X owner Elon Musk touted his social media platform as a glaring and much-targeted news island in an ocean of elite media bias.  During a conversation in Poland with The Daily Wire editor emeritus Ben Shapiro‚ Musk made the point that X was not only an exception among social media companies‚ but an exception among the media in general. Shapiro and Musk agreed that media elites abruptly changed their treatment of Musk after he purchased the social media platform. “It was amazing to me how much the legacy media walks in lockstep — nobody breaks ranks‚ so now we have X that breaks ranks and doesn’t just go with whatever the approved narrative is‚” Musk said. “I think for many in the public‚ they don’t quite realize just how much deception is really going on with the media. The biggest deception is the choice of narrative.”     Musk added that the media “can write a story about this or write a story about that.” However‚ he warned that “only a few stories can go on the front page – so you’re deciding essentially‚ what people should pay attention to.” Musk went on to say that instead of catering to the concerns of the public‚ the leftist media responded to a different audience: newsroom editors. Musk said that the media prominently addressed only “what a handful of editors care about.” He continued‚ “They’re telling the people what to pay attention to‚ so the deception by choice of narrative is a big thing. So that’s why I really want the narratives to bubble up organically from the people in the case of the X system‚ which they do.”  When Shapiro told Musk that “there was a censorious hand placed on all of these tech companies‚” Musk agreed that this was “unequivocally” true.  Later on in the interview‚ Musk and Shapiro contrasted the current situation on X with the censorship regime that preceded Musk’s takeover.  Musk told Shapiro that he generally tries to “increase the so-called Overton window of what can be discussed‚ what is okay to discuss without being ostracized.” He stated‚ “Certainly attacking DEI–would have been ostracized before and not anymore. And anything that’s sort of sensitive or that the media ignores‚ the public can then raise it on the X platform and make that an actual topic of discussion.”  In response‚ Shapiro brought up prior the rampant censorship of biological reality‚ when accounts were censored for referring to men as men and women as women. Since taking over the platform‚ Musk ended censorship around “misgendering” and “deadnaming” and ended the suspension of satire site The Babylon Bee’s account for the same reason.  Conservatives are under attack! Will ‘Lawfare’ Take Trump Off the Ballot?

The biggest threat to the Constitution in 2024 is the “lawfare” being waged against Donald Trump — and the Supreme Court is as much its target as Trump is. Consider attempts in Colorado‚ Maine and elsewhere to ban Trump from the ballot. The architects of these efforts are counting on most Americans not knowing how presidential primaries and general elections actually work. What happens if a blue-state Supreme Court or Democratic secretary of state rules that Trump isn’t eligible to be president? If the question stayed at the state level‚ very little would change. This is because voters don’t directly pick either a party’s nominee or a president. Primaries and caucuses are only first steps in a process — which differs from state to state — that ultimately selects delegates to the party’s national convention. Those delegates‚ in turn‚ pick the nominee. Colorado requires delegates to support the candidate they’re pledged to‚ even if that candidate drops out of the race. But a candidate who withdraws can free up his or her delegates with a simple letter‚ and after the first round of voting at the convention‚ delegates are often automatically unbound. If Colorado kept Trump off the ballot‚ but he needed the state’s delegates — an unlikely scenario at this point — he could get them by having his voters throw their support behind one of the candidates who’s on the ballot but has already dropped out and endorsed Trump: Ron DeSantis or Vivek Ramaswamy would do. Yes‚ it would be messy‚ but if the GOP is determined to nominate Trump‚ a handful of blue states won’t stop him with ballot bans. The general election is also indirect. When voters choose a president and vice president‚ they’re actually voting for a slate of electors pledged to those candidates. Disqualifying Trump from the ballot wouldn’t disqualify the electors pledged to him and his running mate — and the Republican candidate for vice president would appear on the ballot even if Trump didn’t. In blue or battleground states‚ it’s even conceivable that this could help the Republican ticket‚ if moderate voters turned off by Trump found it easier to vote GOP with only his running mate on the ballot. The same slate of electors‚ however‚ represents both the presidential and VP nominees; Trump would get the electors pledged to the ticket even if his name wasn’t on voters’ ballots. A state that banned Trump might try to disqualify his electors‚ but this would risk a constitutional crisis on both the state and federal levels. Colorado‚ for example‚ has a law that replaces “faithless electors” who don’t vote for the winner of the state’s popular election — but what happens if the Republican ticket wins‚ yet there’s no presidential candidate listed on it? Replacing Republican electors with Democrat electors would hardly make sense if the GOP ticket‚ with only a vice president listed‚ won the popular contest. With so many different rules in different states‚ the results would be wide-open to challenge when Congress counts the Electoral College vote. Savor the irony: If Trump won the Electoral College vote despite state attempts to ban him‚ Vice President Kamala Harris and congressional Democrats would be in the same position Mike Pence and the Republicans were in on Jan. 6‚ 2021. Would Harris count the votes from Trump electors? Yet it won’t come to that — because even Democrats pushing to ban Trump know that the states will be preempted by the U.S. Supreme Court. In fact‚ that’s the trap they’ve laid. SCOTUS is set to take up the Colorado case‚ and Democrats want to embarrass the Republican-majority court. If the justices rule against Trump‚ they’ll throw the election and the Republican Party into turmoil. Trump and his supporters‚ red-state governments‚ and perhaps the institutional GOP as a whole might defy the ruling‚ putting Trump on ballots anyway and opening a deeper constitutional crisis. But it’s more likely the justices will decide in Trump’s favor‚ in which case Democrats will be the ones questioning the court’s legitimacy. And that’s the strategy: to get another decision that juices Democratic enthusiasm and turnout the way the Dobbs abortion ruling did. Trump’s reputation will be further damaged even if he prevails‚ and if he does‚ Democrats will harness their voters’ fury at the Republican-majority Supreme Court. Lawfare subverts democracy by taking decision-making away from voters and giving it to the courts‚ while ensuring that half the country — one party or the other — is outraged by the judiciary’s conclusions. Democrats have led their supporters to entertain a fantasy of winning by disqualifying Trump rather than beating him‚ but the scenarios don’t work‚ and lawfare only breeds strife. Friday’s White House press briefing went for 86 minutes‚ but it had fireworks on everything from the border crisis to climate to the Israel-Hamas war. Most notably‚ Fox’s Peter Doocy was only one of two reporters to ask the National Security Council’s John Kirby over the bombshell that roughly a dozen United Nations Relief and Works Agency (UNRWA) workers — the group responsible for U.N.-directed aid in Gaza — may have participated in Hamas’s October 7 terror attack on Israel. A Biden potted plant‚ CNN’s Arlette Saenz was surprisingly the other reporter and went first with an open-ended request for comment. Doocy came along a few minutes later and called out Kirby for having said earlier this month (January 4‚ specifically) that “you can’t hold [UNRWA] accountable for the depredations of Hamas.”     Asked what he thought now‚ Kirby had a look of eating crow and fretted: “[I]t certainly looks as if there is cause to be concerned about the actions of some of the members of UNRWA...but that does not and nor should it impugn the entire agency” because their “important work” has “helped save literally thousands of lives in Gaza”. Doocy was incensed Kirby wasn’t more outraged: DOOCY: That’s bad‚ though! If there are 12 people who are accused of — KIRBY: It’s bad! It’s bad if there’s one! It’s bad if there’s one! DOOCY: — that’s bad! And the U.S. is giving them money‚ how much money? KIRBY: We have suspended the — they have suspended — DOOCY: How much before the suspension? KIRBY: — I don’t have the dollar figures here‚ Peter. DOOCY: John! After Kirby told Doocy he’d “get back to you‚” Doocy ripped the White House as irresponsible: “[W]ho does this White House vet because we know that people coming across the southern border are not vetted. Now we know that people that are getting hundreds of millions of dollars of U.S. money are not being vetted. So‚ who do you guys check out?” Kirby called it “interesting” to “combin[ed] the two” and scolded Doocy for doing so since the border “has nothing to do and you know it has nothing to do with UNRWA and Gaza.” He also offered a hilarious answer about the border: “[I]t’s not like we don’t have a process at the border‚ and there is a challenge there‚ and the President does want to get more Border Patrol agents. But this idea that just there’s no vetting and there’s no proper immigration enforcement going on at the border just is not — does not comport with reality.” Ooof. Doocy’s last question set Kirby off (click “expand”): DOOCY: But up until today‚ the U.S. policy then has been we don’t negotiate with terrorists‚ but we will give them hundreds of millions of dollars? KIRBY: Come on now. That’s — that’s conflating here. This is not — you’re — you’re — that’s like saying the whole UNRWA is a terrorist organization. You know who is a terrorist organization? Hamas‚ not UNWRA. Now‚ if they have — if the investigation proves that‚ in this case‚ I think it’s about a dozen employees were assisting Hamas and even to the point of‚ maybe even‚ you know‚ involved in hostage taking‚ then absolutely they need to be held to account and we will — although we’ve already suspended any additional allocations to UNRWA‚ we’ll certainly consider additional‚ you know‚ what it — depending on the investigation‚ whether that requires any additional changes in the way we support UNRWA going forward. Prior to Kirby‚ White House climate adviser Ali Zaidi took questions about President Biden’s announcement of a ban on certain liquified natural gas (LNG) exports. CBS’s Weijia Jiang had the obvious question of why now and The Washington Post’s Toluse Olorunnipa correctly sniffed out the fact that this move was to suck up to the demands of far-left climate activists Biden needs to keep wedded to his administration (click “expand”): JIANG: So why is this pause coming now and not on day one? It’s almost three years into the President’s term and‚ since he took office‚ the administration has approved thousands of oil and gas projects. So‚ why didn’t you take this pause on day one to do all the critical analysis you just talked about? ZAIDI: So‚ great question. Um‚ the Dept of Energy — this analysis that the agency is undertaking — it’s not unprecedented. It’s routine and the analytical basis for these decisions — the economic analysis‚ the environmental analysis — is‚ at this point‚ in most cases‚ about five years old. We’ve also seen the market changed dramatically over this period of time. Um‚ if you look just at the United States‚ which has now become the number one exporter...[W]e’ve seen change is our evolving understanding of the environmental implications of this. Look‚ over the last 10 years‚ for example‚ we have started to really understand the potency and threat that methane presents to the environment. Methane is this super polluting greenhouse gas 80 times more potent than C02. And in some instances‚ some scientists believe that it’s represents about half a degree of the warming we’re seeing here...I think this will inform how we approach this program going forward. (....) OLORUNNIPA: To what extent is this a response to activists who have expressed some displeasure with the President’s overall record on climate so far? ZAIDI: You know‚ young people have been such a central part of the coalition that really helped‚ I think‚ the President imagine this climate agenda...that‚ I think‚ young people are excited about. One that’s not about just getting sucked into the doom and gloom of the sky‚ turning orange and the smoke that we breathe into our lungs‚ but of what we can see together...[Y]oung people know they’ve got in Joe Biden‚ a partner‚ a ally‚ a leader who is taking on this crisis and unlocking the...massive‚ massive opportunity that sits on the other side of that. OLORUNNIPA: And what’s your message to activists who say you have to — you should move beyond the pause to actually reject some of these projects? ZAIDI: Look‚ if the question is‚ does the science urge us to find every single way to move as quickly as we can‚ faster and faster each day to take on the climate crisis? It does. It’s code red. That’s what the scientists say...[W]e’ve been creative‚ innovative‚ and‚ I think‚ intrepid in finding ways to move faster and faster in taking on this crisis. Fox Business’s Edward Lawrence had the best question of this portion as he noted this ban could “push countries specifically in Asia to turn to coal plants when they can’t get that increased LNG”: FBN's @EdwardLawrence: “So‚ 32 oil and natural gas industry groups have signed onto a letter saying that the pause sends a wrong message to the allies‚ but also that it will push countries specifically in Asia to turn to coal plants when they can't get that increased LNG‚ you… pic.twitter.com/7OHUk6gURM — Curtis Houck (@CurtisHouck) January 26‚ 2024 During Press Secretary Karine Jean-Pierre’s turn‚ the AP’s Aamer Madhani actually stepped up and asked if Biden will finally visit East Palestine‚ Ohio as it’s nearly been a year since the toxic train derailment.  Madhani also questioned whether‚ if he won’t go‚ this shows East Palestine is “a hindrance” to Biden and/or “a sign of almost insensitivity”. Not surprisingly‚ Jean-Pierre offered a lengthy answer resembling many of her previous answers on the topic (see here‚ here‚ and here for examples). Fast-forwarding to the end of the briefing‚ Andrew Feinberg of The Independent spent over five minutes demanding Biden federalize the Texas National Guard and all other state National Guards dispatched by their respective governor to help Texas control the southern border. A satanist Veteran Affairs staffer working at an undisclosed facility recently filed a complaint with a nonprofit civil rights group‚ claiming that his or her supervisor's desk display‚ which reads "Not today‚ Satan‚ not today‚" was a "grotesque Christian supremacist" sign‚ the New York Post reported. The sign was subsequently removed from the supervisor's desk.The self-described satanist staffer is an Air Force veteran who "subscribes to many non-theist teaching[s] (including Satanist)."According to the worker‚ the undisclosed VA facility already had a hostile work environment when he or she was invited into the supervisor's office. The staffer then observed the sign on the supervisor's desk‚ which he or she claimed was placed "in such a way that it was physically directed at anyone sitting in the guest chair across from her desk."A letter sent by the staffer to the Military Religious Freedom Foundation‚ a civil rights group‚ explained that he or she sent a "passionate and deeply emotional email to my supervisor describing my feelings towards her and it." The organization has agreed to take up the veteran's case against the supervisor.According to the Military Religious Freedom Foundation's founder and president‚ attorney Michael Weinstein‚ the worker "was already having significant problems with his or her immediate supervisor‚ and this didn't help any."According to Weinstein‚ some individuals are not aware of "the full nature of Satanism." He told the Christian Post that the supervisor's sign was a "noxious example of trying to express a particular religious view in a situation where it simply was not warranted.""It's not sacrificing children at midnight with knives‚" Weinstein stated. "Remember‚ in our perspective‚ we don't look at it as to what is good and bad. We look at what is legal and what's not legal.""We don't look at whether Satan is bad‚ or Jesus is bad‚ or Vishnu is bad‚ or Buddha or Yahweh. We look at the time‚ place‚ and manner of an expression of a faith or non-faith tradition‚" he added. "We're a secular democratic republic. And that's why we have a separation of church and state. It's all time‚ place‚ and manner."The staffer explained in his or her letter that the sign was ultimately removed "with absolutely no resistance whatsoever from my hostile Christian supervisor." Through purchases of Chinese-made military equipment by state-owned manufacturers‚ North American consumers may be providing feedback to the communist nation on how to better their technology. Argus Night Vision is reportedly a Chinese night vision housing and image intensifier tube manufacturer based in Tianjin‚ China‚ that sells products in the United States and Canada.The company has received preferential treatment from the Chinese government‚ including preferential tax policies‚ special government financial incentives‚ staff settlement bonuses‚ and policy benefits such as office space or wage support.Vermilion China also reported that through the sales of night vision goggles to Western markets‚ the Chinese manufacturers benefit from feedback to improve the quality of their equipment.According to their confidential sources‚ the outlet said that Argus has contacted Americans who are affiliated with the military and offered to have them travel to China for training on night vision equipment and to provide product feedback. While the outlet could not corroborate such information with Argus‚ it was however able to confirm that Canadian companies that sell Argus products are indeed facilitating the product development through feedback.According to HCC Tactical‚ a U.S. firm that has a government contract and sells Argus products‚ its "sister company in Canada (Opfor Night Solutions) has worked directly with Argus to improve and evaluate the BNVD-1431 series of products.""Their feedback and recommendations led directly to many of the improvements made to this housing for the MK II. Their weatherproofing service is no longer necessary as all changes have been made at the factory‚ and the OPFPR Night Solutions upgrade screw kit has been supplied to the factory so all units come with them as standard."In a video posted to the Kinetic Consulting YouTube channel‚ the host described being in a class with the OpFor Night Solutions owner‚ who then sent the host a pair of night-vision goggles. The host went on to describe how Argus took the owner of the Canadian company's suggestions and then made them standard for the product. "I originally got [the goggles] from OpFor Night Vision in Canada‚ they offered to send them to me after we were spending time in the class — the owner and I were in a class together down here in Miami and we had a great time‚" the YouTube presenter recalled. "He was offering up some cool night vision or housings that were optimized by him originally‚ and then Argus started taking in all his optimizations and making them standard for that Mark II system."During an interview with what was described as an industry representative‚ Vermilion China was told that "individuals and companies involved in distributing Chinese thermal devices in the U.S. help guide their development and production efforts."At least four U.S. companies were listed as selling the Chinese products‚ without mentioning their origins.Like Blaze News? Can Joe Biden federalize the National Guard to stop Greg Abbott?

“Civil War” is trending on social media following the U.S. Supreme Court ruling earlier this week overturning a lower court injunction in the case of Texas versus the Biden administration over border security. The injunction had temporarily prohibited the federal government from removing concertina wire deployed by Texas National Guard troops‚ who are seeking to secure the border under the direction of Governor Greg Abbott. In response to the court’s decision‚ Abbott released a letter boldly declaring Texas’ right to defend itself from the ongoing border invasion and stating that the National Guard would continue its work. While many in the media have painted Abbott as defying the Supreme Court‚ the removal of the injunction does not legally prevent the Texas National Guard from continuing to place obstacles along the border as Abbott has vowed. The federal government is simply no longer barred from also removing the obstacles‚ as was the policy before the injunction. The legal status of Texas’ deployment of obstacles at the border must await an actual ruling on the case itself. This has not stopped Democrats‚ including U.S. Rep. Joaquin Castro (D-Texas) from demanding that Biden federalize the Texas National Guard to take away the state’s ability to defend itself. Others have compared Abbott’s efforts to uphold the law with Southern governors defying desegregation in the 1960s. The comparison is not merely defamatory. It has a legal component. To federalize the Texas National Guard (and activate other federal troops)‚ Biden would need to invoke the Insurrection Act‚ which he can do only in limited legal circumstances citing one of three separate sections of the law‚ found under Title 10 of U.S. Code‚ sections 331‚ 332‚ and 333. Section 331 requires the approval of the state legislature or the governor when a state asks for help in quelling a rebellion against state authority. Not applicable in this case. The idea that “no human being is illegal” and therefore has a right to enter the country is the beating heart of the left’s open-borders policy. Section 332 allows the president to invoke the Insurrection Act and federalize National Guard troops absent a request from a state legislature‚ “whenever the President considers that unlawful obstructions‚ combinations‚ or assemblages‚ or rebellion against the authority of the United States‚ make it impracticable to enforce the laws of the United States in any State by the ordinary course of judicial proceedings.” President Biden might try to cite this section arguing that Abbott is unlawfully obstructing‚ but it seems unlikely the White House can argue that judicial proceedings are ineffective‚ since the legal case is still ongoing. The use of this section is further complicated by the fact that Biden seeks to enforce an open-border policy that — as Abbott argues in his letter — is a violation of the federal government’s constitutional responsibility to protect the states. Claiming Texas is engaged in obstruction puts a spotlight on the Biden administration’s failure to enforce existing federal immigration law. This leaves Title 10‚ Section 333‚ which allows the president to federalize a state’s National Guard when “any part or class of its people” are “deprived of a right‚ privilege‚ immunity‚ or protection named in the Constitution and secured by law” when “the constituted authorities of that State are unable‚ fail‚ or refuse to protect that right‚ privilege‚ or immunity‚ or to give that protection.” Section 333 was originally derived from the 1871 Civil Rights Act‚ known as the “Ku Klux Klan Act‚” which gave then-President Ulysses S. Grant the authority to use the military to suppress the Klan’s violent conspiracy to stop recently freed black citizens from voting. Despite concerns about the act’s constitutionality when it was passed‚ it would be revived by courts in the 1960s to enforce civil rights decrees and eventually be folded into the Insurrection Act. In this case‚ Biden would be forced to argue that illegal aliens are a “class of its people‚” which is to say American and Texas citizens‚ and further that illegally crossing the border is a right “named in the Constitution and secured by law.” While legally laughable‚ the idea that “no human being is illegal” and therefore has a right to enter the country is the beating heart of the left’s open-borders policy. So one can’t dismiss the notion that Biden might be convinced to go ahead with such a scheme‚ since the left’s ideological logic essentially demands it. Against such an effort is likely to be the Pentagon’s National Guard Bureau‚ which would have to weigh this flimsy claim against the fact that the National Guard has not been federalized over a state’s objections in more than 60 years. As generals nervously watch the hemorrhaging of American military recruitment‚ one imagines they won’t be eager to inject themselves into such a squabble‚ particularly when the optics of letting military-age males swarm the border are not nearly as attractive as images of U.S. troops protecting schoolgirls from snarling racists. The continued promotion of the left’s “wokeness” ideology among the U.S. military general staff means we can’t be entirely certain where the Pentagon would come down‚ but bureaucratic inertia alone may be enough for the general staff to discourage the Biden White House. To further discourage the Biden administration from escalating a crisis‚ red-state governors should ask their adjutant generals to use all their influence to ensure the Adjutant Generals’ Corps Association and the National Guard Association lobby the National Guard Bureau to discourage and publicly downplay any such effort by the Biden administration. State attorneys general should consider a joint letter of support for Abbott’s authority as commander of the Texas National Guard and articulate that any attempt by Biden to federalize the Guard in this case would be a gross violation of his authority. The House of Representatives should pass a resolution supporting Abbott’s declaration that Texas is facing an invasion and affirming his right to use the Texas Military Department to resist it. A strong message publicly rebuking a scheme to federalize the National Guard is necessary to lower tensions and prevent the Biden administration from making a mistake that could have terrible unforeseen consequences.

A viral dashcam video shows the moment an Oklahoma trooper narrowly avoided disaster after a car smashed into a vehicle that had been pulled over by the law enforcement officer. Miraculously‚ there were no severe injuries from the devastating car crash that happened during the traffic stop. Trooper Jesse Gregory with the Oklahoma Highway Patrol pulled over a white SUV on Jan. 18. Gregory was on the passenger side of the SUV and speaking to the driver. Suddenly‚ out of nowhere‚ a black SUV zooming down the highway violently slammed into the car. Debris from the forceful collision flew into the air‚ and the trooper was launched into the grass from the impact of the car crash. Despite being involved in the brutal collision‚ Gregory was able to jump to his feet and can be seen in the dashcam video running out of frame. Gregory told KWTV-DT‚ "And after watching the video‚ I don't even remember barrel-rolling to my feet."The Oklahoma Highway Patrol described the police dashcam footage of the terrifying car crash as "difficult to watch."The trooper said‚ "Hopefully this is my scare of the career."The crash is being investigated‚ and it has yet to be determined whether the vehicle that plowed into the stationary car had been speeding. Luckily‚ all three people in the accident had not only survived the car crash but had already been "treated and released‚" according to the Oklahoma Highway Patrol. Trooper Gregory said he is "ready to come back" to work. He admitted‚ "And just kind of work through it because I know it's going to take a little bit mentally to come back."The Oklahoma Highway Patrol said in a post on Facebook that it had posted the shocking video to remind the public of "distracted or impaired driving and the importance of the slow down‚ move over law.""We are in the middle of a distracted driving emphasis right now in honor of Trooper Nicholas Dees‚ who lost his life in the line of duty after being struck by a distracted driver‚" the Oklahoma Highway Patrol stated. Trooper Nicholas Dees was investigating a tractor-trailer accident around 10 p.m. on Jan‚ 31‚ 2015‚ when he was struck and killed by a distracted driver. The driver was reportedly updating his social media while driving and killed Dees in the line of duty. The driver was charged with manslaughter and sentenced to five years in prison. Ironically‚ Gregory was involved in another police traffic stop crash that happened just weeks ago. On Jan. 5‚ Canadian County Deputy Jose Mendoza was tossed to the ground after a pickup truck barreled into the vehicle that had been pulled over to the shoulder. Gregory is seen in the police dashcam footage rushing to provide Mendoza with assistance. Gregory said‚ "He was struck in the exact same situation. I was less than a mile from him‚ and I was actually first on scene and called for help."Mendoza and the others involved in the car accident all survived and suffered varying levels of injuries. Christian group sues Hawaii's education department for blocking its after-school club from public schools

A Christian club organization filed a lawsuit Tuesday against the Hawai'i State Department of Education‚ accusing education officials of blocking it from operating after-school clubs in several public school districts.In 2022 and 2023‚ the Child Evangelism Fellowship of Hawaii attempted to register its Good News Club with several schools across the state. The group decided to take legal action after the HIDOE repeatedly denied its application requests and "either expressly or effectively denied every appeal‚" according to the lawsuit.The CEF alleges that the HIDOE discriminated against the club because of its religious affiliation while it allows other similar‚ non-religious clubs to operate. The lawsuit stated that one school even sent a letter to the CEF stating that its club could not be approved because it is religious."For nearly two years‚ Defendants have blocked CEF from hosting its elementary school Good News Clubs in certain District facilities that are open to other‚ similarly situated non-religious organizations‚" the complaint states. "Defendants' policies of unequal access‚ pretextual denials‚ and hostility to CEF's religious message violate the Constitution and have denied some Hawaii elementary school students access to free‚ positive‚ and character-building Good News Clubs that enrich countless students' lives in other Hawaii schools and throughout the country."The Good News Club is a weekly elementary school Bible club that aims to help local "churches to reach lost children and their families with the Gospel‚" according to the CEF's website."Here in Hawaii‚ the law says that after the school day is complete‚ every public school is considered a public use facility‚" a CEF flyer explaining its club states. "This essentially means that any organization can use space at any public school once the school day is over."A 2001 Supreme Court ruling declared that "if a school opens its campus after school hours for any organization‚ they have to open them for all organizations‚" the CEF added.A press release from Liberty Counsel‚ a nonprofit litigation organization representing CEF‚ stated that by denying the CEF's request to host its club on public school campuses‚ the HIDOE had violated the First and Fourteenth Amendments‚ state laws‚ and school discrimination policies. Liberty Counsel Founder and Chairman Mat Staver stated‚ "The U.S. Supreme Court has ruled that public schools cannot discriminate against Christian viewpoints regarding use of school facilities. Child Evangelism Fellowship gives children a biblically based education that includes moral and character development. Good News Clubs should be in every public elementary school and that includes in these Hawaii schools."
