The Supreme Court on Tuesday began hearing Starbucks’ challenge to the federal labor agency that forced the coffee giant to rehire seven workers who tried to unionize. In the summer of 2022‚ Starbucks fired seven baristas who were organizing a union at their Memphis location‚ arguing the workers violated company policy by having a television news crew come to the store after hours. However‚ the National Labor Relations Board obtained a court order to reinstate the terminated baristas‚ agreeing with the workers that they were fired over their union activities. An appeals court later upheld that decision. Starbucks argues that federal courts should have stricter standards for reinstating fired employees. Currently‚ a court may grant an injunction against a company if it is deemed “just and proper.” During the first day of arguments‚ some of the justices appeared to agree with Starbucks. Justice Neil Gorsuch pointed out that other federal agencies are subject to a stricter standard. “In all sorts of alphabet soup agencies‚ we don’t do this. District courts apply the ‘likelihood of success’ test as we normally conceive it. So why is this particular statutory regime different than so many others&;#63;” Gorsuch asked. Starbucks has a notoriously fraught relationship with its union‚ Starbucks Workers United‚ but tensions have recently cooled somewhat. Starbucks and union representatives announced in February that they would resume talks. They were set to meet on Wednesday for a bargaining session‚ the first in close to a year‚ with the goal of getting a contract by the end of 2024. Nevertheless‚ Starbucks has decided to plow ahead with its case before the high court to the dismay of union officials. “The day [Starbucks] committed to a new path should’ve been the day that they pulled back the case before SCOTUS‚” Lynne Fox‚ president of Workers United‚ the parent union of Starbucks’ union‚ told The Washington Post. Some said they had lost their health insurance or had their electricity cut because they could not pay their bills. If the court decides in favor of Starbucks‚ the decision could discourage union activity at other companies. Union activity has surged across the country this year. Amazon‚ SpaceX‚ and Trader Joe’s have also recently challenged the National Labor Relations Board. SpaceX filed a federal lawsuit in Texas earlier this year against the agency after the labor board accused the company of illegally firing eight employees for criticizing Elon Musk‚ the company’s founder.

Several of the illegal immigrants Florida Republican Governor Ron DeSantis flew to Martha’s Vineyard in 2022 have since been approved for U-visas — based on claims that they were the victims of a crime. According to a report published Monday by The Boston Globe‚ three of the 49 illegal immigrants who were transported from San Antonio‚ Texas‚ to Florida and then to Martha’s Vineyard have been granted what’s called a “bona fide determination” – meaning that they qualify for a U-visa but have not yet received it. U-visas are typically “set aside for victims of certain crimes who have suffered mental or physical abuse and are helpful to law enforcement or government officials in the investigation or prosecution of criminal activity‚” according to U.S. Citizenship and Immigration Services. And in this particular case‚ they cooperated with a Bexar County Sheriff’s investigation into whether any of them had been lured or coerced into getting on the flights. The investigation lasted about one month‚ and Sheriff Javier Salazar concluded that the illegal immigrants involved had been “lured … under false pretenses” to board the planes and then said they were “unceremoniously stranded” upon their arrival in Martha’s Vineyard. DeSantis has repeatedly denied any coercion‚ saying that all migrants boarded the flights “voluntarily.” CLICK HERE TO GET THE DAILYWIRE+ APP Official U-visas could take up to ten years to approve because Congress only allows 10‚000 to be issued annually — but the “bona fide determinations” protect recipients from deportation until their visas arrive and allow them to legally work in the United States during that time as well. U-visas also put recipients on a path to obtaining green cards. Hemanth C. Gundavaram‚ co-founder and director of the Immigrant Justice Clinic at Northeastern University School of Law‚ explained to The Globe that the goal was to help correct for “a failure in our system‚” noting that in order to qualify for U-visas‚ the illegal immigrants must first be shown to be the victims of crimes and then had to assist law enforcement or the government in any investigation that followed. “This is a harm reduction provision. If you didn’t have these protections‚ someone would have to stay here‚ worry about deportation‚ and not be able to make a living‚” he said.

Nine couples are suing Ovation Fertility in Newport Beach‚ California‚ alleging the in vitro fertilization (IVF) provider knowingly implanted deceased embryos into patients to cover up a lab mistake. There are at least two joint lawsuits pending against the provider‚ according to People. The filings allege that a lab embryologist wrongly injected the embryos with hydrogen peroxide or a different toxic substance instead of a sterile solution while they were in an incubator‚ which caused the embryos to be “killed instantly.”  The lawsuits further alleges that Ovation employees were aware that the embryos were deceased when they were implanted but chose to have “these dead embryos [implanted] into the would-be mothers.”  Specific charges against the facility include negligent misrepresentation‚ fraud‚ negligence‚ and medical battery‚ per ABC News. While most plaintiffs chose to remain anonymous‚ one couple spoke with People about their experience at the clinic and why they chose to pursue legal action. Brooke Berger and her husband Bennett Hardy began pursuing IVF treatments two years ago. They expressed distress at finding out the procedure they went through at Ovation had no chance of success. “It’s been very difficult and has taken such a toll‚” Berger told the outlet. “There was no chance at all. We found out that we went through all of this for nothing. It was really heartbreaking.” Their attorney Robert H. Marcereau said‚ “The story that came up more often and more consistently — at least three or four times with our clients — getting it secondhand from their doctors‚ was this notion that somehow hydrogen peroxide had been accidentally introduced into the incubator while the embryos were there‚ which hydrogen peroxide‚ it’s basically like battery acid to those embryos.” CLICK HERE TO GET THE DAILYWIRE+ APP “It’s a very caustic substance‚ particularly if it’s a higher percentage strength. And it was lethal to them. That’s why there was a 100% mortality rate for these embryos during this period. But Ovation has never come out and said exactly what happened‚” the attorney continued. “They don’t have qualified personnel and protocols to ensure things like this don’t happen.” The couple further alleges that the IVF provider attempted to refund the cost of the procedure to avoid litigation. A spokesperson for Ovation gave a statement to People via email.  “Ovation Fertility has protocols in place to protect the health and integrity of every embryo under our care. This was an isolated incident related to an unintended laboratory technician error that impacted a very small number of patients‚” the spokesperson wrote.  “As soon as we recognized that pregnancy numbers were lower than our usually high success rates‚ we immediately initiated an investigation. We have been in close contact with these few impacted patients since the issue was discovered. We are grateful for the opportunity to help patients build a family and will continue to implement and enforce rigorous protocols to safeguard that process.” The pending lawsuits are seeking jury trials and unspecified compensation. “We can’t speak to whether or not there may be some criminal action‚” Marcereau went on. “We haven’t gotten to the bottom of what happened with the embryos. But it can certainly be criminal. We have a lot of questions and no answers yet. That’s what this litigation is going to be about. We want answers for these grieving couples and ensure nothing like this ever happens again.”

More than half of the Republicans in the U.S. Senate reached out to a pair of top officials in the Biden administration on Tuesday demanding “immediate action” to protect Jewish students on college campuses. The group of 27 GOP lawmakers‚ led by Sen. Tom Cotton (R-AR)‚ sent a letter to Attorney General Merrick Garland and Education Secretary Miguel Cardona as pro-Palestinian protests at Columbia University‚ Yale‚ and others have led to reports of harassment and acts of anti-Semitism. “You need to take action to restore order and protect Jewish students on our college campuses‚” the letter said. “President Biden issued a statement on Sunday‚ purporting to condemn the outbreak of anti-Semitism. If that statement was serious‚ it must be accompanied by immediate action from your departments.” The GOP senators requested that Cardona and Garland provide their offices “an update” on relevant efforts to enforce federal laws by 5 p.m. on Wednesday. They provided a non-exclusive list of examples. “Rioting violates federal law‚” the lawmakers said. “Violence or attempted violence against anyone because of their Jewish heritage violates federal law. School administrators’ failure to protect Jewish students from discrimination or harassment violates federal law and is grounds for those schools losing access to federal funds.
