SCOTUS Rules In Favor Of Oregon City’s Ban On Homeless Encampments

The Supreme Court ruled 6-3 on Friday that an Oregon city’s law restricting camping on public property does not violate the Constitution’s prohibition against enacting cruel and unusual punishments under the Eighth Amendment.  Writing for the majority, Justice Neil Gorsuch said that the courts did not have the right to strike down laws enacted by the city of Grants Pass in response to the homelessness crisis. Gorsuch was joined by Justices Brett Kavanaugh, John Roberts, Samuel Alito, and Amy Coney Barrett, with Clarence Thomas writing a concurring opinion.  “The Constitution’s Eighth Amendment serves many important functions, but it does not authorize federal judges to wrest those rights and responsibilities from the American people and in their place dictate this Nation’s homelessness policy,” Gorsuch wrote.  Previously, the 9th Circuit Court of Appeals ruled that Grants Pass could not enforce its restrictions on sleeping on public property if the number of publicly available beds for the homeless was less than the number of homeless estimated in the area. The city’s laws, including fines of $295 for sleeping on public property, were challenged under the Eighth Amendment on behalf of a group of homeless people in the area.  “Yes, people will disagree over which policy responses are best; they may experiment with one set of approaches only to find later another set works better; they may find certain responses more appropriate for some communities than others,” Gorsuch wrote. “But in our democracy, that is their right.  “Nor can a handful of federal judges begin to ‘match’ the collective wisdom the American people possess in deciding ‘how best to handle’ a pressing social question like homelessness,” he added.  Justices Sonia Sotomayor, Ketanji Brown Jackson, and Elena Kagan all dissented.  “Sleep is a biological necessity, not a crime. For some people, sleeping outside is their only option,” Sotomayor wrote. “For people with no access to shelter, that punishes them for being homeless. That is unconscionable and unconstitutional.” CLICK HERE TO GET THE DAILYWIRE+ APP Grants Pass Mayor Sara Bristol told the Associated Press she was grateful for the court’s decision.  “This lawsuit was about whether cities have a right to enforce camping restrictions in public spaces, and I’m relieved that Grants Pass will be able to reclaim our city parks for recreation,” she said. “Homelessness is a complex issue, and our community has been trying to find solutions.” Cities across the country have grappled with how to handle increasing homelessness in recent years, with an estimated 582,000 homeless in 2022.

The liberal hosts of ABC’s “The View” found themselves “in mourning” and going through the various stages of grief during Friday’s broadcast as they recapped the disastrous debate between former President Donald Trump and current President Joe Biden. The debate, which has reportedly caused panic within the Democratic Party, showcased all of the frailty and confusion that conservative outlets have been pointing out in Biden — and put it on display in a way that very few have even attempted to excuse or explain away. “The View” co-host Joy Behar was one of the few, advising her co-hosts not to “get too depressed yet” — while Sunny Hostin said that she was “mourning” — and suggesting that his lackluster performance was just due to a cold giving him a hoarse voice. “Let’s not get too depressed yet,” Joy Behar tells the panel. Saying that the debate had been “really hard to watch,” Haines went on to admit that Democrats had been working overtime to spin Biden’s age and cognitive abilities as less concerning than they really were. “Democrats need to stop spinning the age problem. Over and over Democrats have twisted themselves into a pretzel to say, ‘Don’t believe your lying eyes,'” Haines added, admitting that she and her co-hosts had done the same. She then immediately pivoted to attack Trump, saying that Republicans should be the ones who had to get a new nominee. Ana Navarro defended Biden, saying she was not ready to throw in the towel “until Joe Biden tells me he’s giving up.” Fake conservative Ana Navarro asserts that Democrats are better humans than Republicans: “Democrats are exquisite. Trump Makes Prediction On Whether Biden Will Stay In Race After CNN Presidential Debate

Former President Donald Trump predicted on Friday that President Joe Biden would remain the Democratic nominee for president after Biden was widely criticized for his shaky debate performance Thursday night. Trump told Fox News he believed Biden would not be replaced after some Democratic commentators suggested that Biden should step down and allow someone to take his place following his poor performance at the CNN presidential debate. During the debate, Biden repeatedly mumbled and made other verbal missteps, causing panic among Democrats. “Yes, I think he will be the nominee,” Trump said when asked by Fox on Biden’s future as the nominee. Trump added that he didn’t think any other Democratic candidate would have performed better against him. “It was a great honor to be on stage representing the people of our country,” Trump said. Throughout the debate, Trump repeatedly attacked Biden over the record number of illegal immigrants who have entered the country under his watch while Biden criticized Trump for his handling of the economy and ongoing legal problems. Much of the post debate commentary focused on Biden’s mental and physical health. “He seemed a little disoriented,” former Obama adviser David Axelrod said of Biden after the debate. “But by that time, I think the panic had set in. And I think you’re going to hear discussions that − I don’t know will lead to anything − but there is going to be discussions about whether he should continue.” The Trump campaign quickly declared victory after the debate concluded. “Despite taking a week-long vacation at Camp David to prepare for the debate, Biden was unable to defend his disastrous record on the economy and the border,” Trump campaign co-chairs Chris LaCivita and Susie Wiles said on Thursday. “President Trump is spot-on when he says that if Joe Biden is too incompetent to stand trial, then Biden is too incompetent to be President.” CLICK HERE TO GET THE DAILYWIRE+ APP The Biden campaign has already pushed back on claims that he should step away from his presidential campaign, saying he will remain in the race. “I don’t walk as easy as I used to. I don’t speak as smoothly as I used to. I don’t debate as well as I used to,” Biden said at a rally in North Carolina on Friday. “But I know what I do know. I know how to tell the truth. I know right from wrong. I know how to do this job.” Trump will also be holding a campaign event on Friday in Chesapeake, Virginia.
