Numerous House Democrats have signaled that they would not certify a 2024 presidential election win from Donald Trump‚ relying on the 14th Amendment to claim Trump is an insurrectionist and thus ineligible from holding office. Democrats including Reps. James Clyburn (SC)‚ Jamie Raskin (MD)‚ Adam Schiff (CA)‚ Eric Swalwell (CA)‚ and even House Minority Leader Hakeem Jefferies refused to say that they would confirm Trump to office if he won the 2024 election. As Dan McLaughlin explained at National Review‚ Democrats could have the votes to sustain an objection to a Trump win if they take control of the House. “Only a simple majority is required‚ and unlike when the House chooses a president under the Twelfth Amendment‚ they don’t vote by states‚” he wrote. “Unlike in 2016 or 2004‚ when they were in the minority‚ House Democrats could be playing with live ammunition.” Still‚ a majority of senators would have to object to a Trump win‚ too. This would likely take 51 senators‚ and as McLaughlin pointed out‚ this would be a tough task for Democrats: They “either have to hold every seat they currently occupy (good luck in West Virginia)‚ or take a Republican-held seat (the bluest of which is either Ted Cruz’s in Texas or Rick Scott’s in Florida)‚” he said. A potential way around some of this chaos rests at the Supreme Court‚ which heard oral arguments earlier this month in Trump v. Anderson‚ a case about whether or not a state‚ in this case Colorado‚ can keep Trump off the ballot based on the 14th Amendment. If the high court gives clarity on the issue of Trump eligibility‚ specifically that he is eligible‚ then Democrats would not have room to object on this basis. The arguments‚ so far‚ have bode well for Trump. Nearly every single justice‚ including the liberal ones‚ seemed exceedingly uncomfortable with siding with Colorado based on Section 3 of the 14th Amendment. Notably‚ that provision was enacted immediately following the Civil War in an effort to keep anyone who engaged in an “insurrection” from holding office. Attorney Jonathan Mitchell‚ who argued on behalf of Trump‚ argued that Section 3 doesn’t mention “president‚” but an “officer of the United States‚” which he says includes appointed officials‚ not elected officials. Another argument centered around Colorado adding a qualification to Trump by deeming him an insurrectionist and then disqualifying him before the election. Some of the strongest pushback to Colorado’s claims came from Justice Elena Kagan. “Why should a single state have the ability to make this determination not only for their own citizens but also for the nation?” she pressed the Colorado legal team. “It sounds awfully national to me … if you weren’t from Colorado‚ and you were from Wisconsin‚ or you were from Michigan‚ and what the Michigan secretary of state did is going to make the difference between whether candidate A is elected over Candidate  B is elected? Hundreds of thousands of Brazilians rallied on Sunday in the country’s biggest city to show support for former Brazilian President Jair Bolsonaro‚ who flew an Israeli flag in a rebuttal of anti-Semitic remarks made by the country’s current president‚ corrupt socialist Luiz Inacio Lula da Silva. The rally comes as Brazil’s federal government investigates Bolsonaro over whether he was involved in orchestrating riots on government buildings last January‚ the Associated Press reported‚ adding that he’s also under investigation for allegedly receiving illegal gifts from Saudi Arabia during his presidency. Bolsonaro‚ who is barred from running for office until 2030‚ wants those who have been locked up from the riot to be pardoned and released from jail. “What I seek is pacification‚ it is erasing the past‚” he said. “It is to seek a way for us to live in peace and stop being so jumpy. But ahead of the Tuesday primary‚ there was time for ABC to get one last Sunday installment into the record. Watch as ABC This Week’s “Power Panel” delves into its latest installment of MICHIGAN DOOM- as aired on Sunday‚ February 25th‚ 2024: MARTHA RADDATZ: Let's move onto Michigan. You've got Michigan this week and progressives have been upset about Joe Biden's support of Israel‚ which we think there might be some sort of ceasefire and hostage release brewing. They- that state has the largest percentage of Arab American voters. How concerned should the campaign be about this?  RACHEL BADE: Way more concerned than they currently are. I actually talked to the leader of the Abandon Biden movement on the ground there. He's a Palestinian American‚ those folks who have had family members who have died during the bombardments in Gaza‚ and he was a Biden voter. Just a few months ago‚ he had a sign- Biden/Harris sign in his yard. Now he says he would sooner vote for…what did he say? Sooner vote for Mickey Mouse than Joe Biden- even if it means voting for Donald Trump. So I think that- if you look at the numbers- one more thing‚ Martha‚ Joe Biden won by 150‚000 votes in Michigan. There are 200‚000 Muslim or Arab American voters in Michigan. If he alienates all of them‚ Michigan is gone for him.  RADDATZ: And‚ small numbers‚ really‚ overall. We just have a few seconds here‚ but really could have a profound impact.  ASMA KHALID: A critical impact. And to that point‚ I spoke with a number of people who sat in meetings either with Biden campaign officials or with Biden officials‚ policy makers‚ who are so dissatisfied- came out of those meetings still not convinced that they will vote for Joe Biden.  RADDATZ: Something we'll all watch this week. Michigan coming up. Thanks to all of you. We’re into the third month of the media’s fretting over Biden’s prospects in Michigan‚ which is primed to be a swing state in 2024. The pattern is the same across networks: A correspondent parachutes into Dearborn‚ speaks to a few community leaders‚ and wraps their item by emoting concern over Biden’s electoral prospects should Michigan fall to Trump.  Even the questions are the same. It’s always some variant of “are you willing to refuse to vote for Biden over Gaza even if Trump wins?” And the answers are some variant of “I must vote my conscience” or “If Trump wins‚ Trump wins”. ABC News had‚ until now‚ avoided mentioning “Abandon Biden”‚ a movement endorsed by both U.S. Representative Rashida Tlaib and Bernie Sanders’ “Our Revolution”. The ongoing ask of Democratic primary voters is to embarrass Biden over his Gaza response by voting “Uncommitted”.  With Primary night virtually upon us‚ what can we expect going forward? Look to the percentages garnered by “Uncommitted” in places like Dearborn and Hamtramck. Should there be news of some sort of ceasefire in Gaza‚ look to these same correspondents to parachute back into the Arab American community seeking to elicit positive reactions. If not‚ expect the “DOOM” drumbeat to continue‚ and for the “Biden’s coalition is crumbling” series to extend itself.
