Illegal Alien Mom Arrested on Charges of Trying to Hire Hit Man Was Freed From ICE Detention in 2019

An illegal immigrant mother arrested on charges of attempting to pay a hit man to kill witnesses involved in her son’s murder trial was previously detained by federal authorities, but later released, immigration officials confirmed to the Daily Caller News Foundation. Josefina Cardona-Cardona, an illegal migrant from Guatemala, was arrested on Monday after allegedly agreeing to pay an undercover agent to kill two cooperating witnesses in her son’s fatal stabbing case in Palm Beach County, Florida. Immigration and Customs Enforcement confirmed to the Daily Caller News Foundation that Cardona-Cardona entered the U.S. unlawfully and was taken into the agency’s custody in 2019, but was later released and referred to a program intended to monitor migrants waiting for their court dates. The Guatemalan migrant seemingly did not comply with the program and skipped out on her immigration hearing. “Josefina Cardona-Cardona is an unlawfully present noncitizen from Guatemala, who entered the country illegally on an unknown date and location without admission or parole,” an ICE spokesperson told the Daily Caller News Foundation. The agency confirmed that Cardona-Cardona was arrested by Border Patrol on April 4, 2019, and then transferred into Enforcement and Removal Operations custody four days later on April 8. However, she did not remain in the agency’s physical custody for long. “[She was] subsequently released on an Order of Recognizance and was required that she enroll in and comply with the Alternatives to Detention program,” the ICE spokesperson stated. An immigration judge in Miami ordered Cardona-Cardona to be removed from the U.S. in absentia, meaning she never showed up to her immigration hearing, the spokesperson added. Cardona-Cardona was arrested by Palm Beach County law enforcement on Monday after she allegedly agreed to pay an undercover agent, who she thought was a hit man, to kill two cooperating witnesses in her teenage son’s murder trial. She offered to pay $4,000 for each hit, according to the arrest report. Her son, Manuel Marcos Cardona, was at a five-year-old’s birthday party in June 2022 when a fight broke out. An individual stepped in to break up the fight, but then Marcos Cardona stabbed him five times, with the victim succumbing to his wounds the following day. Marcos Cardona—who was 14 years old at the time of crime, but charged as an adult—was subsequently handed a 15-year prison sentence after agreeing to a plea deal. ICE confirmed to the Daily Caller News Foundation that their Enforcement and Removal Operations division has since lodged a detainer for Cardona-Cardona. She is currently being held in a Palm Beach County Sheriff’s Office detention center, and local officials said she is subject to deportation following the completion of her prosecution. The discovery of Cardona-Cardona’s referral into Alternatives to Detention marks the latest blemish in what has become a controversial program. Established in 2004, the Alternatives to Detention program allows migrants to move freely in the country and avoid physical detention while they await their immigration court dates. This is done by using GPS monitoring, phone applications or other forms of tracking services to remain aware of their whereabouts. As the current border crisis rages on, participation in the program has increased, with hundreds of thousands of migrants enrolled in the program, according to ICE. However, a previous Daily Caller News Foundation investigation found the Biden administration has increased its reliance on a phone application that only tracks the location of an illegal immigrant at specific times, in lieu of relying on GPS monitoring, which can track them most or even all of the time. A Bill to Ensure Fair Representation for American Citizens

The House of Representatives finally acted Wednesday to remedy an injustice that has been getting worse as the number of illegal aliens coming into the United States has skyrocketed: the distortion caused by including noncitizens when determining how many House members each state gets. The House passed HR 7109, the Equal Representation Act, to mandate a citizenship question on the census form and use of only the citizen population in the apportionment formula for representation applied after every census. Article I, Section 2 of the U.S. Constitution mandates an “actual Enumeration” of the U.S. population every 10 years. That enumeration is used to determine the number of members in the House to which each state is entitled. Because Congress limited the size of the House to 435 members in 1929 by passing the Permanent Apportionment Act, those 435 representatives are divided among the states. Reapportionment after the 2020 census gave additional seats to six states: Colorado, Florida, Montana, North Carolina, Oregon, and Texas. It also reduced the number of seats held by seven states: California, Illinois, Michigan, New York, Ohio, Pennsylvania, and West Virginia. But that reapportionment was based on the country’s total population, which includes aliens who are here both legally and illegally even though they have no right or ability to participate in our democratic political process. Keep in mind that reapportionment also affects the outcome of presidential races, since this same apportionment determines how many votes a state has in the Electoral College. Under Section 1 of Article II, the number of Electoral College votes for each state is the total of its two U.S. senators and the number of its representatives in the House. The Trump administration unsuccessfully tried to add a citizenship question back to the 2020 census form; the question first appeared in the 1820 census but wasn’t included in more recent years. As the U.S. Supreme Court noted in 2019 in Department of Commerce v. New York, such “demographic questions have been asked in every census since 1790, and questions about citizenship in particular have been asked for nearly as long.” In fact, the high court noted, the Constitution “vests Congress with virtually unlimited discretion in conducting” the census. Although the Supreme Court specifically held that the Constitution’s enumeration clause “permits Congress, and by extension the Secretary [of Commerce], to inquire about citizenship on the census questionnaire,” it didn’t allow the Trump administration to go forward with adding a citizenship question. (The U.S. Census Bureau, which conducts the census, is part of the Commerce Department.) Instead, the court held that the commerce secretary had not provided a sufficient explanation for his actions under applicable administrative law. There was not enough time after this decision for a more extensive explanation to be provided by the secretary before the census form needed to be printed and distributed, so the 2020 census didn’t include a citizenship question. But the Supreme Court’s decision makes it clear that HR 7109’s restoration of a citizenship question to the census is well within the authority of Congress, as well as the commerce secretary, under existing law. Section 2 of the 14th Amendment to the Constitution, ratified in 1868, provides that representatives in the House “shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed.” Congress implemented this requirement in U.S. law (2 U.S.C. § 2a). HR 7109, the bill passed by the House, would amend Section 2a to exclude not only “Indians not taxed,” but also “individuals who are not citizens of the United States.” How bad is the distortion in representation in the House caused by including aliens, both legal and illegal, in apportionment? A 2019 study by the Center for Immigration Studies estimates that if aliens were removed from the apportionment population, these eight states would each gain a congressional seat: Ohio, Michigan, Missouri, Minnesota, Alabama, Idaho, West Virginia, and Rhode Island. California alone would lose three seats, since it has the largest population of illegal aliens in the country. Similarly, a 2015 report by the Congressional Research Service estimated that apportionment based on citizen population, excluding aliens, would shift seven congressional seats. Gaining a seat: Louisiana, Missouri, Montana, North Carolina, Ohio, Oklahoma, and Virginia. California would lose four seats. Given the unprecedented number of aliens allowed into the U.S. illegally by the Biden administration since January 2021, the distortion in representation no doubt grew even worse since these reports were issued. Opponents of this commonsense change may try to argue that the language in Section 2, that apportionment is based on the “number of persons in each State,” means that aliens must be included in the apportionment calculation. However, the term “persons” historically has been interpreted in this context, as the Supreme Court explained in 1992 in Franklin v. Massachusetts, to mean an individual who not only has a physical presence but “some element of allegiance or enduring tie to a place.”  That is why the Census Bureau, for example, doesn’t include aliens who visit the U.S. for a vacation or a business trip in the population count, since they have no political or legal allegiance to any state or the federal government, and their only “enduring tie” is to their native or home countries. However, the Census Bureau shouldn’t include any aliens in the population count for apportionment purposes. But Democrats apparently don’t want to know how many aliens are in the country.  And they want the votes of U.S. citizens diluted by aliens. The House vote Wednesday on the Equal Representation Act was strictly along party lines, with 206 Republicans voting for it and 202 Democrats voting against it. The bill faces tougher going in the Democrat-run Senate. Including aliens in apportionment dilutes the votes and political representation of American citizens. It unfairly gives political power to states such as California that deliberately obstruct enforcement of our immigration laws and implement sanctuary policies intended to attract illegal aliens who endanger the safety of the public and cost taxpayers huge amounts of money.  Including aliens in apportionment also cheats states and voters not only in the House of Representatives but through distortion of the Electoral College system used to decide presidential races. "You basically detonate a nuclear bomb, it ionizes or charges atoms in the atmosphere and it creates a large electrical field on the ground that can basically destroy all the electronics in a city or a wider area.""We know this works because the Russians and the United States both actually detonated a lot of nuclear weapons in space in the early 1960s, particularly during the Cuban Missile Crisis to kind of show each other we could."The disturbing history of the EMPs included testing the nuclear arms off the southwest coast of Hawaii. This caused measurable effects in Honolulu such as auroras in the sky and the disabling of portions of the electric grid and radio systems in the city.The real worry for a modern society is our vast reliance on electronics, Autry warned. "If somebody did one of these today, your phone would be a brick. Anybody with a pacemaker would drop dead, instantly. Every piece of your electronics... your laptop computer, your internet router, would be gone, and most of the relays in our power grid would be gone so there would be no power."What makes the threat even more dire is the likely inability to replace some of the serviceable parts that would be destroyed during such an attack."Guess what?" Autry asked rhetorically. "The people most likely to have sent that EMP to us are the Chinese, and they're not sending you any more iPhones or letting anybody ship them. Guess what? They make all of our electrical transformers, or if they don't, they make the steel that's required to make the electrical transformers. There's only one U.S. company left that can make that steel," Autry continued.Electrical vehicles could be turned into "fireballs" the space expert noted, while "every internal combustion car on the road is going to be dead because they're all run by computers and electronic ignition system.""We are instantly transported into the Stone Age," Autry described before laughing that in his book "Red Moon Rising," he joked that "Gen Z is gonna learn how to make a fire and sharpen spears" without the help of a YouTuber."It's going to be a really bad day." Classification workaround and preparation"The thing that scares me more," Autry piled on, was the way America's enemies have avoided classifying EMPs in the same category as nukes."Both Russia and China have classified these weapons not as strategic nuclear weapons but as cyber weapons, and they've made it clear that they consider the use of them not to impinge upon any obligations they may have made, or any treaties involving nuclear weapons. They can just use these things as cyber tools."Autry revealed that he sees previous cyber attacks from the aforementioned nations as possible acts of war, but he prefers to focus on solutions rather than pontificate about past occurrences.The policy expert said that the "Space Force is not unaware" of the possibilities of an attack and that the government agency's job is to "develop defensive systems against such an attack" that would defend assets on the ground."We could do a lot better at the state level, and the federal law could help mandate that our critical infrastructure be protected from EMPs. It's not actually super hard to do. You need to put these things inside what we call a faraday cage, which is a metal box or or even a mesh box."Faraday boxes exist commercially, and while somewhat pricy for larger units, companies like Defender Shield and SLNT have popped up to sell products for a few hundred dollars. Phone sleeves, laptop carriers, backpacks, and duffle bags that block magnetic waves and RFID signals are suggested for the average consumer.Another concern of Autry's was the United States being dragged into a conflict by another nation using an EMP. Providing examples like Russia against Ukraine or China against Taiwan, Autry said the countries could act as if it wasn't a real attack on the population because there would be limited casualties.One thing he was certain of is that both the state and the individual could stand to be a lot more prepared.
