EXCLUSIVE: DHS Accuses NPR of ‘Race-Baiting Smears’ Against ICE Agents

The Department of Homeland Security has accused National Public Radio of “race-baiting smears” against U.S. Immigration and Customs Enforcement agents.   “Baseless accusations of ‘racial profiling’ by NPR and other outlets are contributing to a 1,000% increase in assaults against ICE law enforcement,” DHS said in a statement Monday evening.   The response from DHS follows a Monday morning NPR report on the outlet’s “Morning Edition” program, in which a U.S. citizen going by the nickname “Chilo” claims she was “questioned by masked officers” on the streets of Washington, D.C., regarding her citizenship status.   NPR’s Michel Martin reports that Chilo thinks she was profiled because of her “black hair and brown skin.” Chilo tells Martin the interaction with masked law enforcement frightened her because she “thought they’re going to take me away.”   Chilo, 53, is from Nicaragua, but was adopted and became a naturalized citizen when she was 9, according to NPR. The woman told NPR she was carrying both her REAL ID and a copy of her passport at the time of the interaction with the agents.   “It is completely illegal for the federal government to detain a U.S. citizen for immigration purposes and to subject them to deportation,” Marissa Montes, a professor at Loyola Law School and director of the Loyola Immigrant Justice Clinic, said in the NPR report.   The allegations of “racial profiling,” according to DHS, are “false.”   “No record or evidence of these anonymously sourced claims exist,” DHS said.   DHS Assistant Secretary Tricia McLaughlin said it is “shameful that NPR would run anonymous and unsubstantiated allegations to smear our brave law enforcement as they are facing a more than 1,000% increase in assaults against them.”   “What makes someone a target of ICE is if they are illegally in the U. S.—NOT their skin color, race, or ethnicity,” McLaughlin said.   DHS Secretary Kristi Noem “has unleashed ICE to target the worst of the worst—including gang members, murderers, and rapists,” she continued, adding that “70% of ICE arrests are of criminal illegal aliens who have been convicted or have pending charges in the U.S.,” adding: President [Donald] Trump and [DHS Secretary Kristi] Noem are putting the American people first by removing illegal aliens who pose a threat to our communities. NPR acknowledged receiving a request for comment from The Daily Signal, but did not provide a response by the time of publication. DOJ Files Another Emergency Appeal After Court Yet Again Orders Foreign Aid Restored 

The Department of Justice filed an emergency appeal Monday asking the Supreme Court to pause a lower court demand that the Trump administration continue funding Biden-era foreign aid programs.  The lower court order, issued Sept. 3 by Judge Amir Ali in the U.S. District Court for the District of Columbia, requires the Trump administration to disburse almost $4 billion worth of foreign aid grants by Sept. 30.   Those grants were originally designated by Congress in 2024 to be spent by the State Department and the U.S. Agency for International Development before the end of this month. But they were terminated by President Donald Trump in early 2025 following his order that “no further United States foreign assistance shall be disbursed in a manner that is not fully aligned with the foreign policy of the president of the United States.”  The grant recipients appealed, kicking off a months-long legal battle in which Ali, a Biden appointee and a dual citizen of Canada, issued multiple orders demanding that the administration spend the money.   The grant recipients included organizations such as the Global Health Council and the AIDS Vaccine Advocacy Coalition.  In August, a federal appeals court said Ali’s decision was wrong but didn’t issue an order to reverse it—meaning Ali’s demand remained in place. That prompted U.S. Solicitor General D. John Sauer to take the case to the Supreme Court.   Days later, though, on Aug. 28, the appeals court finally issued a mandate lifting Ali’s order, prompting Sauer to withdraw his petition at the Supreme Court. That same day, the Trump administration asked Congress to rescind the $4 billion in funding—a decision that Congress now has 45 days to consider.  But on Sept. 3, Ali issued yet another preliminary injunction instructing the administration to spend the funds, saying that the Trump administration’s grant terminations likely violated the Administrative Procedure Act, a law that prescribes the formal process for executive branch agencies to create rules and regulations.  Sauer appealed, but the appeals court denied his request for a stay on Friday—prompting him to take the case back to the Supreme Court Monday.  In his petition, Sauer asks the court to pause the order while Congress considers rescinding the money, calling it “self-defeating and senseless” for the administration to be forced to spend the funds it’s asking the legislature to cancel.  “The district court’s last-ditch injunction self-evidently harms the government and the political process,” posing “a grave and urgent threat to the separation of powers,” Sauer said.  The post DOJ Files Another Emergency Appeal After Court Yet Again Orders Foreign Aid Restored  appeared first on The Daily Signal.

Obama Judge Who Blocked Planned Parenthood Defunding Takes Aim at Laken Riley Act

A Barack Obama-appointed judge delivered a blow to the Laken Riley Act, a law that passed with bipartisan support and that prioritizes the arrest of illegal aliens with certain criminal records.  U.S. District Judge Indira Talwani of the District of Massachusetts is the same judge who in July ruled to secure federal taxpayer funding for Planned Parenthood after Congress voted to defund the nation’s largest abortion provider.  Talwani ruled late Friday that detaining an individual solely on the basis of his prior arrest record violates due process. The case involved a young illegal immigrant arrested for shoplifting on July 4. The judge focused on the individual case and did not assert the Laken Riley Act itself was unconstitutional.  “The risk of erroneous deprivation of petitioner’s liberty is high where, as discussed above, his detention is based on an arrest for which no charges have been filed and the underlying conduct for which bears no relationship to dangerousness or flight risk,” Talwani wrote in the ruling.  The Laken Riley Act, the first bill President Donald Trump signed into law in his second term, requires Immigration and Customs Enforcement to arrest and detain illegal aliens who “commit theft offenses” and also gives states the authority to sue federal officials who refuse to enforce immigration laws. The law is named after Georgia nursing student Laken Riley, who was murdered by an illegal alien in February 2024.  Under the law, detention is mandatory even if an illegal immigrant wasn’t convicted of a prior arrest.  In this case, the American Civil Liberties Union of Massachusetts defended an 18-year-old illegal immigrant who had been arrested as a minor—but was not convicted—for shoplifting. Talwani determined detaining him without a bond hearing under the Laken Riley Act violates his right to due process. She ordered him to be released if a bond hearing is not provided for him by Sept. 10. The ACLU celebrated the ruling.  “Courts have been crystal clear that immigration detention must comport with due process and no one in the United States can be deprived of their liberty without any process or justification,” said My Khanh Ngo, senior staff attorney with the ACLU Immigrants’ Rights Project in a public statement. “The Laken Riley Act is anathema to those constitutional principles, and we are pleased the court recognized this and granted a bond hearing for our client.” Appointed by President Barack Obama in 2013, Talwani had a controversial record on the bench even before July when she imposed a temporary restraining order directing the Department of Health and Human Services to ensure Medicaid funding continued to be disbursed to Planned Parenthood, which sued to restore its funding after Congress withdrew it.  In April of this year, in a separate immigration case, Talwani blocked the Trump administration from revoking the work permits of 530,000 illegal immigrants from Cuba, Haiti, Nicaragua, and Venezuela. In June 2023, Talwani sided with a Massachusetts school district to prevent a 12-year-old student from wearing a T-shirt that said, “There are only two genders,” at school. During the first Trump administration, in June 2019, Talwani issued a decision ordering Immigration and Customs Enforcement to stop arresting people at Massachusetts courthouses while they were attending or leaving a courthouse on official court business.  The plaintiff in the case Talwani ruled on Friday, only referred to in court documents as “John Doe,” came to the United States in 2021, when illegal immigrants were flooding the country in the first year of the Biden administration. He was given “special immigrant juvenile status,” which allowed a pathway for young people who were victims of abuse or abandonment to become lawful permanent U.S. residents, according to the ACLU.  The plaintiff was arrested by local police in Massachusetts on July 4 based on an accusation of shoplifting. He was held at the Plymouth County Correctional Facility.  “It is unthinkable to imprison someone in the United States without due process based solely on unproven accusations,” Jessie Rossman, legal director at the ACLU of Massachusetts said in a public statement. He added, “The court ruled this violates the law and must cease. Congress is weighing whether to lift sanctions on Syrian President Ahmed al-Sharaa, a former jihadist seeking to legitimize himself on the world stage. Rep. Josh Brecheen, R-Okla., is making clear he’s not eager to lift those sanctions on the newly minted leader, given the killings and clashes involving ethnic minorities that have occurred during his tenure. “He was a thug six months ago,” Brecheen told The Daily Signal. “This Islamist, ISIS thug, he’s put ISIS leaders in his military, the same people that I’m convinced that are complicit in trying to exterminate these people.“ Rep. (Anna Moneymaker/Getty Images) Al-Sharaa, also known by his nom du guerre Abu Mohammad al-Jolani, was formerly a member of jihadist groups such as al-Qaida and the Islamic State of Iraq, and led the Al-Nusra Front. He took power in late 2024 after leading a coalition of armed groups in toppling longtime dictator Bashar Assad. In recent months, reports have poured in of killings of civilians in Syrian sectarian clashes, many of them Druze, an ethno-religious minority. Although the Syrian government has publicly pledged to stop the killings of ethnic minorities, the bloody clashes have continued, with hundreds killed in the southern district of Sweida in conflicts between the Sunni Bedouin tribes and the Druze people. Currently, Syria is subject to strict American sanctions under the Caesar Syria Civilian Protection Act of 2019, which came into effect during the Assad regime and was extended for five more years during the Biden administration. It was renewed for five more years shortly after Al-Sharaa took power in late 2024.The act is named after a person identified only as “Caesar,” who documented torture of civilians by Assad’s regime. Some in Congress are proposing repealing the sanctions in the upcoming annual defense bill. That push follows President Donald Trump signing an executive order in June to remove sanctions on Syria.  The order proposed a hopeful, yet cautious treatment of the new Syrian leader, with a White House press release stating that “President Trump wants Syria to succeed—but not at the expense of U.S. interests.” Rep. Joe Wilson, R-S.C., offered an amendment to the annual defense bill Wednesday before the House Rules Committee to repeal the Caesar Act completely. “The Caesar law undermines the president’s policy and makes it almost impossible to, quote, ‘give Syria a chance,’ as proposed by President Trump,” said Wilson.  Grateful to testify before the House Rules Committee in support of my amendment to repeal the Caesar Act in the NDAA!It’s time to give Syria a chance and I hope the Committee will allow my amendment. pic.twitter.com/Rzp1nObAbv— Joe Wilson (@RepJoeWilson) September 8, 2025 Brecheen, however, says it would be difficult for him to embrace Al-Sharaa. “The terrorist that is leading Syria now, six months ago, ISIS [and] al-Qaida is what he was wearing the uniform for,” Brecheen told The Daily Signal. “And so now, he’s put on a suit and Al-Sharaa Julani, he is now the leader of Syria.” Brecheen added: “And many people—I’m one of them—believe that he is not just unable to control the jihadists that are part of his military structure. I’m one of those people that is convinced that he is complicit in the at least 2,000, 1,800, confirmed dead in what’s called the Sweida district.” “As of last Wednesday, there were 20 members of Congress who obtained a briefing with some firsthand knowledge that there may be … 750,000 people [in] an arid region, they could be with within two weeks of having no water, because of the poisoning and bombing of wells.
