DOJ Targets Boeing, Says It Breached 2021 Deferred Prosecution Agreement

The Department of Justice has alerted Boeing that the airline manufacturer breached terms of its 2021 deferred prosecution agreement, which saw Boeing protected from criminal prosecution after two 737 Max accidents in 2018 and 2019 that killed 346 people. Those accidents occurred on an October 2018 Lion Air 737 Max flight and a March 2019 Ethiopian Airlines 737 Max flight. The 2021 agreement stated, “The Company agrees that, effective as of the date it signs this Agreement, in any prosecution that is deferred by this Agreement, it will not dispute the Statement of Facts set forth in this Agreement.” It added: This Agreement is effective for a period beginning on the date on which the Information is filed and ending three years from that date (the “Term”). The Company agrees, however, that, in the event the Fraud Section determines, in its sole discretion, that the Company has knowingly violated any provision of this Agreement or has failed to completely perform or fulfill each of its obligations under this Agreement, an extension or extensions of the Term may be imposed by the Fraud Section, in its sole discretion, for up to a total additional time period of one year. Boeing paid $2.5 billion in penalties after the 2021 agreement with a promise it would improve safety and compliance protocols, but families victimized by the two crashes felt that justice had not been done. After recent events, they met with the Biden administration last month to urge ending the 2021 agreement. Those events included an Alaska Airlines flight losing a door plug in January. In late February, the Federal Aviation Administration issued a report criticizing Boeing that stated it did not find “objective evidence of a foundational commitment to safety that matched Boeing’s descriptions of that objective.” The report also declared that some employees at Boeing were reticent to speak of safety concerns because they feared retaliation. “For failing to fulfill completely the terms of and obligations under the [deferred prosecution agreement], Boeing is subject to prosecution by the United States for any federal criminal violation of which the United States has knowledge,” the Justice Department informed US District Judge Reed O’Connor in Fort Worth, Texas, who supervised the 2021 agreement. The Justice Department added that “the government has determined that Boeing breached its obligations by failing to design, implement, and enforce a compliance and ethics program to prevent and detect violations of the U.S. fraud laws throughout its operations,” CNN reported. Red Lobster, the largest U.S. seafood restaurant chain, is expected to file for bankruptcy after offering customers an all-you-can-eat shrimp deal that ultimately cost the company millions of dollars. Red Lobster currently boasts roughly 650 locations nationwide and has its headquarters in Orlando, Florida; it recently closed dozens of its outlets. Thai Union Group, Red Lobster’s majority owner, said they were through funding the chain. “We’re going to exit. We are not going to inject any more money into Red Lobster,” Thai Union Chief Executive Thiraphong Chansiri said in February. “The company aims to use the bankruptcy process to negotiate concessions from landlords and strike a deal with creditors to continue operating, moves that could trim hundreds of millions of dollars in debt,” Red Lobster said, according to The Wall Street Journal, which noted that the company’s sales dropped 8% from 2022 to 2023. The Journal pointed out that restaurant chains are suffering because typical consumers, who have incomes less than $50,000, cannot afford to eat out because the current economy has forced them to cut spending. Another factor crippling the chains is the high interest rate they are dealing with when it comes to their debt. Among chains hit hard by the economy, Tijuana Flats and Sticky’s Finger Joint both filed for bankruptcy in the last 30 days; past month. Dom’s Kitchen & Market and Foxtrot Market, which have prepared-food sections, both closed in April. In mid-April, the National Gardening Association reported that with the rising costs of groceries, many Americans have taken to growing food at home. It reported that 43% of Americans are now growing food at their homes, up from 33% of Americans in 2019. “According to the U.S. Department of Agriculture, at-home food prices increased by 11.4% in 2022. China, Iran Had Fake AI Content Ready To Influence 2020 Election: Report

According to U.S. officials, agents working with the Chinese and Iranian governments had fake, AI-generated content ready to release in 2020 so they could influence the American presidential election. The National Security Agency found evidence of China and Iran’s capacity to produce deepfakes, a source told CNN. “The question becomes how quickly can we spot an anomaly and then share that rapidly within the United States,” a former senior U.S. official told CNN. “Are we winning the race against a series of adversaries that might operate within the US? That’s the challenge.” “Leading adversaries of the United States — China, Russia, and Iran — are strategically utilizing AI to diminish U.S. influence in targeted regions by employing tactics such as disinformation campaigns and the advancement of unmanned military capabilities,” Concentric noted last November, adding, “China now has at least 130 large language models (LLMs), accounting for 40 percent of the global total and just behind America’s 50 percent share.” In November 2021, the Department of Justice charged “two Iranian nationals for their involvement in a cyber-enabled campaign to intimidate and influence American voters, and otherwise undermine voter confidence and sow discord, in connection with the 2020 U.S. presidential election.” CLICK HERE TO GET THE DAILYWIRE+ APP The FBI issued an alert in March that stated: Malicious actors almost certainly will leverage synthetic content for cyber and foreign influence operations in the next 12-18 months. Foreign actors are currently using synthetic content in their influence campaigns, and the FBI anticipates it will be increasingly used by foreign and criminal cyber actors for spearphishing and social engineering in an evolution of cyber operational tradecraft. … Russian, Chinese, and Chinese-language actors are using synthetic profile images derived from GANs, according to multiple private sector research reports. These profile images are associated with foreign influence campaigns, according to the same sources. The FBI discussed how to ascertain whether an image could be fake: Visual indicators such as distortions, warping, or inconsistencies in images and video may be an indicator of synthetic images, particularly in social media profile avatars. For example, distinct, consistent eye spacing and placement across a wide sample of synthetic images provides one indicator of synthetic content. Similar visual inconsistencies are typically present in synthetic video, often demonstrated by noticeable head and torso movements as well as syncing issues between face and lip movement, and any associated audio.

Remains Identified As Maryland Woman Who Vanished In 1968

Remains found in Florida in 1985 have been identified as a Maryland native who went missing in 1968. Mary Alice Pultz was born in Rockville, Maryland, in 1943, but left with her boyfriend in 1968 and lost contact with her family, the St. John’s Sheriff’s Office (SJSO) said in a press release. Her boyfriend at the time, John Thomas Fugitt, would go on to murder his male roommate in 1981. Fugitt, who also went by the alias Billy Joe Wallace, was sentenced to death for the murder but died in prison before he could be executed. On April 10, 1985, some construction workers in St. Augustine, Florida, found the remains of a white woman in a shallow grave on Crescent Beach. An initial investigation put the woman’s age between 30 and 50 years old at the time of her death, and due to the circumstances of where her body was found, her death was ruled a homicide. The case quickly went cold. In 2011, the woman’s skull and mandible were sent to the University of South Florida’s Institute for Forensic Anthropology and Applied Science. Experts were able to create a graphic using facial reconstruction to show how the victim may have looked. While the image generated some leads, nothing led to her identification, and the case went cold again. In 2023, part of the remains were sent to Othram, a Texas-based lab that specializes in forensic DNA evidence and forensic genetic genealogy. Othram has been responsible for identifying victims in numerous cold cases over the past few years, including the identification of the Golden State Killer. Othram was able to develop a DNA profile for the victim, which was then sent to consumer genealogy databases such as 23andMe to find potential relatives of the victim. A match was found, so Sgt. Gene Tolbert of the SJSO’s major crimes unit traveled to North Carolina to meet with the possible relatives. In January 2024, detectives confirmed that the relatives matched the deceased and identified the remains as belonging to Pultz. An examination of the remains revealed three surgical burr holes in her skull, which would have been created to relieve pressure on the brain during a brain bleed or other fluid buildup. After interviewing her family, detectives learned that those holes must have been made after she left in 1968. Detectives believe she must have been involved in a traumatic event that required hospitalization, such as a car crash. CLICK HERE TO GET THE DAILYWIRE+ APP Wendolyn Sneed, Chief Medical Examiner for the District 23 Medical Examiner’s Office in St. John’s County, examined the remains recently and found “multiple fractures of the nasal bones, healed fractures of multiple ribs, and healed fractures on the lower legs.” These injuries, Sneed advised, were in line with severe trauma, such as from a car crash or being struck by a vehicle. These injuries are not considered to be related to her cause of death. “This investigation is a powerful example that we will never give up,” St. John’s County Sheriff Rob Hardwick said in the press release. “The combination of highly skilled detectives and advanced DNA technology has given Mary Alice’s family some answers about her disappearance close to 40 years ago. Our Major Crimes detectives are some of the best in the business and I am proud of their dedication to be a voice for homicide victims and their families as we seek closure for loved ones.” Detectives are still investigating the murder of Pultz, and while Fugitt is considered a person of interest, police have not ruled out other possibilities.
