US Must Oppose International Criminal Court Bid to Prosecute Israeli Prime Minister, Defense Chief

For more than two decades, supporters of the International Criminal Court have urged the U.S. to ratify the Rome Statute and join the court. But multiple U.S. administrations of both parties refused, concerned that the ICC lacks safeguards against political manipulation and violates national sovereignty by claiming jurisdiction over the nationals and military personnel of non-party states. The ICC has just validated those concerns with its decision to issue warrants against Israeli Prime Minister Benjamin Netanyahu and Israeli Minister of Defense Yoav Gallant. The politicization of the ICC and other international organizations regarding the Israel-Palestinian situation is not new. It’s part of a broad-based effort by the Palestinian Authority to weaponize international organizations in its dispute with Israel and seek recognition absent a negotiated peace. In the case of the ICC, the Palestinians submitted a declaration to it in 2009 accepting the court’s jurisdiction in its “territory.” The ICC rejected the declaration because it was not a state recognized by the United Nations. Rather than negotiate with Israel and achieve statehood through a peace process, the Palestinians sought recognition in the United Nations. After the Security Council rejected a Palestinian bid for U.N. membership in 2011, the General Assembly granted the “State of Palestine” nonmember observer state status in 2012 over the opposition of the United States. The U.S. has opposed efforts by the Palestinians to become full members of the U.N. because, as reiterated this month, “We also have long been clear that premature actions here in New York, even with the best of intentions, will not achieve statehood for the Palestinian people.” Nonetheless, based on its elevated status in the U.N. General Assembly, the ICC recognized Palestine as a state and accepted its accession to the Rome Statute in 2015. That opened the door to an ICC investigation of “past, ongoing and future crimes within the court’s jurisdiction” within the territory of the “State of Palestine,” which the court sought to define as “the Palestinian Territory occupied in 1967 by Israel, as defined by the 1949 Armistice Line, [which] includes the West Bank, including East Jerusalem, and the Gaza Strip.” The ICC opened an official investigation into the situation in Palestine in 2021. The ICC prosecutor confirmed it would cover “crimes committed since 13 June 2014 in Gaza and the West Bank, including East Jerusalem. It is ongoing and extends to the escalation of hostilities and violence since the attacks that took place on 7 October 2023,” adding: In accordance with the Rome Statute, my Office has jurisdiction over crimes committed on the territory of a State Party and with respect to the nationals of States Parties. The U.S. opposed the investigation, asserting that the ICC lacks jurisdiction because Israel is not a party to the Rome Statute and because the Palestinians “do not qualify as a sovereign state and therefore, are not qualified to obtain membership as a state in, participate as a state in, or delegate jurisdiction to the ICC.” In addition, the prosecutor’s statement is objectionable as it implicitly endorses Palestinian territorial claims outside of a negotiated agreement with Israel. There’s also the principle of complementarity, under which the ICC is supposed to investigate only if national authorities are unwilling or unable to prosecute genuinely. Israel has demonstrated repeatedly, including during the current conflict in Gaza, that it will investigate and punish its soldiers for crimes or negligence. In defiance of this evident willingness of Israel to hold its soldiers accountable, the ICC yielded to pressure from the Palestinians, nongovernmental organizations, and a few other governments to issue arrest warrants against Israeli leaders. This is the latest stratagem in a multipronged—multilateral, bilateral, rhetorical, military, economic, and legal—effort to pressure Israel to end the current conflict and make concessions to the Palestinians. The ICC also issued warrants for Hamas leaders relating to the killing, raping, and kidnapping of hundreds of Israeli civilians on Oct. 7. But the ICC ignores Hamas’ responsibility for much of the suffering of Palestinian civilians due to the theft of humanitarian aid, use of civilians as human shields, and misusing civilian and U.N. facilities, including hospitals and schools. Instead, the court accuses Israel of willingly causing suffering and starvation even though Israel has gone to extraordinary lengths to evacuate Palestinians from harm’s way and facilitate humanitarian aid, including more than 500,000 tons of food, water, medical supplies, and shelter. In short, the ICC has enabled Palestinian lawfare efforts against Israel, damaged prospects for peace by recognizing Palestinian statehood (and, implicitly, its territorial claims), asserted jurisdiction over Israeli citizens even though Israel has rejected ICC jurisdiction, and ignored Israel’s demonstrated ability and willingness to investigate crimes. Of course, the ICC has not just targeted Israel. The ICC has also launched an investigation into American actions in Afghanistan. Like the Israel investigation, the court proceeded even though the U.S. is not a party to the Rome Statute and has rejected its jurisdiction. In response, the U.S. sanctioned ICC officials and applied political pressure that contributed to the ICC deciding to deprioritize its investigation into alleged U.S. crimes and, instead, focus on alleged crimes committed by the Taliban and the Islamic State-Khorasan. The U.S. should be willing to similarly protect its ally Israel. A condemnation by President Joe Biden falls woefully short. Legislation introduced in Congress would apply sanctions to ICC officials if the court is conducting a preliminary examination or investigation against the U.S. or allies that have not consented to ICC jurisdiction or is pursuing charges against a U.S. persons or protected persons from U.S. allies that have not consented to ICC jurisdiction. At a minimum, the U.S. should cease all cooperation with and support of the ICC and its investigations. Additionally, however, the U.S. should not neglect the instigator: the Palestinians. Annual appropriations legislation includes a provision to suspend Economic Support Fund aid to the Palestinians if they “initiate an International Criminal Court judicially authorized investigation, or actively support such an investigation, that subjects Israeli nationals to an investigation for alleged crimes against Palestinians.” Although imprecise language allowed previous administrations to dodge this requirement, it’s past time to apply this prohibition. Rewarding bad behavior ensures more of it. To protect sovereignty and preserve incentives for future peace negotiations, the U.S. should signal its strong objection to this illicit attempt by the ICC and the Palestinians to hobble Israel’s efforts to defend itself. A restaurant owner minced no words on the immense costs that are devastating his business as inflation continues to harm both owners and customers under President Joe Biden.  During the May 20 edition of Squawk Box, co-anchor Joe Kernen pointed to a specific case succinctly illustrating inflation’s devastating impact on Americans’ wallets. He prefaced his point by saying his guest Will Restaurants Investments Group Founder Brian Will’s “food costs have increased by more than 20% since 2023 and he has had to raise menu prices three times in the last year.” Will noted that the inflation crisis spurred a 24 percent rise in his food costs, a 20 percent rise in his labor costs and a whopping 50 percent rise in maintenance costs. Kernen responded, “You’re like a microcosm. So costs are up and revenues down. It sounds like, it almost sounds like stagflation.”     In fact, this inflation isn’t just hitting restaurant owners. Americans are paying far more when they go out to eat. Compared to last year, eating out cost 4.1% more in April.  Overall, Americans have dealt with a horrifying average of 5.5% inflation over the last 39 months of Biden’s presidency, compared to an average of 1.9% inflation under former President Donald Trump.  During the interview, Will made clear that raising prices three times in the last year was a very necessary choice: “Overall revenues are down 11% even after raising prices 20%. So if we hadn't raced the prices the revenues would be down even more.” Will emphasized just how hard the higher costs were hitting him, saying that repairing a restaurant fryer with current maintenance prices was more costly than replacing it. In the leftist landscape of Portland, Oregon, a woman has now been convicted by a jury of criminal harassment, a hate crime, after she misgendered and confronted a trans person who was using the women’s bathroom. The woman, Cassandra McIntyre, was sentenced to two years probation plus community service. But those who were in attendance on January 6 are suffering an even worse fate. And Glenn believes it’s for a reason. “There are things that have already been revealed and things that are coming that will show our government was deeply involved in that,” Glenn says, adding, “and it’s to paint half the country as an extremist.” Glenn is afraid that this will lead to something far worse. “I fear Beslan, or something like it is coming. The topic that most angered the social media outrage mob was Butker's emphasis that homemaking is a worthy and important vocation for women.'It is empowering to acknowledge that a woman’s hard work in raising children is not in vain.'Officially, the Kansas City Chiefs organization has not commented on the controversy. But two of the women closest to Kansas City Chiefs CEO and chairman Clark Hunt are speaking out in support of the message that Butker shared, suggesting his place on the team is not in danger.Without specifically addressing Butker, Tavia Hunt, Clark's wife, said that Butker's message is "not bigoted.""Affirming motherhood and praising your wife, as well as highlighting the sacrifice and dedication it takes to be a mother, is not bigoted. It is empowering to acknowledge that a woman’s hard work in raising children is not in vain," she wrote on Instagram."Countless highly educated women devote their lives to nurturing and guiding their children. Someone disagreeing with you doesn’t make them hateful; it simply means they have a different opinion," she added. "Let's celebrate families, motherhood and fatherhood. Our society desperately needs dedicated men and women to raise up and train the next generation in the way they should go."Tavia explained that she encouraged her daughters to pursue education and "chase their dreams." But she also taught them that raising a family with a devoted spouse is "one of the greatest blessings this world has to offer," citing studies showing that "committed, married couples with children are the happiest demographic."Invoking Proverbs 31:28, Tavia declared, "Embracing the beautiful roles that God has made is something to celebrate." Over the weekend, a man seized the opportunity to steal a vehicle owned by the Los Angeles Police Department and took it on a short joyride that resulted in injuries to one cop and two civilians.Around 3:30 a.m. on Sunday, a female officer was working security detail at Oceanwide Plaza, about a mile and a half outside Downtown L.A. While the officer was either sitting inside or standing near her police-issued SUV, a man suddenly hopped inside and began driving, dragging the officer alongside as she attempted to stop the carjacking.The suspect in the police SUV 'plowed into multiple other cars and scooters before crashing into a pole.'Despite the cop clinging dangerously the vehicle, the suspect apparently sped away at frightening speed. One witness reported seeing the cop car "flying" down the street at "60 to 70 mph ... with no lights."Other officers in the area gave chase, and the suspect drove the police cruiser a few blocks before crashing into at least one other vehicle at the intersection of West Eighth and Figueroa Streets. Video of the scene taken by KABC-TV shortly after the crash shows one vehicle with a mangled back end and a police SUV on top of a curb near a bike rack. The video also shows a third vehicle, a red van, parked in the middle of the street with obvious damage to the front end. KABC-TV did not mention a third vehicle involved, but the Post indicated that the suspect in the police SUV "plowed into multiple other cars and scooters before crashing into a pole."The suspect then got out of the vehicle and ran away on foot. He was apprehended soon afterward and arrested.Meanwhile, the officer "was ejected from the vehicle" at some point, a department statement said, either while the vehicle was in motion or from the force of the collisions. Thankfully, she suffered only minor injuries that are not considered to be life-threatening, the department said. As of Monday morning, her condition was listed as "stable," the AP reported.Two other people were inside one of the vehicles struck by the cop car driven by the suspect. Both also sustained injuries that are not considered to be life-threatening and were treated at a nearby hospital.The identities of the injured officer and the suspect have not been released. President Joe Biden spent part of his commencement address Sunday at traditionally black school Morehouse College addressing racial issues, specifically telling graduates that black men are getting killed in the streets of America — and that the country doesn't love black men as much as black men love the U.S.Biden told those in caps and gowns that they missed their high school graduations because of the COVID pandemic, National Public Radio reported, and then added that they "started college just as George Floyd was murdered, and there was a reckoning on race."'It’s natural to wonder if democracy you hear about actually works for you.' "It’s natural to wonder if democracy you hear about actually works for you," he told the graduates. "What is democracy if black men are being killed in the street? What is democracy if a trail of broken promises still leave black communities behind? What is democracy if you have to be 10 times better than anyone else to get a fair shot?
