Exactly How The 25th Amendment Could Work To Potentially Remove President Biden

You’ve probably heard a lot about the 25th Amendment recently and how it might be used to remove a President from office. But do you know exactly how it works? I didn’t. But now I do and it’s a very interesting process that I thought I would share with you. Let’s start with the Full Text of the Amendment: Amendment XXV Section 1. In case of the removal of the President from office or of his death or resignation, the Vice President shall become President. Section 2. Whenever there is a vacancy in the office of the Vice President, the President shall nominate a Vice President who shall take office upon confirmation by a majority vote of both Houses of Congress. Section 3. Whenever the President transmits to the President pro tempore of the Senate and the Speaker of the House of Representatives his written declaration that he is unable to discharge the powers and duties of his office, and until he transmits to them a written declaration to the contrary, such powers and duties shall be discharged by the Vice President as Acting President. Section 4. Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President. Thereafter, when the President transmits to the President pro tempore of the Senate and the Speaker of the House of Representatives his written declaration that no inability exists, he shall resume the powers and duties of his office unless the Vice President and a majority of either the principal officers of the executive department or of such other body as Congress may by law provide, transmit within four days to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office. Thereupon Congress shall decide the issue, assembling within forty-eight hours for that purpose if not in session. If the Congress, within twenty-one days after receipt of the latter written declaration, or, if Congress is not in session, within twenty-one days after Congress is required to assemble, determines by two-thirds vote of both Houses that the President is unable to discharge the powers and duties of his office, the Vice President shall continue to discharge the same as Acting President; otherwise, the President shall resume the powers and duties of his office. Next let’s understand the history of HOW and WHEN we got this Amendment: The 25th Amendment to the United States Constitution was ratified on February 10, 1967. It was designed to provide clear procedures for dealing with situations where the President is unable to perform the duties of the office due to death, resignation, removal, or incapacitation. The circumstances that led to its creation were driven by historical precedents and contemporary concerns during the mid-20th century. Historical Context Precedents of Presidential Succession and Incapacity: William Henry Harrison (1841): The first president to die in office. Vice President John Tyler assumed the presidency, setting an informal precedent for presidential succession, though the Constitution was unclear on this point. James Garfield (1881): After being shot, he lingered for 80 days before dying. During this period, there was uncertainty about who should exercise presidential powers. Woodrow Wilson (1919): Suffered a debilitating stroke and was incapacitated for the remainder of his term, but no formal transfer of power occurred, leading to governance challenges. Franklin D. Roosevelt (1945): Died in office shortly after beginning his fourth term, raising concerns about the absence of clear succession procedures. Contemporary Concerns (1960s): Cold War Tensions: The Cold War underscored the need for stable and continuous leadership due to the threat of nuclear confrontation. John F. Kennedy’s Assassination (1963): President Kennedy’s assassination highlighted the lack of clear constitutional procedures for dealing with presidential incapacity or sudden death, as there was no formal mechanism for the Vice President to become Acting President. Creation of the 25th Amendment In response to these historical challenges and contemporary concerns, Congress moved to address the gaps in the Constitution regarding presidential succession and incapacity. The process involved several key steps: Proposals and Debates: Various proposals were considered, focusing on ensuring a clear line of succession and mechanisms for determining presidential incapacity. The need for a formal process to handle temporary or permanent presidential incapacitation was a central concern. Drafting and Approval: Senator Birch Bayh of Indiana played a pivotal role in drafting and advocating for the amendment. The proposed amendment was approved by Congress on July 6, 1965, and sent to the states for ratification. Ratification: The amendment was ratified by the required number of states on February 10, 1967, officially becoming part of the Constitution. Ok, now let’s really dive in…. How does it work? This would be the process: How the 25th Amendment Works in Removing a President The 25th Amendment to the United States Constitution deals with presidential succession and disability. It has four sections, with Sections 3 and 4 being particularly relevant to the removal of a sitting president due to inability to perform the duties of the office. Section 4 of the 25th Amendment Section 4 outlines the process for removing a president who is unable to discharge the powers and duties of the office. This section is used when the president is incapacitated but does not voluntarily step down. Here’s a step-by-step breakdown: Initiation: The Vice President and a majority of the principal officers of the executive departments (the Cabinet) or another body established by Congress can declare the president unable to discharge the duties of the office. Written Declaration: They must send a written declaration to the President pro tempore of the Senate and the Speaker of the House of Representatives. Transfer of Power: Upon this declaration, the Vice President immediately assumes the role of Acting President. President’s Response: The President can contest this declaration by sending a written declaration to the same congressional leaders stating that no inability exists, and they are capable of performing their duties. Reaffirmation by Vice President and Cabinet: If the Vice President and the majority of the Cabinet still believe the President is unable to discharge the duties, they must send another written declaration within four days to the congressional leaders. Congressional Decision: Congress must assemble within 48 hours if not in session and decide the issue within 21 days. If two-thirds of both the House and Senate agree with the Vice President and the Cabinet, the President is removed, and the Vice President continues as Acting President. If they do not achieve a two-thirds vote, the President resumes their duties. And how might it apply to Joe Biden? Application to Joe Biden For the 25th Amendment to be invoked regarding President Joe Biden, the following would need to happen: Observation and Decision: Vice President Kamala Harris and a majority of President Biden’s Cabinet would have to determine that President Biden is unable to discharge the powers and duties of his office due to physical or mental incapacity. Written Declaration: They would submit a written declaration to the President pro tempore of the Senate and the Speaker of the House, stating that President Biden is unable to fulfill his duties. Transfer of Power: Vice President Harris would immediately become Acting President. President Biden’s Response: If President Biden believes he is capable of performing his duties, he would submit a written declaration to the congressional leaders contesting the Cabinet’s assertion. Reaffirmation: If Vice President Harris and the majority of the Cabinet disagree with President Biden’s self-assessment, they would send another written declaration within four days. Congressional Decision: Congress would then convene to decide the matter. If two-thirds of both the House and Senate agree with Vice President Harris and the Cabinet, President Biden would be removed from office, and Vice President Harris would continue as Acting President. If the required two-thirds vote is not achieved, President Biden would resume his duties. Review & photos by Joe Schaeffer Styx, Foreigner and John Waite brought their Renegades & Juke Box Heroes Tour to the Honda Center in Anaheim. The show features set lists filled with classic hits and fan favorites. John Waite opened the show with a nine-song set that was well-received by the audience. His performance blended material from his time with Bad English, The Babys, and his solo career. Highlights included “Change,” “Missing You,” and “Every Time I Think of You.” Waite’s voice has held up exceptionally well over the years, and he closed his set with a powerful rendition of Led Zeppelin’s “Whole Lotta Love.” As the opener, Waite showcased his incomparable talent. His performance was captivating, leaving the crowd wanting more. Styx proved they’re still a powerhouse outfit. Led by Tommy Shaw and James Young, both lead guitarists, the entire band was a fireball from start to finish. They were joined by newly added bassist Terry Gowan who along with Todd Sucherman created an ample back bone to the band’s sound. Guitarist Will Evankovich also provides another vocal dynamic to the songs as well. Their 75-minute set packed in 13 songs that spanned their extensive catalog. They opened with “The Grand Illusion” and included a mix of favorites, as well as the title track from their latest album Crash Of The Crown. The band’s performance was energetic and polished, with Lawrence Gowan’s vocals fitting perfectly into their classic tracks. Original bassist Chuck Panozzo made a heartfelt appearance during “Lady,” and the band demonstrated why they have been a touring powerhouse, averaging nearly 100 shows a year. Styx consistently delivers high caliber shows, touring extensively year after year. Foreigner, co-headlining with Styx, delivered a set that brought their songs to life with perfection. Vocalist Kelly Hansen and bassist Jeff Pilson, the longest-ranking members, led the band through a set that managed to captivate the audience. The hit-packed set that began with “Double Vision” and was a showcase of their enduring appeal, with a set list that spanned their extensive catalog of hits. Alongside Kelly Hansen and bassist Jeff Pilson were keyboardist Michael Bluestein, drummer Chris Frazier, and guitarists Bruce Watson and Luis Maldonado. Founder and leader Mick Jones, though absent from the road, ensured that the band delivered each song to perfection. Hits like “I Want to Know What Love Is” resonated powerfully, and they closed their set with the classic “Hot Blooded.” The tour is set to continue through various locations and will conclude on August 28 in Sioux Falls, South Dakota. The bands have also released a joint compilation album, Renegades & Juke Box Heroes, available at tour stops and retail outlets, which features four songs from each band. The tour has received positive reviews, with fans and critics alike praising the bands for their lively performances and the nostalgic journey through their greatest hits. It’s clear that Styx, Foreigner and John Waite have all maintained their musical prowess and continue to captivate audiences with their timeless rock anthems.

Nearly three-fourths of voters doubt President Joe Biden is fit to serve after his shaky debate performance last week, according to a new poll. CBS News and YouGov found 72% of registered voters do not believe Biden, 81, has the mental and cognitive health to be president while 27% said that he does. For months before the debate, the nation's voters repeatedly expressed doubts over whether Joe Biden had the cognitive health enough to serve as president. Half of registered voters said former President Donald Trump, 78, does have the mental and cognitive health to serve as president while 49% said that he does not. Three weeks ago, on June 9, CBS News and YouGov found more registered voters viewed Biden as being capable of performing the duties of commander in chief. At the time, 65% of respondents did not think Biden was fit to serve while 35% said that he did possess the mental and cognitive health for the job. Democrats are reportedly panicking after the debate on Thursday and there is a push, including by The New York Times’ editorial board, for Biden to leave the race. CBS News and YouGov found 72% of registered voters say Biden should not be running for president, a 9-point jump over the 63% who said the same in February. Among Democratic registered voters, 46% say Biden should not be running for president, a 10-point increase over the 36% who said the same in the earlier poll. Most voters agreed Biden should not be running because of his age, decisions he might make in office, his record as president, and ability to campaign effectively. Ultimately, 55% of Democratic registered voters said Biden ought to continue running when asked if he should be the nominee while 45% said he should step aside. CBS News said its new poll is based on a national sample of 1,130 registered voters contacted from June 28-29 and has a margin of error of plus-or-minus 4.2 points.
