Decades-Old Handgun Sales Ban Is Unconstitutional, Federal Appeals Court Rules

A federal appeals court ruled on Thursday that a decades-old ban on federally licensed firearms dealers selling handguns to individuals aged 18-20 is unconstitutional. The New Orleans-based 5th U.S. Circuit Court of Appeals cited the U.S. Supreme Court’s landmark 2022 ruling in New York State Rifle & Pistol Association, Inc. v. Bruen. “The three judge panel consisted of Judge Edith Hollan Jones, a Ronald Reagan appointee; Judge Jennifer Walker Elrod, a George W. Bush appointee; and Judge Rhesa Hawkins Barksdale, a George H.W. Bush appointee,” Breitbart noted. “Ultimately, the text of the Second Amendment includes eighteen-to-twenty-year-old individuals among ‘the people’ whose right to keep and bear arms is protected,” the opinion read, according to the New York Post. “The federal government has presented scant evidence that eighteen-to-twenty-year-olds’ firearm rights during the founding-era were restricted in a similar manner to the contemporary federal handgun purchase ban, and its 19th century evidence ‘cannot provide much insight into the meaning of the Second Amendment when it contradicts earlier evidence,’” it added. The federal appeals court ruled against a lower court’s decision upholding the ban. The Biden Justice Department defended the ban in the case brought by a group of 18-20 year-olds with the assistance of the Firearms Policy Coalition and the Second Amendment Foundation. The plaintiffs brought the case to the 5th Circuit in an attempt to appeal a Louisiana federal judge’s ruling upholding the statute. “Today’s ruling is yet another critical FPC win against an immoral and unconstitutional age-based gun ban. We look forward to restoring the Second Amendment rights of all peaceable adults throughout the United States,” Firearms Policy Coalition President Brandon Combs said in a statement. Ultimately, the three-panel of the Fifth Circuit rule reversed the judgment of the United States District Court for the Western District of Louisiana, remanding the case for “further proceedings consistent with [the panel’s] opinion.” Second Amendment Foundation founder and executive vice president Alan Gottlieb cheered the decision, saying, “We have always maintained that young adults, who can vote, join the military, get married, enter into contracts and even run for office can also enjoy the full rights of citizenship which includes rights guaranteed by the Second Amendment. If we can trust young adults to defend our country, we can certainly trust them to own any and all legal firearms.”

The last two days have been full of confirmation hearings for nominees chosen by President Trump to fill key positions in his new administration. JFK Jr, Tulsi Gabbard, and Kash Patel have taken up the majority of the airwaves regarding their respective nominations. But President Trump took to social media just a short time ago with the news of a big win, the impact of which will surely be felt across energy markets and national security discussions for decades to come. America is BACK. pic.twitter.com/2fDtVsSq0D — The White House (@WhiteHouse) January 31, 2025 A majority of democrats in the Senate joined Republicans voting in favor of Burgum’s confirmation, according to a report by the Associated Press: The Senate confirmed Doug Burgum as interior secretary late Thursday after President Donald Trump tapped the North Dakota billionaire to spearhead the Republican administration’s ambitions to boost fossil fuel production. The vote was 79-18. More than half of Senate Democrats joined all 53 Republicans in voting for Burgum. Burgum, 68, is an ultra-wealthy software industry entrepreneur who came from a small North Dakota farming community, where he worked at his family’s grain elevator. He served two terms as governor of the oil-rich state and launched a presidential campaign in 2023, but dropped out months later and quickly endorsed Trump. Trump also picked Burgum to chair a new National Energy Council that’s tasked with achieving American “energy dominance.” He would have a seat on the National Security Council — a first for the interior secretary. His directive from Trump is to make it even easier for energy companies to tap fossil fuel resources, including from public lands. You can bet that DRILL BABY DRILL is back, and so is American energy dominance! Maybe most importantly, we will no longer fall prey to OPEC price manipulation and the economic leveraging that happens under democrat administrations who constantly cut America off at the knees in the interests of extreme environmentalism. The abundance that President Trump has been touting lately will come through a policy that taps America’s natural energy resources. Burgum will directly oversee environmental policies for American public lands, according to a report in The Hill: Burgum, a one-time candidate for the 2024 GOP presidential nomination-turned-visible Trump campaign surrogate, has been among the president’s least controversial nominees. He advanced out of the Senate Energy and Natural Resources Committee last week in a nearly unanimous vote, with only Sens. Ron Wyden (D-Ore.) and Mazie Hirono (D-Hawaii) voting against the nomination. As Interior secretary, Burgum will oversee environmental policy and the nation’s public lands. Trump has vowed on the campaign trail and in his early actions as president to expand oil and gas development and roll back environmental protections enacted under the Biden administration. In remarks at his confirmation hearing, the former governor signaled support for those priorities, saying, “We live in a time of tremendous abundance, and we can access that abundance by prioritizing innovation over regulation.” The vote comes the day after the Senate confirmed Environmental Protection Agency Administrator Lee Zeldin in a 56-42 vote. Check out his speech from the Republican National Convention in Milwaukee six months ago. As a former governor, he applauded President Trump for cutting through red tape and taxes which he described as having ‘a beautiful breeze’, compared to having the ‘gale force wind’ in your face with Biden in the White House. Burgum’s confirmation is a sure vote in favor of energy dominance, and our ability to stand toe-to-toe with China as they attempt to supplant America as the global leader in multiple arenas. While Burgum’s confirmation wasn’t considered a hard sell in Congress, every victory is a celebration right now in the Trump White House as they seek to place the right people in key positions to ensure success over the next four years.

In the 10 days since President Donald Trump has taken office, he has already visited multiple domestic disaster sites in addition to a plate full of other second-term priorities. After the recent crash involving a military helicopter and an American Airlines jet, the president once again demonstrated a level of media availability that stands in stark contrast to his predecessor. When one reporter asked whether he was planning to visit the site of the crash, however, a seemingly perturbed Trump offered a somewhat terse reply, per HuffPost: “I have a plan to visit, not the site because — you tell me, what’s the site? The water?” Trump told reporters at the White House. “You want me to go swimming?” The midair collision happened Wednesday night as an American Airlines jet was about to land at Ronald Reagan Washington National Airport. There were 64 people on the plane and three military personnel in the helicopter. Officials said there were no survivors, and by Thursday morning authorities had pulled 28 bodies from the frigid Potomac River. The moment was widely shared on social media, with many commenters defending Trump’s dismissive reply: That’s funny. Wednesday night. There were no survivors of the deadly crash, which claimed 67 lives. During the press conference, Trump railed against former presidents Barack Obama and Joe Biden for allegedly lowering the standards for air traffic controllers through diversity programs. “I changed the Obama standards from very mediocre at best to extraordinary. You remember that, only the highest aptitude, the highest intellect, and psychologically superior people were allowed to qualify for air traffic controllers,” Trump said. “And then when I left office and Biden took over, he changed them back to lower than ever before. I put safety first. Kash Patel’s first day of confirmation hearings have been as cataclysmic as anyone guessed, and as promising as many of us hoped leading up to today’s hearing. During questioning, Senator Josh Hawley took up a subject with President Trump’s pick to lead — and fix — the FBI which he has often focused on during Congressional hearings. Sen. Hawley reminded Patel in particular of the notorious memo which directed the FBI to in fact target Christians and Christian churches based on their religious grouping. Patel, possibly even more familiar with the circumstances of that memo than Sen. Hawley, was perfectly clear that no such mandate exists under which the FBI could or should engage in such actions. What is more, he committed to ending the Biden-era targeting of Christians by the FBI, and vowed the full resources of the FBI to investigate those responsible for doing so and holding them accountable. What is more, Sen. Hawley pressed Patel to commit to investigating and holding accountable those responsible for doing so, according to a report by Fox News: Patel told Hawley that the senator has his “commitment” to “investigate any matters such as this” that “are important to Congress.” “I will fully utilize, if confirmed, the investigative powers of the FBI to give you the information you require, and also to hold those accountable who violated the sacred trust placed in them at the FBI,” Patel told Hawley. Hawley responded, “I’m glad to use the word sacred trust, because that’s exactly what it is. The FBI’s the most powerful law enforcement body in this nation, arguably the most powerful law enforcement body, at least in a free nation in the world and to have this body corrupted politically such that it is targeting people of faith in this country and then lying about it to this committee and the American people is unimaginable.” “I’ll be honest with you, I never thought this would happen in the United States of America, I just didn’t. If you had told me five years ago we’d be reading memos like this, I would have said, no way, no way. That’s bad fiction. In fact, it’s a horrible reality. The department needs to be cleaned up.” The soon-to-be Director of the FBI didn’t miss a beat when asked if he would investigate who was responsible and hold them accountable for the targeting of Christians based on religious affiliateion. Hawley correctly labeled Wray’s allowances on the matter. Hawley questioned Biden’s Attorney General Merrick Garland about the memo. The Attorney General stonewalled as well, feigning the same personal shock over the nature of the memo as well. And yet, no one was held responsible or faced any repercussions that we know of, and the targeting continued on multiple fronts throughout the Biden administration’s oversight of the FBI with nothing but rubber stamp approval from Biden’s DOJ. For others — Congressional democrats in particular — it represents an immediate threat to their power, and possible retribution for past actions, according to a story in The Hill: Kash Patel, President Trump’s nominee to lead the FBI, was at the center of a contentious confirmation hearing Thursday, facing intense grilling from Democrats on the Senate Judiciary Committee about his past comments and allegiance to Trump. To Republicans, Patel represents a chance to reform an agency whose public image has taken a hit and refocus the FBI on its crime-fighting mission. To Democrats, Patel is an unqualified figure at risk of abusing FBI power. Patel sought to assure the committee he would not take any illegal actions but would not commit to resigning if faced with such pressure. “My answer is simply, I would never do anything unconstitutional or unlawful, and I never have in my 16 years of government service,” he said. “I will always obey the law.” For those democrats seeking to sink Patel’s confirmation as FBI Director, that promise does little to quell fears of retribution. In a very personal answer during questioning, Patel opened up about the fact that he was the unwitting focus of a federal FBI investigation regarding his work in the past few years pushing back against the Biden administration’s illegal overreach. Time will tell if Kash Patel will be able to navigate the treacherous waters of confirmation, or wind up another victim of the old guard’s need to protect itself.
