Abbas and an unknown man raped a girl at preschool - Court of Appeal: "Not a serious crime"

LAW & JUSTICE. The Court of Appeal shares the district court's assessment. It was not serious rape when Abbe, who claims to be 22 years old, raped a 13-year-old girl at a preschool in Märsta.
On September 10, 2022 in Märsta, a 13-year-old girl was raped by Abbas, called "Abbe". Moments later, the girl was raped once more by another Afghan, who remained unidentified during the police investigation.
During police questioning, the girl told that she met a friend at around 3-4pm during the day. The girls met Abbas, another man called Mohammad and a third unknown man at a preschool. At the preschool, Abbas performed oral and vaginal intercourse with the girl.
A while later, the same girl was raped again, this time by the unknown man in a wooded area by Östregårds väg.
Three days later, a report of child rape was made. Abbas was arrested on 20 September and detained on 23 September.
Previously suspected of attempted rape
During the police investigation, information has emerged that Abbe was suspected of attempted rape of children in 2018. This by having tried to force a girl to have intercourse by pulling down her pants. The girl had just turned 15 at the time of reporting. However, the investigation was dropped due to evidence problems, the police preliminary investigation report states.
Criminal record extracts show that between 2017 and 2021, Abbas was guilty of shoplifting, illegal driving, weapons offences, drug offences, unlawful threats, driving bans, minor drug offenses and attempted robbery
"Alone"
Public documents seen by Fria Tider show that Abbas came to Sweden as an "unaccompanied refugee child" and claimed to have been born in 2001. He applied for a residence permit on January 13, 2015 and was granted a permanent residence permit on June 16 of the same year. Abbas became a Swedish citizen on April 4, 2018.
In the charge register it is stated that Abbas was born in Afghanistan, but in the Prison Service's personal investigation it appears that he was born in Iran.
The district court's verdict
On 27 February 2023, the Attunda district court announced its verdict. Abbas was convicted of child rape, three counts of drug offenses and drunk driving. The penalty was three years in prison. He was also required to pay damages to the girl of SEK 225,000 in compensation for violation and SEK 30,000 for mental and physical suffering.
Mohammad was sentenced for sexual molestation of children then allegedly hit the girl on the bottom at the time the rape was committed. The penalty was a suspended sentence and SEK 8,800 in daily fines. He was also sentenced to pay SEK 10,000 in damages to the girl.
The Court of Appeal shares the assessment
On 10 May 2023, the Svea Court of Appeal announced its verdict. The Court of Appeal upholds the verdict against Abbas.
The girl and the prosecutor demanded that the Court of Appeal should classify the act as serious and that Abbas should be sentenced to a longer prison term than what the district court has decided. But the Court of Appeal does not agree with this.
"Like the district court, the court of appeal finds that it has not been shown that Abbas has had sexual intercourse together and in agreement with another unknown perpetrator. The court of appeal shares the district court's assessment that the act should not be classified as a serious crime," writes the court of appeal.
Mohammad was fully acquitted of the charges. The reason is that it has not been proven that it happened as the prosecutor and the girl told, according to the Court of Appeal.
The man who carried out the second rape has still not been identified and is still at large.
Since Abbas has received Swedish citizenship, it is not possible, with current legislation, to deport him from Sweden.
