Last week, China anchored one of its two “Monster Ships” — the largest Coast Guard ships in the world — within the exclusive economic zone of Manila, the capital of the Philippines. The vessels are 165 meters long and displace 12,000 tons of water, making them three times the size of the U.S. Coast Guard’s main patrol ships. The Situation Using Canada’s Dark Vessel Detection technology, the Philippines tracked the movements of CCG-5901, the “Monster Ship,” after it left Hainan, China on July 1. The ship entered the Philippine exclusive economic zone the next day and anchored itself about 800 yards from a Philippine Coast Goard boat. The “Monster Ship” has also deployed a smaller boat in the exclusive economic zone.   An exclusive economic zone is an area of 200 nautical miles, equivalent to 230 miles, beyond a nation’s territorial sea that they have jurisdiction over. Exclusive economic zones were established in 1982 through the UN Convention on the Law of the Sea. The Chinese vessel docked about 80 miles off the Philippine island of Palawan near the Sabrina Shoal. The Shoal is part of the Spratly Islands, which have long been quarreled over by the two countries. Intimidation and Motivation Jay Tarriela, the spokesperson for the Philippine Coast Guard, called China’s actions an “intimidation” at a news forum on Saturday, according to Reuters. He also vowed, “We’re not going to pull out and we’re not going to be intimidated.” The Philippines’ exclusive economic zone is one of the most highly contested in the world. China has laid claim to 90 percent of the South China Sea. This claim encroaches upon the exclusive economic zone of five other countries, including the Philippines’. Brunei, Vietnam, and Malaysia have also attempted to claim parts of the Philippines’ exclusive economic zone for themselves. In 2016, The Hague Tribunal ruled that China does not have a claim to the majority of the South China Sea. China has largely ignored the ruling and is in the midst of multiple territory disputes. Responses On Monday, July 8, Japan and the Philippines signed a defense pact called the Reciprocal Access Agreement. The agreement allows Japan to deploy forces in the Philippines for joint drills and Filipino forces to enter Japan for joint combat training. The legislatures of both countries still must approve the pact. China reprimanded Japan’s entrance into the agreement, asking Japan to “seriously reflect on its history of aggression.” Japan invaded and occupied the Philippines during World War II. The two countries have since opened relations over mutual concerns about China’s growing military power and influence in Asia. Japan is also in a territorial dispute with China over the Senkaku Islands between Taiwan and the Japanese island Okinawa. The Philippines turned down U.S. offers for assistance in the South China Sea. Romeo Brawner, Filipino Armed Forces chief general, told Reuters the Philippines will “try to exhaust all possible options that we have before we ask for help.” (READ MORE: US Returns to the Philippines to Fend Off China) Future Consequences This is not the first time China has made an inflammatory move against the Philippines. Though the Philippines have thus far rejected U.S. aid offers, should tensions continue to escalate, the U.S. may still become involved in the conflict. In 1951, the two countries signed the U.S.-Philippines Mutual Defense Treaty, which stipulates that if there is an attack against one nation, the other must come to its aid. Japan has a similar treaty with the U.S., the U.S.-Japan Security Treaty. Since the U.S. has mutual defense treaties with the Philippines and Japan, who also have a defense pact (though not a mutual defense treaty), the U.S. could quickly become embroiled in a conflict in the South China Sea. As a member of NATO, U.S. involvement could result in NATO involvement. Japan has also been invited to the NATO summit in Washington, D.C., which is occurring this week, along with three other countries from the region, showing NATO’s growing interest in the region. (READ MORE: Time for an Asian NATO?) On Sunday, an American citizen was injured in Lebanon by shrapnel from Hezbollah missiles fired at Israel. This tragic incident is another example of the state’s inability to protect U.S. citizens abroad, a trend that has become too common during the Biden administration. Hezbollah is a Shiite political and militant group based in Lebanon notorious for its international terrorist attacks. The war in Gaza reignited the decades-old conflict between Hezbollah and Israel, putting thousands of civilians in danger. Last Wednesday, an Israeli drone strike in Lebanon assassinated a senior Hezbollah military commander, prompting Hezbollah to launch hundreds of rockets and mortars at Israel the following day. Two weeks earlier, on June 27, Canada officially announced contingency evacuation plans to withdraw 45,000 citizens from Lebanon, citing a potential increase in fighting between Hezbollah and Israel. Gen. Wayne Eyre, the leader of Canada’s defense team, said “We can’t do it alone … It will very much be a coalition effort, and we are tightly tied in — very tight — with our allies.” Reports also emerged from defense officials that the U.S. is preparing to evacuate Americans from Lebanon if fighting between Israel and Hezbollah increases. In three short years, the Biden administration has partially or fully evacuated 11 U.S. embassies — the most in U.S. history — in Burma, Chad, Afghanistan, Ethiopia, Ukraine, Belarus, Russia, Nigeria, Sudan, Niger, and Haiti. For context, former President Barack Obama recorded the second-most embassy evacuations with eight throughout his two terms. Former President Donald Trump ordered three partial evacuations in his one term. Recent evacuations have been notably chaotic. In 2021, 13 American service members were killed during the withdrawal from Afghanistan, and two Americans lost their lives while evacuating from Sudan in 2023.  In Afghanistan, Sudan, and most recently in Haiti this March, the U.S. has left thousands of private American citizens behind while airlifting embassy staff out by helicopter. As of 2022, 86,000 Americans live in Lebanon and in 2006, the U.S. evacuated 15,000 people from the country during Israel’s war with Hezbollah. While the official number of casualties is unknown, the conflict has displaced more than 100,000 Lebanese civilians. The research platform’s insights highlighted the time lag between the final Federal Reserve rate hike and the onset of a recession. According to the data, previous recessions followed the last rate hikes with varying delays: five months in 1960, three months in 1970, two months in 1973 and 1980, one month in 1981, 17 months in 1990, 10 months in 2001, and 18 months in 2008. Will Biden transmit “his written declaration that he is unable to discharge the powers and duties of his office” to Congress? Or will the vice president and a majority of the Cabinet inform Congress of President Biden’s incapacity and remove him from office? Kamala Harris  constitutional duty is clear; the president is clearly incapable, and she is on the hot seat as the one required to initiate 25th Amendment proceedings. Section 3 of that amendment describes the voluntary stepping-down of the president: Whenever the President transmits to the President pro tempore of the Senate and the Speaker of the House of Representatives his written declaration that he is unable to discharge the powers and duties of his office, and until he transmits to them a written declaration to the contrary, such powers and duties shall be discharged by the Vice President as Acting President. In this case, this would presumably (and, I would argue, necessarily) be followed by a formal resignation, after which (ugh) Kamala Harris would be sworn in as president. This would also place her in the slot as the presumptive Democrat nominee for the 2024 presidential election, The involuntary process is a bit more involved and includes at least one major stumbling block: Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President. The president has the option to contest this, and the balance of Section 4 describes that process. But here’s the catch: Removing an unwilling president under the 25th Amendment requires a two-thirds vote in both the House and Senate. Margot Cleveland continues:  we are now at the point where the inaction by Vice President Kamala Harris and Biden’s Cabinet constitutes a violation of their oath of office. They solemnly swore they would “bear true faith and allegiance” to the Constitution and that they would “faithfully discharge the duties of the office.” That oath mandates they provide Congress “their written declaration that the President is unable to discharge the powers and duties of his office…” There is no wiggle room. No “wait and see” if the president can convince the public he is fit for office, whether by choreographed appearances or edited prime-time interviews.
