House Oversight Committee Probing Biden Voter Mobilization Order

The House Oversight and Accountability Committee is probing a controversial Biden administration executive order tasking the federal government with mobilizing voting groups it says are underrepresented. In a letter obtained by RealClearPolitics, Chairman James Comer, R-Ky., has requested that Office of Management and Budget Director Shalanda Young produce a slew of documents and information concerning the development and implementation of President Joe Biden’s sweeping “Executive Order on Promoting Accessing to Voting” no later than May 28 and a staff-level briefing by May 20. The demand by the chairman of the House Oversight Committee signals an escalation in Republican lawmakers’ efforts to combat an effort they say may be unlawful, if not unconstitutional. The administration characterizes its efforts as a remedy to “discriminatory policies and other obstacles … disproportionally affect[ing]” black, non-English-speaking, handicapped, and other minority voters. Executive Order 14019 calls on all federal agencies to develop and execute corrective plans to “promote voter registration and voter participation.” It instructs officials government-wide to consider “soliciting and facilitating approved, nonpartisan third-party organizations … to provide voter registration services on agency premises.” Seeing the order as potentially enabling “the executive branch to circumvent the legislative process,” Comer is asking Young to clarify the “constitutional or statutory authority the President relied on,” as well as all “White House and OMB documents and communications” pertaining to the drafting of it. In past oversight letters, including ones delivered in June 2022 by then-ranking Republicans on various committees, including Comer, members have also raised concerns that officials could violate the Hatch Act prohibiting their engagement in political activities in carrying out the order. Senate Republicans have also questioned whether the act violates the Antideficiency Act, which precludes federal agencies from using funds “for a purpose that Congress did not explicitly authorize,” namely “voter mobilization.” “Overreach by the federal government often leads to confusion and inconsistencies,” Comer also stated. He cites a recent letter from Mississippi Secretary of State Michael Watson to Attorney General Merrick Garland to illustrate this issue. The order mandates that relevant agencies seek to ensure “access to voter registration for eligible individuals in federal custody.” To satisfy that charge, the Magnolia State official notes that the U.S. Marshals Service is modifying contracts and/or intergovernmental agreements with jails “to provide voter registration materials and facilitate voting by mail,” and likewise that the Justice Department is working to “facilitate voter registration and mail voting for individuals in the custody of the Bureau of Prisons.” He says these efforts create “numerous opportunities for ineligible prisoners to be registered to vote in Mississippi.” Illegal aliens, Watson warns, may be among those receiving information on how to register to vote. The Biden administration issued Executive Order 14019 in March 2021. Despite a raft of oversight requests from House Republicans of agencies within their respective committee jurisdictions, those agencies have largely withheld the strategic plans they were tasked with crafting and implementing, and information regarding the putatively nonpartisan groups with which they have coordinated. The White House has rebuffed RealClearInvestigations in its efforts to solicit details about an order that Republicans characterize as little more than a taxpayer-funded Democrat get-out-the-vote effort. As RealClearInvestigations has previously reported, the Biden administration has sought to drive voter registration through agencies as diverse as the departments of Labor and Housing and Urban Development via job training centers, public housing authorities, and child nutrition programs. U.S. Citizenship and Immigration Services has issued guidance calling for the agency to register voters at naturalization ceremonies. The Department of Education has blessed the use of “federal work-study funds to pay students for “supporting broad-based get-out-the-vote activities, voter registration,” and other activities. In January, over two dozen Pennsylvania legislators filed a federal lawsuit challenging the executive order. The Foundation for Government Accountability—which has litigated with the Biden administration to pry loose documents concerning the order—submitted an amicus brief supportive of the suit, asserting that the agencies’ efforts have one thing in common: “They provide government welfare benefits and other services to groups of voters the vast majority of which have historically voted Democrat.” Republicans’ concerns over the order extend to the involvement of the third-party groups with which agencies were to consider coordinating. The order itself was built on a blueprint from progressive think-tank Democrats. In a since-deleted but still archived analysis, the outfit estimates that if fully implemented, the order could generate 3.5 million new or updated voter registrations annually—a significant figure given that recent presidential elections have been determined by thousands of votes across a few states. Democrats as well as the American Civil Liberties Union have reportedly worked to implement the directive. Documents obtained by The Heritage Foundation’s Oversight Project and released earlier this month show that at a July 2021 listening session convened by the Biden administration, left-leaning activist groups encouraged some of the practices federal agencies would ultimately implement to carry out the directive, for example, in targeting prospective voters in prisons and at naturalization ceremonies. (The Daily Signal was foundation by The Heritage Foundation in 2014.) “Every participant whose party affiliation or political donation history could be identified by the Oversight Project was identified as a Democrat except for one Green Party member,” the report noted. While the participants suggested efforts to target constituencies—including criminals, immigrants, low-income families, including those in public housing, and Native Americans—the Oversight Project observed that “There is no corresponding evidence of efforts [to] increase voter access and education in likely Republican constituencies.” As RealClearInvestigations has also recently reported, Democrats have made purportedly nonpartisan voter registration targeting groups that vote disproportionately Democrat a linchpin of their plans to prevail in recent election cycles. “If the Biden Administration wants to use taxpayer-funded buildings to allow ‘nonpartisan third-party organizations’ to engage in voter registration,” Comer writes, “then the American people deserve to know who these organizations are.” The Oversight Committee’s pursuit of information regarding the order comes in the wake of the House Small Business Committee’s recent escalation of its own probe of the order. It recently subpoenaed two members of the Small Business Administration who refused to sit for transcribed interviews regarding an unprecedented partnership the agency inked with the Michigan Department of State. Under the relevant memorandum of understanding, among other things, state officials may conduct in-person voter registration at administration small business outreach events. Fox News reported that the Small Business Committee found that nearly all, “22 out of 25 such outreach events, have taken place in counties with the highest population of Democratic National Committee target demographics.” In March, a federal judge dismissed the Pennsylvania legislators’ case challenging the executive order on grounds of standing. In late April, the legislators took their case to the Supreme Court, filing a petition for writ of certiorari and motioning for expedited consideration of their request in hopes the nation’s highest court will rule favorably on the matter of standing prior to the 2024 election. 18 States Fight Federal Trans Agenda on Pronouns, Bathrooms

In response to new federal rules on pronouns and bathrooms based on gender identity, 18 state attorneys general are suing the U.S. Equal Employment Opportunity Commission.  The lawsuit, led by Tennessee Attorney General Jonathan Skrmetti, a Republican, was filed Monday in U.S. District Court for the Eastern District of Tennessee.   “This end-run around our constitutional institutions misuses federal power to eliminate women’s private spaces and punish the use of biologically accurate pronouns, all at the expense of Tennessee employers,” Skrmetti said in a public statement.  The Daily Signal first reported last month that the Equal Employment Opportunity Commission published guidance determining that an employer would be guilty of harassment for requiring someone to use a restroom that comports with his or her biological sex, or for referring to someone by a personal pronoun that the person doesn’t want used. The guidance, which the EEOC adopted on a party-line vote of 3-2, would determine how the commission would handle an employee complaint on the matter and also could affect other employee litigation as the formal federal policy.  EEOC has 2,331 employees, according to its 2023 annual report.  Joining Tennessee in the lawsuit are Republican attorneys general from the states of Alabama, Alaska, Arkansas, Georgia, Indiana, Iowa, Kansas, Kentucky, Mississippi, Missouri, Nebraska, Ohio, South Carolina, South Dakota, Utah, Virginia, and West Virginia.  “In America, the Constitution gives the power to make laws to the people’s elected representatives, not to unaccountable commissioners, and this EEOC guidance is an attack on our constitutional separation of powers,” Skrmetti, Tennessee’s attorney general, said. “When, as here, a federal agency engages in government over the people instead of government by the people, it undermines the legitimacy of our laws and alienates Americans from our legal system.” The EEOC issued new sexual harassment guidance that extends Title VII’s prohibition of sex-based discrimination to cover gender identity. Title VII forbids employment discrimination based on race, color, religion, sex, and national origin. It applies to any employer, public or private, with more than 15 employees. Under this guidance, an employer may be responsible under Title VII if the employer, or another employee, uses a name or personal pronoun other than the one an employee prefers for his or her gender identity, or limits access to a restroom or other sex-segregated facility that isn’t consistent with what the employee prefers to use.  This rule prevails regardless of the biological sex of the employee in question. “Harassing conduct based on sexual orientation or gender identity includes … repeated and intentional use of a name or pronoun inconsistent with the individual’s known gender identity (misgendering) or the denial of access to a bathroom or other sex-segregated facility consistent with the individual’s gender identity,” EEOC’s new enforcement guidance says. An EEOC spokesperson referred The Daily Signal to the Justice Department for comment on this report. A Justice Department spokesperson didn’t respond by publication time.  In a previous public statement, EEOC Chairwoman Charlotte Burrows, a Democrat, praised the enforcement guidance.  “Harassment, both in-person and online, remains a serious issue in America’s workplaces,” Burrows said shortly after the commission announced the guidelines. “The EEOC’s updated guidance on harassment is a comprehensive resource that brings together best practices for preventing and remedying harassment and clarifies recent developments in the law.” Joining Burrows to vote in favor of the updated harassment guidance were two other Democrats, Vice Chair Jocelyn Samuels and commissioner Kalpana Kotagal. The commission’s two Republican members, Keith Sonderling and Andrea Lucas, voted against the guidance. In 2021, Burrows attempted to unilaterally include such actions under what constitutes harassment through a press release,  without public comment or a vote by the full commission.  However, a federal court in Tennessee enjoined the guidance from going forward in 2022. Another federal court in Texas vacated Burrows’ guidance altogether. The Equal Employment Opportunity Commission did not appeal the rulings. RFK Jr. Files Lawsuit Against Meta, Alleging Censorship of Presidential Campaign Video

Kennedy Jr., who is running as an independent candidate in the upcoming US presidential election, has announced that he filed a lawsuit against Meta (Facebook and Instagram) in the US District Court for the Northern District of California. Kennedy alleges that the two platforms censored a video, the documentary “Who is Bobby Kennedy,” that is part of his presidential campaign. We obtained a copy of the lawsuit for you here. The filing, submitted by Kennedy and his political action committee (PAC), accuses Meta of using its platforms to prevent users from watching, sharing, or posting links to the video, a short time after it was first released. The platforms are accused of suppressing a video about the presidential candidate’s career and his criticism of vaccines as a result of the US government’s repeated demands that tech companies do so. To bolster this argument, the filing refers to Murthy v. Missouri, currently in the Supreme Court, where the allegation is that the White House pressured and colluded with social media powerhouses to censor content it disfavors, including around vaccines. Meta first blocked the documentary on May 3 – two days later formally reversing this decision, describing it as “a mistake” – but Kennedy maintains that the film is still demoted and shadow-banned, and otherwise sabotaged in terms of visibility. He also made a point that the case is not only about free speech suppression, i.e., a First Amendment issue, but also, interference in the democratic process. “Meta is censoring a biographical film about a major candidate in an election year,” Kennedy stressed – and one might add, this is happening on some of the major and most influential platforms. This is not the politician and activist’s “first rodeo” trying to take Big Tech to task for, in his view, unjustifiably censoring his content. A lawsuit he brought against Google (YouTube) for removing his videos critical of Covid vaccines’ efficacy is now being considered in a court of appeals. Appearing on Tuesday’s edition of The View to hawk his new book The Situation Room: The Inside Story of Presidents in Crisis, ABC anchor George Stephanopoulos not only admitted to the existence of the Deep State, but he also praised them as “packed with patriots.” He went on to push a conspiracy theory against President Ronald Reagan which was debunked long ago by a congressional commission. The former lackey to President Bill Clinton was teed up to praise the Deep State by faux-conservative co-host Alyssa Farah Griffin. She gushed about how the Deep State were the ones who make the history of America: “My favorite thing is that you interviewed Situation Room staff. I’ve always said that it's White House staff whose names you'll never know that are the writers of history. They’ll tell us so many details.” Stephanopoulos went on to lionize the unelected, busybody bureaucrats who often injected themselves into matters of the nation to influence and control what happened in the country: You know, that was my favorite part about doing the book. I interviewed about a hundred duty officers from the White House – and these are people that come – relatively young people who come from all over the government: the CIA, the DIA, Defense Department, military. And, you know, some people like to call those people the Deep State. He went on to declare “that the Deep State is packed with patriots” who supposedly “don't care about political parties” and were only “there to serve the presidency and institution” and not a particular president.     Quoting one member of the Deep State he spoke to, Stephanopoulos claimed they “serve in silence.” Meanwhile, he put a name to the quote: Mike Seelie. So much for being silent. In the second block of the interview, Stephanopoulos and moderator Whoopi Goldberg pushed a conspiracy theory against Reagan he tried to revive in his book. Falsely claiming “there’s no question about it,” Stephanopoulos asserted – without evidence – that Reagan had worked with Iranian extremists to prolong the Iranian Hostage Crisis to help him win the election against President Jimmy Carter: The Iranians decided to hold the hostages until after -- they waited until the moment that Ronald Reagan took the oath of office. You know, one of the things we also learned in the last year was there have always been questions about whether or not somehow the Reagan campaign had tried to influence the Iranians to hold; and the congressional commission said no, but last year it did turn out that John Connelly had gone to the Middle East and had meetings about it that at least suggested that something might have happened. Even Stephanopoulos admitted that a congressional commission debunked what he was peddling; and yet, the ABC “journalist” was still pushing the lies anyway so that he could sell his book and make money. 'Tragic injustice': Clinton-appointed judge sentences pro-life rescuer to nearly 5 years in jail over peaceful protest

A Clinton-appointed judge has sentenced pro-life activist Lauren Handy to four years and nine months in prison plus three years' supervision for peacefully speaking out in support of the lives lost and threatened at an infamous late-term abortion clinic in the nation's capital. U.S. District Judge Colleen Kollar-Kotelly's heavy-handed sentence in Handy's case, which was just one year shy of what Biden's admittedly pro-abortion Department of Justice advocated for, has been blasted by Republicans and other pro-life activists. 'Meanwhile, abortionists who dismember and kill children walk free. A grave injustice!' The Thomas More Society, which defended Handy in the case, has indicated it will proceed with an appeal on behalf of Handy, not only to overturn her conviction but to challenge the constitutionality of the Freedom of Access to Clinic Entrances Act, under which she was convicted in August. Other pro-life rescuers who took part in the peaceful 2020 protest appear to also be headed to prison, including John Hinshaw, who was sentenced Tuesday to 21 months in prison. Background Handy, 30, is the director of activism and mutual aid for Progressive Anti-Abortion Uprising. According to its website, PAAU is "committed to the progressive feminist values of equality, non-violence, and nondiscrimination through an anti-capitalist lens. ... We're committed to unparalleled bravery and to always challenging the oppressive status quo. We're committed to ending elective abortion to matter how long it takes." Blaze News previously reported that Handy and four other PAAU activists — John Hinshaw, Heather Idoni, William Goodman, and Herb Geraghty — were convicted of FACE Act violations last year for supposedly blocking access on Oct. 22, 2020, to the Washington Surgi-Clinic, operated by the late-term abortionist Cesare Santangelo. The FACE Act prohibits anyone from obstructing the entrance to an abortion clinic or intimidating or interfering with a woman attempting to have her unborn baby exterminated. The Biden DOJ claimed that Handy partook in a "clinic blockade that was directed by Handy and was broadcast on Facebook. The defendants conspired to and did forcefully enter the clinic and block access to the clinic using their bodies, furniture, chains and ropes. Once the blockade was established, footage of the activities was live-streamed." Legal analysts at the Heritage Foundation noted that "Congress specified that the FACE Act doesn't 'prohibit any expressive conduct (including peaceful picketing or other peaceful demonstration) protected from legal prohibitions by the First Amendment to the Constitution,' including the 'free speech or free exercise clauses,' occurring 'outside a facility.'" Handy's defense also characterized the incident as a "rescue and protest," noting that she was under the distinct impression, in part due to an undercover video published by Live Action, that Santangelo was not just executing live-birth abortions but leaving born-alive infants to die. Kollar-Kotelly ultimately barred the defendants from claiming their protest was protected by the First Amendment as well as from claiming they had protested in defense of a third person, stating "a defendant may not don a vigilante's hood." The Clinton judge, who made sure to chastise a nun in the public gallery for daring to make the sign of the cross, also prevented the defense from showing the undercover 2012 footage that prompted Handy to want to intervene for fear of prejudicing the jury. Handy, convicted of a FACE Act violation as well as of conspiracy against rights, sat in prison for nine months until her sentencing. Sentencing The Biden DOJ asked Kollar-Kotelly to give Handy 6.5 years, claiming she was among the "masterminds who chose the clinic, advertised the event, recruited participants, and planned the crime," reported the Washington Examiner. Handy's defense alternatively asked for a one-year sentence, emphasizing the peaceful nature of the event that entailed an "attempt to rescue preborn children from imminent death at the hands of an abortionist who Ms. Handy believed performed illegal late-term procedures." The Clinton judge reportedly expressed concern that Handy's protest hindered multiple prospective patients from speedily entering the clinic, including a woman experiencing labor pains. "Your views took precedence over, frankly, their human needs," said Kollar-Kotelly, apparently discounting the human needs ignored deeper within the clinic. Prosecutors apparently also won the judge over with the claim that the protest was not peaceful, as a clinic nurse allegedly sprained her ankle when one of Handy's co-defendants entered the clinic, reported the New York Post. Kollar-Kelly claimed Handy was not being punished for her pro-life beliefs but rather her actions, stating, "The law does not protect violent nor obstructive conduct, nor should it." Response The outcome incensed Republicans, women's organizations, and pro-life activists, who ostensibly agreed that the FACE Act has outstayed its welcome, especially after having been weaponized against pro-life activists by the Biden DOJ. Live Action president Lila Rose noted Handy "has just been sentenced to 57 months in federal prison for handing roses and resources to women at an abortion facility[.] Meanwhile, abortionists who dismember and kill children walk free. A grave injustice!" Rep. Chip Roy (R-Texas) said in a statement obtained by Blaze News, "Today's outrageous 57-month sentence for a progressive pro-life activist is a stark reminder: Biden's DOJ is fully weaponized against pro-life American citizens, and they are using the FACE Act to do it." Roy stressed that "House Republicans should defund the DOJ weaponization, repeal the FACE Act, and stand up for the freedoms that we campaign on." 'Ms. Handy deserves thanks, not a gut-wrenching prison sentence.' "This sentencing of @PAAUNOW's Lauren Hardy is a tragic injustice," said Penny Nance, CEO of the Concerned Women for America. "In policy and practice, the FACE Act is an unjust law that must be repealed. NFL legend Lawrence Taylor took a day off retirement when he sacked Biden and the Democratic Party at a Trump campaign event in Jersey this past weekend. Illegal alien attempts to infiltrate military base: Report

An illegal alien recently attempted to gain unauthorized entry into a Virginia military base, according to a report from Kelly Sienkowski with the Potomac Local News.The news outlet reported that two males posing as Amazon delivery drivers tried to gain access to Quantico Marine Corps Base near Triangle, Virginia. On May 3, the men drove a box truck up to the base’s main gate. They told the guards that they worked for Amazon and were attempting to fulfill a delivery to the base’s post office. After they failed to provide access credentials, local law enforcement instructed the men to wait in a holding area so that they could conduct a secondary inspection.'Have U.S. investigators ruled out a terrorism motive?'Captain Michael Curtis told Potomac Local News, “One of the military police officers noticed the driver, ignoring the direct instructions of the officers, continued to move the vehicle past the holding area and attempted to access … Quantico.”The officers acted quickly to initiate the vehicle denial barriers, which blocked the truck from proceeding farther onto the base.Curtis told the news outlet that the two males were turned over to Immigration and Customs Enforcement custody. He noted that no one was injured as a result of the incident. Several sources revealed to Potomac Local News that one of the men was a Jordanian national who had recently entered the country through the southern border. One of the truck's occupants was reportedly on the U.S. terrorist watch list, according to the sources. However, the military base was unable to confirm the sources’ information.The sources further claimed that the base had increased its security measures since the incident and warned personnel to be on high alert, the news outlet reported.The Marines cited the individuals for trespassing, according to Todd Bensman, a senior national fellow at the Center for Immigration Studies. Bensman wrote in a New York Post column regarding the incident, “Did illegal border crossers from the Middle East just try to attack a U.S. military base? Many more questions deserve answers too. But the federal government has gone mum.”“Have U.S. investigators ruled out a terrorism motive? Do U.S. counterterrorism agencies even want to know, and is anyone even investigating that question?” Bensman continued. “Were there any weapons in the truck or on the illegal immigrants it carried? Was the truck itself the weapon? When and how exactly did the men enter the United States?”Sienkowski told Bensman that no one would reveal any additional information about the incident. “We have reached out to almost every elected official, and many running for office,” Sienkowski stated.“What really blows my mind is that no other media has followed up on the story after a whole week has passed,” Sienkowski added. “We need more transparency in how our border problems are impacting national security through localized incidents like this one.”In response to the report, Senator Bill Hagerty (R-Tenn.) wrote on X, “Our greatest national security threat is the border crisis unleashed by [President Joe Biden]. Woke progressivism has taken over far too much of America, from our schools to our medical establishment, as well as our government. Common sense would solve this, but unfortunately, common sense is not all that common.
