger Of Electing Trump!

Bad polls for Biden? MSNBC has a fix for that! On her MSNBC show on Saturday‚ Katie Phang's guest‚ Molly Jong-Fast of Vanity Fair‚ citing NYU journalism professor Jay Rosen‚ said that journalists‚ instead of writing stories about polls‚ should focus instead on the "stakes" of the election.  And just what are those "stakes?" According to Rosen‚ the stakes are nothing less than "the consequences for American democracy." A dominant theme in the liberal media‚ as we have noted here and here‚ is that Trump represents an existential threat to the survival of democracy in America. So what Rosen and Jong-Fast are‚ in effect‚ saying is that journalists should put aside their traditional role of reporting the facts‚ and instead scaremonger their audience as to the dangers that the election of Trump would represent. Jong-Fast warned that without democracy‚ "there will be no journalism." And since Trump‚ in the liberal-media mind‚ would end democracy‚ his election would also mean the end of journalism.  Scaremongering much? Trump had four years in the White House and the national media thrived on opposing him. Today's "journalism" is still very much dominated by the left -- as demonstrated by the very existence of MSNBC‚ and the presence on the network of an endless stream of hosts and guests such as Phang and Jong-Fast. Perhaps even more troubling is that‚ as Rosen's prescriptions indicate‚ the next generation of journalists are being taught to ignore fact-gathering and instead employ their powers to promote the liberal agenda. You can already see how "old-school" journalists in national news rooms are being intimidated into wokeness by the leftists just coming out of journalism schools.   As for "ending journalism‚" it was the Biden administration that pressured Big Tech to suppress the Hunter Biden laptop story and falsely present it as a Russian disinformation campaign.  And it was the Biden administration that created the Orwellian  "Disinformation Governance Board‚" a literal Ministry of Truth! The Board was only disbanded in response to an outcry over its obvious impingement on First Amendment freedoms. And Phang's opening line to Jong-Fast was to ask whether "we should we just do away with polls altogether?" Who's "we‚" and just how would Phang "do away with polls altogether?" A law‚ or a Biden executive order‚ outlawing them? So‚ who's the real threat to democracy and journalism? Here's the transcript. MSNBC The Katie Phang Show 12/2/23 8:45 am ET KATIE PHANG: WhY my next guest says‚ we gotta stop treating election polls as full-scale news events‚ and why the stakes are too high to obsess over snapshots of 2024. Molly Jong-Fast joins us straight ahead. . . .  America. We may have a bit of a polling problem. And the problem is not with the poll numbers‚ it's with poll dependents. You want a poll that shows Biden doing well ahead of '24? We've got a poll for you. You want a poll showing Trump doing well ahead of 2024?We've got plenty of polls that show that. You want a poll to serve as a political advisor of sorts? We've got that poll‚too.  Look‚ polls can be useful. They can be informative and educational. But‚ let's face it‚ polls cannot tell us in December of 2023‚ who will win an election in November of 2024. Don't believe me? Just ask Hillary Clinton. As Vanity Fair's Molly Jong-Fast puts it [in this column]‚ let's stop treating polls as actual news events. Joining me now is Molly Jong-Fast‚ special correspondent for Vanity Fair and the host of the Fast Politics podcast. I mean‚ Molly‚ my first question out of the gate‚ based upon everything we know‚ should we just do away with polls altogether‚ then? I mean‚ what's the utility of having them? . . .  MOLLY JONG-FAST: One of the things that's really destructive is‚ you see a lot of opinion pieces written off polls as a news peg. So‚ for example‚ when I was working on this piece‚ there were like‚ three pieces on the Washington Post site that were written with polling as fact.  So‚ for example‚ the border comes back to bite Democrats‚ because it's on‚ it's based on a polling. So‚ it's based on the supposition that the border is somehow a problem for Democrats because of a poll. And that in itself is not‚ it‚ it's just sort of unnatural bit of news‚ that may or may not be true. But‚ then it shapes a narrative‚ which really is problematic. PHANG: So‚ let's give credit where credit is due. Jay Rosen -- JONG-FAST: Right‚ yes. PHANG: -- has been actually sounding this alarm for years‚ saying it's not the odds‚ but the stakes. I'm gonna say it again: not the odds‚ but the stakes.  The focus that Jay says should be‚ not who has what chances of winning‚ but the consequences for American democracy. I mean‚ I don't know if you could underscore that any more in terms of its importance‚ especially as you sit here today‚ Molly. So my question for you is‚ but should journalists be telling its readers‚ its viewers‚ etc.‚ what's at stake? JONG-FAST: Yes. PHANG: Is that really a place for journalists -- JONG-FAST: Yes. PHANG:-- or should they just be just‚ just the facts‚ ma'am? JONG-FAST: Yes! But the facts are what's at stake‚ right? And I think the place where you could see this the most is 2016. If you look at the number of pieces that were written about Hillary Clinton becoming president as a fait accompli‚ because her pollingwas 90%. As low as 78% when the Comey letter came out‚ but mostly in the 90s. So‚ the idea was‚ she was going to be the next president‚ and so‚ you didn't need to deal with the stakes of a Donald Trump presidency‚ because you were so focused on the odds of a Hillary Clinton presidency. And I think that is fundamentally the problem. And Jay Rosen teaches at NYU as a journalism professor. And I think he's really right. That we should be looking‚ as journalists‚ we should be pro-democracy.  And that is ultimately the goal. Because without democracy‚ there will be no more journalists.

A mother in Iowa has lost both of her legs and will require facial reconstructive surgery after being mauled by three pit bulls.Around 11:30 a.m. on Nov. 24‚ three pit bulls attacked Brittany Skoland at her home in Fort Dodge‚ Iowa. Neighbor reportedly heard "someone yelling for help‚" and called the police. When a police officer arrived‚ he saw Brittany Skoland being mauled by the three pit bulls. "The officer attempted to scare the dogs away to stop them from attacking the woman‚ but the dogs would not stop‚" read the statement from the Fort Dodge Police Department. "The officer on scene then drew his duty weapon and shot all three dogs multiple times to stop the attack."A local resident told KCCI that it took several rounds to subdue the animals. “I was sitting in my living room‚ and I was just sitting there and all of a sudden I heard bang bang bang‚ and I come to the door and I seen all the cops‚ well there was only one at the time‚ and I seen the lady laying on the ground and the dogs going at her and the cops shot them. And it was quite a few rounds of ammunition to get them down‚” Rosemary Possehn told the news outlet. The officer shot all three pit bulls dead. However‚ Skoland had already suffered serious injuries from the pit bull attack. Skoland was transported to nearby Unity Point Trinity Regional Medical Center‚ and later flown to Iowa Methodist Medical Center in Des Moines. A GoFundMe campaign was launched to assist the Iowa mother with medical bills.Skoland's aunt‚ Teresa Hanus‚ wrote in the fundraising description: "As of 12/2 Brittany has lost a lot more than we originally thought. She's had many surgeries and procedures in the last few days. She has had both legs amputated to her knees."The aunt noted that her niece suffered serious head trauma and will need facial reconstruction surgery. Because of the vicious dog attack that took Skoland's legs‚ her home will need special accommodations for when she returns home and is bound to a wheelchair. The owner of the pit bulls was reportedly not cooperative when questioned by a local television news channel. KCCI attempted to speak to the owner of the dogs‚ but he allegedly "yelled obscenities and told KCCI to go away before walking into his home."The dog owner has reportedly not been charged with any crimes as of yet. Law enforcement is still investigating the brutal pit bull attack. As of Sunday afternoon‚ the GoFundMe had raised over $16‚000. An Israeli woman who was released by Hamas during a ceasefire late last month was reportedly operated on by a veterinarian while she was being held hostage in Gaza. Business Insider reported that the aunt of hostage Mia Schem said her niece was operated on by a vet after she suffered an injury to her hand. Over the course of a seven-day truce between Israel and Hamas‚ 100 hostages were apparently freed by Hamas. Schem's aunt‚ Vivian Hadar‚ said that waiting for her niece to be freed from Hamas was "like Russian Roulette." But she shared with the Jerusalem Post that "[f]inally she is with us‚" adding that "[Schem] was traumatized. She is thin and weak.""A vet operated on her hand. She did physical therapy for herself. She told them that she was not a soldier and that she has French citizenship. I don't ask her questions and did not dig because when we started asking we saw that it was difficult for her. We are glad that she is with us. It is difficult to see her in this situation.""We kept wanting to know if she was on the list or not‚" Hadar continued. "Yesterday we thought she was on the list and in the end they said no and it completely paralyzed me. What the families of the hostages are going through is not normal. This must not happen. All the hostages must be returned.""[Schem's] hand is very sore. She knew she needed to give herself hand massages. She doesn't say much. We just came and hugged her. She wants to see as many family members as possible. It's not an easy time. It's not easy what she went through and we're looking forward."It is believed Schem was just one of 240 hostages taken by Hamas during a surprise attack against Israel on October 7. Schem had attended the Supernova music festival near the border of Gaza when the attack broke out. Though many people at the music festival were fatally shot‚ Schem was apparently shot in the hand and subsequently taken hostage.Schem went on to mention that the food she was given after Hamas militants abducted her was "good‚ and the kindness and everything good."Since the seven-day ceasefire‚ Israel has resumed its attack on Gaza‚ continuing with its goal of annihilating Hamas from the region.The Israeli government recently stated that it wants a buffer zone installed between Israel and Gaza after the war‚ so as not to allow another surprise attack.Like Blaze News?
