The Senate released the text of a $118 billion spending bill Sunday night that includes funding for U.S. border security as well as security-related aid for Ukraine‚ Israel‚ and Taiwan. But House leadership calls the Senate bill “dead on arrival” if it reaches the lower chamber. “I’ve seen enough‚” House Speaker Mike Johnson‚ R-La.‚ wrote on X about three hours after Senate leadership released text of the spending bill.   “This bill is even worse than we expected‚” Johnson said‚ adding that it “won’t come close to ending the border catastrophe the president has created.” “As the lead Democrat negotiator proclaimed: Under this legislation‚ ‘the border never closes.’ If this bill reaches the House‚ it will be dead on arrival‚” the House’s top Republican said. As the lead Democrat negotiator proclaimed: Under this legislation‚ “the border never closes.”If this bill reaches the House‚ it will be…— Speaker Mike Johnson (@SpeakerJohnson) February 5‚ 2024 House Majority Leader Steve Scalise‚ R-La.‚ posted Sunday on X: “The Senate Border Bill will NOT receive a vote in the House.”  “Here’s what the people pushing this ‘deal’ aren’t telling you‚” Scalise continued. “It accepts 5‚000 illegal immigrants a day and gives automatic work permits to asylum recipients—a magnet for more illegal immigration.”  The Senate’s 370-page bill includes about $20 billion in border-related spending and‚ as Scalise noted‚ directs the Department of Homeland Security to close the southern border “during a period of 7 consecutive calendar days‚ [if] there is an average of 5‚000 or more aliens who are encountered each day.”   Over 1.8 million illegal aliens a year still would be permitted to enter the United States under the legislation. The bill also would give the president the authority to “direct the [homeland security secretary] to suspend use of the border emergency authority on an emergency basis.”   Rep. Mark Green‚ chairman of the House Homeland Security Committee‚ said in a written statement Sunday night that he “will vehemently oppose any agreement that legitimizes or normalizes any level of illegal immigration.”  Rep. Andy Biggs‚ R-Ariz.‚ called the bill “the worst idea on border ‘security’— EVER” and “a disaster.”   Senate Majority Leader Chuck Schumer‚ D-N.Y.‚ and Senate Minority Leader Mitch McConnell‚ R-Ky.‚ are among those touting the bipartisan nature of the bill‚ which includes $60 billion for Ukraine and $14.1 billion for Israel. Sen. James Lankford‚ R-Okla.‚ led the way in negotiating the terms of the bill with Democrats.  Lankford has pushed back on criticism that the bill would allow 5‚000 illegal aliens into the country a day.   “The emergency authority is not designed to let 5‚000 people in‚ it is designed to close the border and turn 5‚000 people around‚” Lankford said.  Sen. Chris Murphy of Connecticut‚ the lead Democrat negotiator‚ released a video message Sunday night explaining that the bill “gives the president the power to better manage the border.”   “So‚ what we did is give the president a limited authority to shut down asylum claims in between the land ports of entry‚” Murphy said‚ “so that when the numbers of crossings are really high‚ we funnel people who want to apply for asylum to those ports of entry where we can do it in a more manageable‚ more humane way.”   “We’re never going to shut down asylum processing‚ but we are going to make sure that it’s done in a more expeditious manner‚” Murphy said. (@ChrisMurphyCT) February 5‚ 2024 The Senate bill also proposes to provide hundreds of thousands of work permits to illegal aliens‚ expand free services for them‚ and include bailouts for so-called sanctuary cities and states that shelter illegal aliens from federal authorities.   Some of Lankford’s GOP Senate colleagues have gone so far as to call the bill a “betrayal of the American people‚” Sen. Mike Lee‚ R-Utah‚ said. The Senate legislation is “an open-borders bill if I’ve ever seen one‚” Sen. Josh Hawley‚ R-Mo. Sen. John Cornyn‚ R-Texas‚ told Breitbart that he has “questions and serious concerns” about the bill.   Sen. Steve Daines‚ R-Mont.‚ chairman of the National Republican Senatorial Committee‚ said he “can’t support a bill that doesn’t secure the border‚ provides taxpayer-funded lawyers to illegal immigrants‚ and gives billions to radical open borders groups.” “I’m a no‚” Daines added. The Senate bill also faces criticism from the political Left for being too restrictive.   “After months of a negotiating process that lacked transparency or the involvement of a single border-state Democrat or member of the Congressional Hispanic Caucus‚ it is no surprise that this border deal misses the mark‚” Sen. Alex Padilla‚ D-Calif.‚ said in a written statement.   Rep. Pramila Jayapal‚ D-Wash.‚ said the Senate bill includes “poison pill provisions such as a new Title 42-like expulsion authority that will close the border and turn away asylum-seekers without due process.”   The bill needs 60 votes in the Senate to overcome a filibuster by some senators. Even if the legislation manages to pass the Senate‚ it won’t receive a vote in the House unless Johnson‚ Scalise‚ and the rest of Republican leadership there change their position‚ which appears unlikely.   The Senate was expected to hold a procedural vote Wednesday on the bill. The House passed a border security bill‚ HR 2‚ in May. That an IP address is not a person and cannot be conclusively tied to an individual is self-evident‚ but does a person have the right to anonymous speech? In a cynical attempt to circumvent First Amendment concerns‚ film companies are making the case that an IP address is not a person – which is often reiterated by defenders of those accused of content “piracy” – and even by courts. But film companies are now using the argument just so they could get Reddit to share IP addresses‚ and then‚ they could get to the person. This case‚ as reported by Torrent Freak‚ concerns Reddit users who post comments related to piracy‚ and therefore unmasking them would be a First Amendment violation in terms of anonymous speech. Voltage Holdings crops up again in this “war on piracy” as one of the companies in question. In the past‚ the targets of their legal action have been BitTorrent users‚ when the IP was used as proof that a certain individual is a “pirate.” That didn’t go so well‚ but now that Reddit has told a court IP addresses are identifying information‚ Voltage Holdings made the “not a person” argument‚ and said that anonymity would not be jeopardized by Reddit handing over IP address logs and unmasking them. Reddit’s case is not as simple as that though‚ since the company claims that once they have the IP address‚ the film companies could go to ISPs to obtain (Reddit) account information. Days later‚ reports said that another unmasking attempt via a DMCA subpoena – this time of BitTorrent users accused of piracy – got blocked by a court in Hawaii. Voltage Holdings featured here as well‚ along with Millennium Funding‚ and Capstone Studios‚ while in the opposite corner sat Cox Communications‚ and‚ of course‚ its users whose identities the companies want. Cox informed the targeted individuals and gave them an opportunity to formally object‚ which one of them did‚ leading the court to find the subpoena was not valid under DMCA’s section 512(h). The key reason is that this section provides ISPs with certain safe harbor protections‚ which in turn makes the attempt to learn about their users’ identities in this scenario invalid. Senator Mark Warner Argues “Misinformation or Disinformation” Shouldn’t Have First Amendment Protections

Senator Mark Warner has aggressively gone after speech protections‚ seeking to seemingly single-handedly reinterpret the First Amendment while complaining that courts dealing with White House/Big Tech collusion are now making the Biden administration “very timid.” The Democrat apparently proceeds from the rule‚ “disinformation is whatever we say it is” – in itself too arbitrary to be taken seriously. But that doesn’t stop Warner from building a big case for rethinking the First Amendment and facilitating censorship even further‚ by effectively strengthening‚ rather than abandoning‚ the said collusion. If something is considered “true misinformation or disinformation‚” the chairman of the Senate Intelligence Committee told NPR‚ then that‚ along with another favorite yet poorly explained scare – deep fakes – does not qualify for First Amendment protections. “I think when you’re talking about true misinformation or disinformation‚ or when you’re talking about utilization of deepfakes where an image…is put up and it’s not us‚ but it looks like us and sounds like us‚ I don’t think those are First Amendment protections‚” is the full quote from the senator. And Warner wants to bring some stock market rules into the world of fundamental rights and free speech‚ suggesting that information labeled as disinformation should be treated as malicious and banned like manipulation is banned from the stock market. The senator then proceeded to talk about 2020 “election deniers” while in the same breath denying the integrity of the 2016 election‚ by once again fear-mongering about the supposed impending doom‚ “a perfect storm in terms of election interference.” To stop that from happening‚ and to keep the current administration in power‚ Warner wants to make its ability to censor and keep “in contact” with the likes of Google and Facebook intact‚ if not stronger. That is why he has made extra effort – penned an amicus brief – in a bid to get the Supreme Court to reverse an injunction concerning the government/Big Tech collusion‚ brought up in the NetChoice‚ LLC v. Paxton case and issued by the Fifth Circuit Court of Appeals. The senator went on to say that he “doesn’t believe” collusion of that kind has to do with free speech suppression. Instead‚ according to him‚ it has to do with “the ability of the government to be able to at least talk to Facebook and Google to say‚ hey‚ if you see misinformation – or can we share evidence of Russian activity? How do we cooperate together?” But it seems Warner believes the US legal system‚ or parts of it‚ trying to put some breaks on this oddly undemocratic practice‚ are making Biden’s White House “very timid” – whereas he is “trying to push the Biden administration to be a little more aggressive.” “But – rest assured that there is not the level of communication (with Big Tech) that existed in 2020 or 2022 or 2018‚” the senator lamented.
