Federal Judge Blocks Biden Gun Background Check Rule For Texas, Gun Rights Groups

Texas and a group of gun rights organizations won a legal victory on Sunday after a federal judge temporarily blocked a gun control rule from the Biden administration regulating private firearm sales.  Federal Judge Matthew Kacsmaryk said that the Biden administration could not implement a policy against Texas or members of multiple gun rights groups that require individuals who “earn a profit” selling guns to conduct background checks and have a federal firearms license no matter where or how they sell their merchandise. In his 14-page ruling, Kacsmaryk said that the rule likely violates the Administrative Procedure Act (APA) and was not in alignment with the “Bipartisan Safer Communities Act,” (BSCA) which the Justice Department cited in its justifications for implementing the policy. He said that because of this determination, evaluating the other arguments made against the rule was unnecessary.  “Plaintiffs understandably fear that these presumptions will trigger civil or criminal penalties for conduct deemed lawful just yesterday,” the judge wrote. “Other Plaintiffs face both civil and criminal enforcement actions for engaging in conduct that the BSCA permits but the Final Rule impermissibly forbids.” The decision applies to Texas, the Gun Owners of America, the Gun Owners Foundation, the Tennessee Firearms Association, and the Virginia Citizens Defense League. The judge ruled that Louisiana, Mississippi, and Utah failed to demonstrate standing and did not issue the temporary injunction in their favor.  Republicans have argued that the regulations infringe on Second Amendment rights and would make it a felony for family members and friends to sell guns to each other without conducting background checks or having a federal license.  “I am relieved that we were able to secure a restraining order that will prevent this illegal rule from taking effect,” Texas Attorney General Ken Paxton said in response to the ruling. “The Biden Administration cannot unilaterally overturn Americans’ constitutional rights and nullify the Second Amendment.” CLICK HERE TO GET THE DAILYWIRE+ APP Gun Owners of America President Erich Pratt praised the decision.  “President Biden and his anti-gun administration have aggressively pursued an agenda meant to harass, intimidate, and criminalize gun owners and dealers at every turn,” he said. “This ruling is a compelling rebuke of their tyrannical and unconstitutional actions that purposely misinterpreted federal law to ensure their preferred policy outcome.” The rule broadly goes into effect on Monday after it faced a flurry of lawsuits. For Texas and the gun rights groups, the rule will be on hold until June 2, pending further litigation.

A pair of GOP senators introduced a bill on Monday to protect in vitro fertilization (IVF) at the federal level. The goal of the “IVF Protection Act,” spearheaded by Sens. Ted Cruz (R-TX) and Katie Britt (R-AL), is to discourage states from prohibiting access to IVF services. If enacted, the legislation would amend the Social Security Act to require that states do not block IVF services as a condition to receive federal Medicaid funding. “IVF has given miraculous hope to millions of Americans, and it has given families across the country the gift of children,” Cruz said in a statement. Britt said the legislation “affirms both life and liberty — family and freedom, and I look forward to working with my colleagues to enact it into law.” Senate Republicans previously blocked legislation from their Democrat colleagues that would have established a federal right to IVF treatments. The AP reported many GOP lawmakers do not want the federal government to meddle with state-level decisions on reproductive care after Roe v. Wade was overturned. Cruz and Britt stressed in press releases about their new bill that the legislation would not compel any person or organization to provide IVF services. They also emphasized that the “IVF Protection Act” permits states to ensure appropriate “health and safety standards” for practicing the fertilization treatment. Former President Donald Trump, who is running for another term in the White House in this year’s election, has voiced support for IVF as polls show it to be a major issue for voters. In a video last month, Trump praised Alabama for passing a bill to protect IVF services after a state high court ruled frozen embryos should be recognized and protected as unborn children. Kevin Costner said he’s been knocking on doors at the Cannes Film Festival looking for backers to finance the next installments of his country Western passion project. The 69-year-old actor confirmed he put up $38 million of his own money into the project he’s been obsessing over for decades. The first film, “Horizon: An American Saga,” debuted at Cannes over the weekend before its national release on June 28.   “That’s the message I want my kids to understand about who I am: that I do what I believe in,” Costner told GQ of taking such a big risk. “I have fear like everybody else. I don’t want to be humiliated.” The actor also commented on taking out a mortgage on his Santa Barbara home to help finance the project. “I mean, it’s okay, maybe I lose that. But it’s: Have I lost myself?” he told the outlet of making that decision.  Warner Bros. is releasing the first two installments of the project this summer and production has already started on the third despite the second two movies not yet being fully funded.  “They’re going to happen regardless, but they’re not already funded,” Costner said. “I got my suitcase on the end of the street, you know, and seeing: Where are all you brave, rich billionaires? Be sure to look at the night sky on June 3rd to see a somewhat rare event called a large “planetary parade.” The term refers to an alignment of planets. In this case, six are involved—Mercury, Mars, Jupiter, Saturn, Uranus, and Neptune. Some parts of the United States will need binoculars or telescopes to witness the sight, but some will have a clear view of most of the planets with the naked eye. “A planetary alignment is an astronomical event that happens when, by coincidence, the orbits of several of the planets of the Solar System bring them to roughly the same side of the Sun at the same time,” Kate Pattle, a Physics & Astronomy lecturer with University College London, told Glamour UK. “This means that they appear in a line on the sky when we view them from the Earth. In this case, the planets Jupiter, Mercury, Uranus, Mars, Neptune, and Saturn will form a line across the sky, in that order.” New York State will have the best view of the planetary parade. Anyone in the area should head out at 5 am ET to catch the show, which will last until 5:26 am. Only Jupiter, Mercury, Mars, and Saturn will be visible without special equipment. You’ll need high-powered binoculars to see Neptune and Uranus. Technically, the alignment will also include Venus, but it will be too close to the sun to see. The Planetary Parade Is Purely Visual People on the eastern seaboard will have views of a partial planetary parade that day, as well. Floridians should be able to see Jupiter, Mercury, Mars, and Saturn at about 6 am. And those in Ohio can see that same lineup around 5:40 am. The alignment will remain in the sky for about a week. To know more about viewing the planetary parade in your area, you can use the interactive Stellarium website or download the mobile Sky Tonight app. It should also be noted that the alignment is purely visual. The planets are not actually lined up in space, and small planetary alignments are more common than large, which are defined by five or more planets. However, literal planetary alignments do happen—but they are extremely rare. The last full event took place in 949 and the next won’t happen until May 6, 2492.
