FCC Considers Jettisoning Longstanding Rule Limiting Broadcasters

Millions of Americans may soon see changes to their television programming if a decades old broadcast restriction that impacts TV station ownership is modified. The Federal Communications Commission currently caps an entity from reaching more than 39% of U.S. TV households, but the federal agency is considering changing that rule. The longstanding federal regulation will likely be the topic of a Dec. 17 Senate Commerce Committee hearing, chaired by Sen. Ted Cruz, R-Texas, where all three FCC commissioners are set to testify. The federal rule has divided Republican leaders. FCC chairman Brendan Carr has considered modifying the federal agency’s cap on commercial broadcasters in the past. “Over the decades, as the media landscape has evolved, the Commission has revisited these rules to account for new competitors and advances in technology,” Carr said in a statement released in June. “Those changes have only accelerated in recent years with the advent of online offerings. Broadcasters now compete for eyeballs with YouTube stars, social media platforms, and streaming services like Hulu and Netflix, not to mention traditional cable and satellite offerings,” the federal regulator continued. Carr went to explain that he believed the FCC had the authority to change the cap without further legislative action by Congress. Meanwhile, President Donald Trump has expressed concerns about left-wing networks potentially expanding their footprints in the United States if the FCC cap is discarded. “If [lifting the FCC cap] would also allow the Radical Left Networks to “enlarge,” I would not be happy,” the president wrote in part on Truth Social, adding, “ABC & NBC, in particular, are a disaster–A VIRTUAL ARM OF THE DEMOCRAT PARTY.” “They should be viewed as an illegal campaign to the Radical Left. NO EXPANSION OF THE FAKE NEWS NETWORKS. If anything, make them SMALLER!” Trump added. However, the National Association of Broadcasters, a trade organization that includes major media companies, is in favor of ending the cap.  “Local broadcasters are not asking for special treatment; we are asking for the ability to compete in today’s media landscape,” NAB president and CEO Curtis LeGeyt said in a statement provided to The Daily Signal.  “Lifting the arbitrary 39% limit, which applies only to broadcast stations, will allow station groups to invest in local journalism, sports rights and the technology that keeps communities informed during emergencies, especially in smaller markets,” LeGeyt continued. “The national cap was imposed during an era before broadband and streaming reshaped how Americans get their news, and the longer Washington delays addressing it, the harder it becomes for local stations to sustain the trusted local news and reporting that Americans rely on every day. We appreciate Chairman Carr’s recognition that empowering local broadcasters will require modern ownership rules, and we look forward to swift FCC action,” the NAP president concluded. Many in the greater New Orleans area, particularly in Latino communities, have been on edge since the planned operations were reported earlier this month, even as Republican Louisiana Gov. Jeff Landry said he welcomes the federal agents. Here’s what to know about “Swamp Sweep.” Bovino has become the Trump administration’s go-to operative for leading large-scale, high-profile immigration enforcement campaigns. During his operation in Chicago, federal agents rappelled from a helicopter into a residential apartment complex and fired pepper balls and tear gas at protesters. Federal agents arrested more than 3,200 immigrants during a surge in the Chicago area in recent months, but have not provided many details. Bovino will be joined by 250 Department of Homeland Security agents – roughly the same number sent to other cities to assist the top Border Patrol official, the sources said. In response to CNN’s questions about operations in New Orleans last week, DHS sent CNN a statement from Assistant Secretary Tricia McLaughlin: “For the safety and security of law enforcement, we’re not going to telegraph potential operations.” It’s unclear how long the agents are expected to stay in New Orleans. President Donald Trump has previously floated New Orleans as a destination for his federal crackdown, saying in an Oval Office meeting this year the city “has a crime problem.” The Crescent City is a Democrat oasis in a Republican state, whose governor is a Trump ally. The Department of Homeland Security (DHS) sent a letter to New York Attorney General Letitia James demanding that she “honor ICE arrest detainers of the more than 7,000 criminal illegal aliens in the state’s custody.” The 7,000+ “criminal illegal aliens” include “murderers, sexual predators, and those convicted of or charged with weapons offenses,” DHS stated. U.S. Immigration and Customs Enforcement (ICE) sent a letter to James in September “asking for cooperation in honoring ICE detainers on criminal illegal aliens.” Her office did not respond. The crimes of these aliens include 29 homicides, 2,509 assaults, 199 burglaries, 305 robberies, 392 dangerous drugs offenses, 300 weapons offenses, and 207 sexual predatory offenses. There are currently 7,113 aliens in the custody of a New York jurisdiction with an active detainer. The crimes of these aliens include 148 homicides, 717 assaults, 134 burglaries, 106 robberies, 235 dangerous drugs offenses, 152 weapons offenses, and 260 sexual predatory offenses. “These are people who are not only in the country illegally, but who have committed additional crimes, including heinous crimes like murder, rape, possession of child pornography, armed robbery, and many others,” ICE Director Todd Lyons wrote in the letter, according to the New York Post. “Attorney General James and her fellow New York Sanctuary politicians are releasing murderers, terrorists, and sexual predators back into our neighborhoods and putting American lives at risk,” said Assistant Secretary Tricia McLaughlin. “We are calling on Letitia James to stop this dangerous derangement and commit to honoring the ICE arrest detainers of the more than 7,000 criminal illegal aliens in New York’s custody. It is common sense. Criminal illegal aliens should not be released back onto our streets to terrorize more innocent Americans,” she added. The New York Post shared further: The agency included a supplemental with its letter highlighting a dozen migrants with heinous criminal histories who were released from custody in New York in recent months rather than being turned over to immigration authorities. Among them was Anderson Smith Satuye Martinez, a Crips gang member with a prior assault conviction who was busted Aug. 19 for criminal possession of a weapon and possession of a controlled substance. Despite an ICE detainer lodged against him, he was released by local authorities before ICE picked him up again on Sept. 11 in the Bronx. ICE also locked up Jose David Hernandez Hernandez, who was arrested for rape, strangulation and assault before being released. After immigration agents’ intervention, he’s now in ICE custody awaiting the outcome of deportation proceedings. Also caught and released by New York authorities was career criminal migrant Alexander Moreno Montoya, who has charges including assaulting a police officer, criminal possession of a weapon and cocaine possession. Although he was under an ICE detainer, he was released from Rikers Island on March 17, only to be caught by ICE ERO NYC on July 7 and removed from the US. “Please confirm whether the State of New York plans to honor detainers on these aliens or whether each of these barbarians will someday walk the streets of New York again,” the letter to James pointedly concludes.
