A federal judge in Kentucky on Thursday struck down the Biden administration’s attempt to rewrite Title IX rules to define sex by ‘gender identity.’ “The U.S. District Court Eastern District of Kentucky Northern Division made the ruling in Cardona v. Tennessee on Thursday,” Fox News noted. The ruling struck down the change nationwide. “Tennessee has successfully defended Title IX, and the country, from the Biden Admin’s radical and unlawful rewrite!” Tennessee Attorney General Jonathan Skrmetti said. “The court’s ruling is yet another repudiation of the Biden administration’s relentless push to impose a radical gender ideology through unconstitutional and illegal rulemaking,” he said. Fox News reports: The ruling came months after the Supreme Court rejected the Biden administration’s emergency request to enforce portions of a new rule that would have included protections from discrimination for transgender students under Title IX. The sweeping rule was issued in April and clarified that Title IX’s ban on “sex” discrimination in schools covers discrimination based on gender identity, sexual orientation and “pregnancy or related conditions.” The rule took effect Aug. 1, and, for the first time, the law stated that discrimination based on sex includes conduct related to a person’s gender identity. It led to more than two dozen attorneys general suing over the rule, arguing it would conflict with some of their state laws that block transgender students from participating in women’s sports. “When Title IX is viewed in its entirety, it is abundantly clear that discrimination on the basis of sex means discrimination on the basis of being a male or female,” the court’s opinion read. “As this Court and others have explained, expanding the meaning of ‘on the basis of sex’ to include ‘gender identity’ turns Title IX on its head. In a decision issued Thursday, U.S. District Judge Danny C. Reeves scrapped the entire 1,500-page regulation after deciding it was “fatally” tainted by legal shortcomings. The rule had already been halted in 26 states after a wave of legal challenges by Republican states. President-elect Donald Trump previously promised to end the rules “on day one” and made anti-transgender themes a centerpiece of his campaign. The decision came in response to a lawsuit filed by Tennessee, Kentucky, Indiana, Ohio, Virginia and West Virginia. In a statement, Tennessee Attorney General Jonathan Skrmetti called it a “victory for the protection of girls’ privacy in locker rooms and showers, and for the freedom to speak biologically-accurate pronouns.” Read the full ruling HERE.

President Trump will meet with Sen. John Fetterman (D-PA) at Mar-a-Lago. According to CBS News, the Pennsylvania Democrat accepted an invitation from Trump to meet at his Florida estate. “That is the plan. Yes, we are going to have a conversation,” Fetterman told CBS News. “I think that one, he’s the president, or he will be officially,” Fetterman said, according to the outlet. “And I think it’s pretty reasonable that if the president would like to have a conversation — or invite someone to have a conversation — to have it. And no one is my gatekeeper,” he added. Fetterman is the first known sitting Democratic U.S. senator to meet with Trump. However, a transition official cautioned that plans could change and that the Fetterman meeting has not been finalized. Fetterman was the first Democrat to sponsor the Laken Riley Act, which would compel the federal government to detain noncitizens convicted or charged with burglary, larceny, theft or shoplifting. A version of the legislation passed the House and is now before the Senate for consideration. “We absolutely need to have a secure border, and I have always also been incredibly supportive and protective for Dreamers,” Fetterman told the Washington Examiner on Tuesday. Trump also hopes Fetterman will support some of his nominees, including Pete Hegseth for defense secretary, a source said. He was one of the first Democrats in the Senate to meet with Pete Hegseth, Trump’s pick to lead the Department of Defense, and he’s expressed willingness to back some of Trump’s other Cabinet nominees. He also broke away from the progressive wing of his party last year by becoming an outspoken advocate for Israel, at one point traveling there to meet with Prime Minister Benjamin Netanyahu. As Senate Majority Leader John Thune has made clear he won’t back changes to the Senate rules requiring 60 votes to pass most legislation, Trump will need Democratic allies in the Senate. This could mark an early effort by Trump to court Fetterman.

The incoming president has also sought an emergency reprieve from the U.S. Supreme Court, claiming on Wednesday in a filing that evidence shown at trial violated his constitutional rights to presidential immunity. Justice Sonia Sotomayor, who oversees requests for emergency relief arising from the 2nd Circuit, ordered Manhattan prosecutors to respond by Thursday morning. New York prosecutors have told multiple judges this week that they don't believe sentencing should be delayed. The chief clerk of the New York Court of Appeals notified an attorney for Trump in a brief letter on Thursday morning that his request to halt the sentencing for Trump’s criminal conviction was reviewed by Judge Jenny Rivera, who declined to block it. No explanation for the decision was offered. Last May, a New York jury found Trump guilty of 34 felony counts of falsifying business documents. The announcement from the New York court came minutes before Manhattan District Attorney Alvin Bragg’s office told the Supreme Court in response to Trump’s effort that “there is no basis” for the court to intervene, saying it lacks jurisdiction.
