The Democrat-appointed justices on Colorado's Supreme Court ruled 4-3 in December that former President Donald Trump engaged in an insurrection on Jan. 6‚ is ineligible to be president‚ and cannot therefore appear on the ballot in the state. In the months since‚ Maine and Illinois have similarly disqualified the Republican front-runner‚ prompting Trump's legal team to file appeals. The U.S. Supreme Court issued a timely opinion Monday morning‚ one day ahead of the Republican primaries in Maine and Colorado: "Because the Constitution makes Congress‚ rather than the States‚ responsible for enforcing Section 3 against federal officeholders and candidates‚ we reverse." This decision will undoubtedly impact efforts in other states by activist groups to disenfranchise their fellow voters and spare President Joe Biden from facing his top rival in the upcoming election. Quick background Six petitioners backed by a Democrat-aligned group sued in September 2023 to have Trump removed from Colorado ballots. Citizens for Responsibility and Ethics in Washington brought the case on behalf of the Colorado voters. CREW‚ a partisan activist group that fancies itself as a government watchdog‚ was optimized as an attack dog for the Democratic Party by Media Matters founder David Brock in advance of the 2016 election. The Colorado initiative was executed under CREW's current president Noah Bookbinder‚ up until recently a member of the Biden Department of Homeland Security's Homeland Security Advisory Council. According to the petitioners‚ Section 3 of the 14th Amendment concerning insurrection applies to the president‚ in this case Trump‚ and the Republican's actions on Jan. 6‚ 2021‚ qualified. Claiming it did "not reach these conclusions lightly‚" the state court's majority determined that Trump had "engaged in" insurrection; that Section 3 applies to the presidency; and that Trump's Jan. 6 speech at the Ellipse was not protected by the First Amendment. Blaze News previously noted that Trump's legal team‚ which appealed the ruling‚ has argued that: "Section 3 of the Fourteenth Amendment prohibits individuals only from holding office[.] ... According to its Monday opinion per curiam‚ the U.S. Supreme Court evidently agrees with Trump's legal team on this final bullet. The high court puts Colorado in check The Supreme Court noted that Congress is empowered by the Constitution to pass "appropriate legislation" to "enforce" the Fourteenth Amendment but that states enjoy no such power in the case of national elections. "We conclude that States may disqualify persons holding or attempting to hold state office‚" wrote the court. "But States have no power under the Constitution to enforce Section 3 with respect to federal offices‚ especially the Presidency." "This can hardly come as a surprise‚ given that the substantive provisions of the Amendment 'embody significant limitations on state authority‚'" continued the high court. "Under the Amendment‚ States cannot abridge privileges or immunities‚ deprive persons of life‚ liberty‚ or property without due process‚ deny equal protection‚ or deny male inhabitants the right to vote. ... On the other hand‚ the Fourteenth Amendment grants new power to Congress to enforce the provisions of the Amendment against the States." All nine members of the court agreed that the Colorado Supreme Court's decision "cannot stand." Justice Amy Coney Barrett noted that the "Court has settled a politically charged issue in the volatile season of a Presidential election. ... For present purposes‚ our differences are far less important than our unanimity: All nine Justices agree on the outcome of this case. That is the message Americans should take home." Justices Sonia Sotomayor‚ Elena Kagan‚ and Ketanji Brown Jackson indicated in their concurring opinion that allowing Colorado to unilaterally remove a presidential candidate is unfit as a candidate in a national election would "create a chaotic state-by-state patchwork‚ at odds with our Nation's federalism principles." The liberal justices took issue‚ however‚ with the majority's announcement that a "disqualification for insurrection can occur only when Congress enacts a particular kind of legislation pursuant to Section 5 of the Fourteenth Amendment‚" noting that in doing so‚ "the majority shuts the door on other potential means of federal enforcement." A New York City business owner charged illegal migrants $300 per month to reside in his furniture store’s basement‚ a Bronx cellphone store‚ and an abandoned library‚ the New York Post reported Tuesday.Ebou Sarr‚ 47‚ told the news outlet that the New York Police Department shut down his hostile operations in January after they discovered he was allowing illegal West African migrants to reside in cramped and hazardous conditions.Sarr explained that he converted the Old Fordham Library in the Bronx into a makeshift shelter. According to a criminal complaint obtained by the Post‚ when police entered the location‚ Sarr stated‚ “I run it.”“I help these people because they have nowhere to go. Shelters won’t accept us. I have proof of residency from the mayor … I have a business up the street‚ but this is where I live‚” he reportedly said.As a result of the illegal operation‚ Sarr was charged with two counts of trespassing on the abandoned property.“It was a place that I think is empty‚ and it’s safe for us to put our people. We were trying to get the city to give us that library. It’s been there for so many years‚” Sarr told the Post. “Places like that‚ they can put the people in. Fix the place and put the people in there.”Sarr‚ who owns a South Richmond Hill furniture store‚ charged illegal migrants $300 per month to reside at one of his improvised hostiles. Police reported “severe overcrowding and hazardous fire trap conditions” inside the abandoned library and the basement of the furniture store. A third location‚ a Bronx cellphone store‚ had “hazardous life-threatening conditions‚” law enforcement said.Since the three locations lacked bathroom facilities‚ residents used showers at a nearby gym.Fallou Seye‚ 29‚ told the Post that “it was hard” to come up with the money to stay in the basement of the furniture store‚ a space he shared with 45 other people who were forced to share beds. “We had no bathroom; we had to go to Planet Fitness to take a shower‚” Seye explained. Department of Homeland Security Secretary Alejandro Mayorkas lashed out Sunday at Gov. Greg Abbott‚ displacing blame over the illegal immigration crisis and accusing the governor of "trying to wreak havoc" across the nation. Mayorkas is apparently rankled by Abbott's refusal and that of other Republicans to accept the president's conveniently timed excuses concerning the crisis at the southern border. With an election around the corner and illegal immigration an increasingly pressing concern for Americans‚ Biden and elements of his administration have begun suggesting that the solution to the border crisis is primarily a matter for congressional lawmakers to tackle — especially now that Congress is run by Republicans. Mayorkas‚ who has overseen the unlawful entry of over 7 million foreign nationals into the country since January 2021 and was impeached last month for "willfully and systemically refus[ing] to comply with the immigration laws‚" continued to run with the administration's preferred narrative Sunday‚ telling CNN's "State of the Union" that "administrative action is no substitute for an enduring solution. ... Legislation is the enduring solution." Last month‚ the Biden White House was reportedly considering taking executive action on the border‚ including possibly restricting illegal aliens' ability to claim asylum once in the U.S. However‚ Mayorkas proved evasive Sunday when pressed about whether the administration would consider even a "Band-Aid" solution in the short term. Rather‚ the secretary intimated that his boss‚ who halted the construction of border wall in his first days in office‚ was more or less impotent to take meaningful action. "As a matter of fact‚ former President Trump tried to close the border‚ and it was enjoined in the courts and never saw the light of day‚" said Mayorkas. "The reality is that Congress needs to act‚ and President Biden said that Congress needs to get a spine." Abbott told CNN's "State of the Union" the previous week that Biden's suggestion that he needed Congress to take action at the border was "completely false." "The fact of the matter is‚ there are laws on the books passed by Congress of the United States right now that authorize the executive branch to deny illegal entry; if people get here illegally‚ to detain them; as well as to require the president and the presidential administration to build border barriers‚" continued Abbott. "The president is not using his executive authority to do any of those those things that Congress has already authorized." "The president doesn't need new laws. Identical twins in Minnesota reportedly swapped places after one of them was driving high on a rural highway and smashed into an Amish carriage‚ killing two children in the process‚ according to the New York Post.The authorities spent months building the case before finally announcing charges.
