Why Did Fani Willis Threaten the Wife of Her Lover With Prosecution?

Thursday in Atlanta‚ Fulton County Superior Court Judge Scott McAfee will hold a hearing on the merits of a motion to disqualify the elected district attorney of Fulton County‚ Fani Willis‚ from the Trump-related racketeering cases. For the reasons we explain below‚ this is not a difficult decision. He should grant the motion and remove Willis‚ her lover Nathan Wade‚ and the entire Fulton County District Attorney’s Office from the cases and send them to one of the other 48 district attorney’s offices in the state that can decide what‚ if anything‚ to do with them. The motion‚ filed by attorney Ashleigh Merchant on behalf of her client Michael Roman‚ and joined by other defendants‚ seeks to remove not only the controversial Willis from the case‚ but her lover‚ Nathan Wade‚ whom she hired as a “special prosecutor” in the sprawling RICO cases against Roman‚ Donald Trump‚ and over a dozen other co-defendants. The gravamen of Merchant’s motion to recuse are the following allegations‚ any one of which‚ if the judge finds to be true‚ is more than sufficient reason for him to recuse Willis et al.: Willis used the money she got from Fulton County to hire extra prosecutors to clear the COVID backlog of cases to instead hire a private attorney‚ Nathan Wade‚ to handle the RICO cases against Trump and others‚ misleading Fulton County commissioners. Willis failed to get permission from those commissioners to even hire Wade in the first place‚ which was required by law. Wade took his oath of office‚ but his oath was required to be filed with the court‚ yet it was not filed until long after he obtained the indictments against Trump and others. Willis paid over $750‚000 to Wade for his legal services‚ even though he had not tried or defended a RICO case in his legal career. Willis and Wade had a romantic‚ sexual relationship that started before she hired Wade‚ her subordinate.  Willis benefitted from hiring Wade by traveling with him on romantic excursions to California‚ Florida‚ and two cruises that were not work related‚ which raises not only ethical questions but possible violations of state and federal law over receiving kickbacks from a vendor for the county. Michael-Roman-Motion-to-Dismiss-IndictmentDownload Since this original motion was filed‚ the defendants have raised additional concerns in new motions over even more ethical violations from Willis. Willis attacked the defendants publicly at her church in a sermon in which she claimed that racial animus was the reason for the attacks against her with these motions over her ethics lapse and potential violations of the law.    That is a potential violation of the professional code of conduct that governs lawyers in Georgia; namely Rule 3.8(g) and Comment 5. The rule and comment prohibit prosecutors from making public statements “except for statements that are necessary to inform the public of the nature and extent of the prosecutor’s action and that serve a legitimate law enforcement purpose.” They also require prosecutors to “refrain from making extrajudicial comments that have a substantial likelihood of heightening public condemnation of the accused.” “In the context of a criminal prosecution‚ a prosecutor’s extrajudicial statement can create the additional problem of increasing public condemnation of the accused‚” the comment explains. Willis’ statements from the pulpit violate this rule as they substantively claim that those filing the motions for her recusal are racists and therefore certainly have the potential to inflame public condemnation of the accused‚ former President Trump and his co-defendants. The second violation stems from Willis’ emergency motion regarding a subpoena from the legal team of Joycelyn Wade‚ the wife of special prosecutor Nathan Wade‚ demanding Willis testify in the Wades’ divorce proceedings. In the motion to quash the subpoena‚ Willis accused Joycelyn Wade of interfering and obstructing Willis in her role as the prosecutor in the Trump case. Willis claimed that the subpoena was “an attempt to harass and damage her professional reputation‚” and that Joycelyn Wade is seeking it “in an unreasonable manner to annoy‚ embarrass‚ and oppress the deponent.” Her motion then requests that the court allow Willis “180 days to complete a review of the filings in the instant case‚ investigate and depose relevant witnesses with regard to the interference and obstruction” of her criminal prosecution. This language heavily implies that Willis is seeking to bring criminal charges against Joycelyn Wade.  That claim‚ according to the defendants‚ violates Rule 3.4(h)‚ which states that a lawyer can’t “threaten to present criminal charges solely to obtain an advantage in a civil matter.” Willis‚ say the defendants‚ was clearly seeking to obtain an advantage for herself and her lover in this divorce case by preventing her potentially damaging testimony. It seemed to work since shortly after Willis filed her motion threatening criminal charges‚ the Wades settled their divorce case. Judge McAfee is‚ no doubt‚ keenly aware that prosecutors have a higher ethical duty than all other attorneys. More is expected of them because they play a vital role in the administration of justice in our country. How the public perceives their local prosecutor matters‚ as they must be beyond reproach in all that they say and do.  According to the American Bar Association‚ “The prosecutor is an administrator of justice‚ a zealous advocate‚ and an officer of the court… The primary duty of the prosecutor is to seek justice within the bounds of the law‚ not merely to convict.” The ABA notes that prosecutors “should act with integrity and balanced judgment‚” and that they have a “heightened duty of candor to the courts and in fulfilling other professional obligations.”    Willis has already been removed from prosecuting a different case. Judge Robert McBurney of the Fulton County Superior Court forbade Willis from prosecuting Burt Jones‚ a candidate for lieutenant governor‚ because Willis was a featured guest in a fundraiser for his Democratic rival in the same race at a time when she was targeting Jones with her grand jury investigation and had named him publicly as a target.  Judge McAfee can‚ and should‚ take judicial notice of that fact during the hearing. Judge McAfee must develop a strong factual record before he rules on the motion. In doing so‚ he needs to keep in mind that prosecutors are fungible. The integrity of the system is vastly more important than who represents the state as the prosecutor. Furthermore‚ the judge should‚ and no doubt will‚ be cognizant of the fact that he should rule based solely on evidence of possible misconduct‚ misfeasance‚ or malfeasance on the part of Willis and Wade‚ not on the underlying merits or lack thereof of the charges in this case.  All trial judges (one of us—Stimson—was one) seek to protect and preserve the record of a trial so that if and when a case goes up on appeal‚ the case does not get overturned for any reasons related to the how the judge handled the case. If the allegations against Willis and Wade are found to be true‚ but Judge McAfee denies the motion‚ and the case results in convictions‚ there is a substantial likelihood that his denial will be one of the first complaints on appeal. In other words‚ if he denies the motion‚ he is handing the defense a ripe issue for appeal. If he grants the motion‚ he takes that issue off the table‚ even if there is an appeal. Trial judges don’t like to be overturned on appeal. In developing the record Thursday‚ McAfee should seek to establish‚ at the very least‚ the following facts: When did the sexual/romantic relationship between Willis and Wade begin? What office policies were in place at the time concerning relationships between supervisors and subordinates? How much money did Willis’s office pay Wade‚ and when did those payments begin? What is the name of the bank and what account was the money deposited into? What did Wade and/or Willis say‚ at any time‚ regarding (a) the nature of their romantic relationship and (b) when the relationship began? What has Willis said‚ in any place‚ regarding the relationship and/or the case that falls outside the acceptable statements about a case per the ABA and Georgia rules?  How much money did Wade and Willis use for their romantic getaways? When and where did they travel? What bank accounts were debited for the trips?  What proof is there that Willis got permission to spend COVID money to hire a “special counsel”?  When did she get approval for hiring and paying Wade from the county commissioners? When was Wade’s oath of office registered and where?  Why did Willis threaten the wife of her lover with criminal charges in a civil case? Why did Willis violate the rule against extrajudicial statements by attributing racial animus to the defendants? The answers to these questions are key to Judge McAfee’s consideration of the motion to recuse. If any of these allegations prove to be true‚ especially if the romantic relationship between Willis and Wade preceded her hiring of Wade‚ the judge has more than sufficient grounds to grant the motion. The appearance of impropriety matters‚ especially when it comes to elected prosecutors.  Finally‚ if Judge McAfee grants the motion‚ the cases simply get transferred to another district attorney’s office in the state of Georgia. There are plenty of other criminal cases in Fulton County for Willis and her prosecutors to handle. Willis has no one but herself to blame if the judge grants the motion.  One of the authors‚ Hans von Spakovsky‚ is licensed to practice law in Georgia and is a former county election official in Fulton County. What should be the attitude of the media towards someone notable for being the purveyor of the biggest election 2020 fake news story? Shun them? That would be the correct attitude for such journalism malpractice. However‚ in the case of CNN it actually promoted such a person. Natasha Bertrand who was the main person behind promoting the fake news story in Politico that the New York Post report in October 2020 revealing the contents of Hunter Biden's laptop was a result of Russian disinformation. The CNN announcement on Tuesday of Bertrand's promotion on X (which everyone still calls Twitter) went over like a lead balloon to the extent that CNN has had to limit responses to that post according to Mollie Hemingway of The Federalist.   CNN is limiting responses to this tweet announcing that it is rewarding Natasha "Fusion GPS" Bertrand for her work spreading the Russia collusion lie and for writing the story that Hunter Biden's laptop was Russian disinformation. https://t.co/BM4vPruFNk — Mollie (@MZHemingway) February 14‚ 2024   Hemmingway also provided a reminder about Bertrand's nefarious fake news background in promoting the the fake Trump-Russia collusion Steele Dossier‚ a project of Fusion GPS which was financed by the 2016 Hillary Clinton campaign.   Never forget that Natasha "Fusion GPS" Bertrand funneled the Russia Collusion lie into print and also was the author of the disinformation op claiming America's intel experts said Hunter Biden's laptop was Russian. A few scorching excerpts. On Monday‚ CNN made clear that this dynamic still drives the corporate media world. The network proudly announced that it had hired Natasha Bertrand away from Politico. In doing so‚ they added to their stable of former CIA operatives‚ NSA spies‚ Pentagon Generals and FBI agents a reporter who has done as much as anyone‚ if not more so‚ to advance the scripts of those agencies. Bertrand's career began taking off when‚ while at Business Insider‚ she abandoned her obsession with Russia's role in Syria in 2016 in order to monomaniacally fixate on every last conspiracy theory and gossip item that drove the Russiagate fraud during the 2016 campaign and then into the Trump presidency. Each month‚ Bertrand produced dozens of Russiagate articles for the site that were so unhinged that they made Rachel Maddow look sober‚ cautious and reliable. In 2018‚ it was Jeffrey Goldberg himself — knowing a star CIA propagandist when he sees one — who gave Bertrand her first big break by hiring her away from Business Insider to cover Russiagate for The Atlantic. Shortly thereafter‚ she joined the Queen of Russiagate conspiracies herself by becoming a national security analyst for MSNBC and NBC News. From there‚ it was onto Politico and now CNN: the ideal‚ rapid career climb that is the dream of every liberal security state servant calling themselves a journalist... They wrote Bertrand was "no ordinary Russiagate fanatic." There was no conspiracy theory too unhinged or evidence-free for her to promote. As The Washington Post's media reporter Erik Wemple documented once the Steele Dossier was debunked‚ there was arguably nobody in media other than Rachel Maddow who promoted and ratified that hoax as aggressively‚ uncritically and persistently as Bertrand. She defended it even after the Mueller Report corroborated virtually none of its key claims... ...It was also Bertrand who most effectively laundered the extremely significant CIA lie in October‚ 2020 that the documents obtained by The New York Post about the Biden family's business dealings in China and Ukraine were "Russian disinformation.” Even though the John-Brennan-led former intelligence officials admitted from the start that they had no evidence for this claim‚ Bertrand not only amplified it but vouched for its credibility by writing that the Post's reporting “has drawn comparisons to 2016‚ when Russian hackers dumped troves of emails from Democrats onto the internet — producing few damaging revelations but fueling accusations of corruption by Trump” (that those 2016 DNC and Podesta documents produced “few damaging revelations” would come as a big surprise to the five DNC operatives‚ led by Chairwoman Debbie Wasserman-Schultz‚ who were forced to resign when their pro-Hillary cheating was revealed). It was this Politico article by Bertrand that was then used by Facebook and Twitter to justify their joint censorship of the Post's reporting in the weeks before the 2020 election‚ and numerous media outlets — including The Intercept — gullibly told their readers to ignore the revelations on the ground that these authentic documents were "Russian disinformation.” Yet once it did its job of helping defeat Trump‚ that claim was debunked when even the intelligence community acknowledged it had no evidence of Russian involvement in the appearance of these materials‚ and Hunter Biden himself admitted he was the subject of a federal investigation for the transactions revealed by those documents. No wonder CNN's ratings are in the toilet. They have destroyed any pretense towards credibility by rewarding Natasha Bertrand for her long history of promoting fake news -- but's all for the "right cause‚" destroying Donald Trump and electing Democrats instead.

It's "turned their double act into a third-rail subject." Grynbaum reflected the conventional wisdom‚ gently: she's not good at this. "He evinces a clarity and comfort at the lectern that can sometimes elude Ms. Jean-Pierre‚ 49‚ a more rote public speaker with less experience tussling with an adversarial press." The pro-Biden press is "adversarial"? Even the text box had a tilt: "The administration relies on a longtime Washington hand to spread its message." Jean-Pierre has resented Kirby's presence from the beginning. Grynbaum writes‚ at a farewell party for Jen Psaki‚ Biden told KJP don't worry‚ “you’ll have an admiral looking over your shoulder.” Like she needs help. "The president’s tone suggested he wanted to be encouraging‚ the people said‚ but the comment landed with a thud." After that‚ we discuss Axios.com reporting about internal White House turmoil over the border crisis‚ telling of one meeting where Biden "exploded in fury" when aides didn't have the immigration data points he wanted. In addition‚ a former Biden administration senior official dissed Vice President Kamala Harris to Axios: "She's been at best ineffective‚ and at worst sporadically engaged and not seeing it was her responsibility. It's an opportunity for her‚ and she didn't fill the breach." We wind down with how the Left is playing around with Valentine's Day. MRCTV's Tierin-Rose Mandelburg reported Abortion Fund Ohio cut straight to the point when its group tweeted: “Girls don't want flowers for Valentine's Day. They want flowers AND abortion on demand‚” and later added “birth control &; chocolate &; plan b‚ oh my!” We Testify‚ a group dedicated to giving women the opportunity to talk about their amazing abortion‚ made Valentine’s Day cards to post on its social media accounts. One was a poem that read‚ “roses are red violets are blue abortions are cool I’ve lost count of mine‚ I’ve had quite a few.” NPR.org promoted "5 facts about queer animals for Valentine's Day." To celebrate that there is "currently a gay anteater couple" at the National Zoo in DC‚ "NPR spoke with wildlife ecologist Christine Wilkinson of the "Queer is Natural" TikTok series for Valentine's Day. Here are some of her favorite facts about queer animals." Did you know some deer are non-binary?? The Wall Street Journal front page carried the sour spin that people are turning inward on Valentine's Day‚ which can still please Big Business through "self-gifting."  The story began "This Valentine’s Day‚ more people are saying I love you – to themselves." A major media narrative to emerge from President Joe Biden’s fiery press conference decrying the special counsel’s report on the classified documents investigation was “gratuitous”‚ in reference to Robert Hur’s line citing the president’s inability to recall the date of his son Beau’s death. But‚ as NBC News reports‚ it turns out that the narrative is fake because Hur wasn’t the one to raise that issue. If true‚ this means that President Biden lied to the nation when he angrily denounced Hur’s alleged question during last week’s fiery press conference which‚ apparently‚ was convened at Biden’s direction. Watch NBC’s Peter Alexander throw gasoline on an already raging fire with regard to President Biden’s cognitive decline‚ as aired on NBC Nightly News on Wednesday‚ February 14th‚ 2024: LESTER HOLT: Peter‚ you also have new reporting this evening about President Biden's interview with the special counsel‚ Robert Hur.  PETER ALEXANDER: Lester‚ President Biden became heated‚ you'll remember‚ responding to the special counsel's assertion that he could not remember within several years when his son Beau died. Last week the president criticized Hur for asking him about it.  PRESIDENT JOE BIDEN: How in the hell dare he raise that? Frankly‚ when I was asked the question‚ I thought to myself‚ it wasn't any of their damn business.  ALEXANDER: But tonight‚ NBC News has learned that Hur never asked that question according to two people familiar with the interview last fall. They say it was the president‚ not Hur or his team‚ who first introduced Beau Biden’s death. The sources say the president got the date‚ May 30th‚ correct- but not the year.  This brief came as an add-on to NBC’s report on the emerging national security threat posed by Russian space nukes. Ronald Reagan is surely laughing somewhere at the irony of a President Joe Biden wishing he had the Strategic Defense Initiative right about now‚ but I digress.  Reasonable people with access to Biden’s speeches and appearances can reasonably expect him to talk about Beau’s passing often‚ sometimes at odd times- and no reasonable person would begrudge a grieving parent for doing so.  And herein lies the pickle: those same reasonable people are now asking whether Biden knowingly lied to the American people when he flamed Hur for allegedly asking the Beau question‚ or whether this now-disproven recollection is yet another instance of Biden’s fading cognition. NBC alone reported on this development‚ as CBS and ABC were otherwise occupied. We expect that to change soon‚ given the ongoing debate over Biden’s age‚ health‚ and cognition.
