President Joe Biden’s administration has set another record. A total of 14‚509 illegal aliens were encountered at the southern border Monday by U.S. Customs and Border Protection‚ the Washington Examiner reported‚ a record for total daily encounters. In response to questions Tuesday about the border‚ White House press secretary Karine Jean-Pierre said that she and the president “take offense” to the idea that they aren’t serious about border enforcement. The White House should feel nothing but shame over its obvious unwillingness to do what must be done to enforce immigration laws and secure the border. At this point‚ it seems intentional. For years‚ Homeland Security Secretary Alejandro Mayorkas has been saying that the border is “secure‚” despite record after record numbers of illegal aliens or illegal crossings being broken and broken again.  We are apparently supposed to just take the Biden administration’s word for it and shut up. The record set Monday is just the latest reminder of the administration’s complete abandonment of duty. From the moment Biden arrived in office in January 2021‚ this has been an unacceptable problem. Biden and Vice President Kamala Harris said they would fix border security by fixing the root cause of illegal immigration‚ which they insist stems from economic problems in Central and South America.  How is that working out? Biden‚ Harris‚ and Mayorkas haven’t solved anything‚ and the problem is getting worse here at home. The only thing they seem eager to do is squabble with Texas Gov. Greg Abbott‚ a Republican‚ about his attempts to seal the border while attacking the previous administration. On the campaign trail‚ Biden routinely slammed then-President Donald Trump for his immigration policies‚ which led to record lows of illegal border crossings. Biden is still doing so‚ despite the obvious signs that his administration’s policies have failed the American people. The failure is so acute that some Democrat governors and mayors increasingly grouse about the mess they’re being left with. Chicago Mayor Brandon Johnson laughably blamed the Texas governor for the number of illegal immigrants showing up in his city. New York declared itself a “sanctuary city” long ago‚ and now it’s suffering the additional‚ well-deserved consequences. Now that city schools and services are being overrun‚ New York’s Democrat mayor is being put in an uncomfortable position by angry constituents. And he should be. Illegal immigrants from all over the world know that if they come to the United States‚ they may get detained by authorities but they also have an excellent chance to remain in this country regardless. The Biden administration has made sure of that. U.S. Customs and Border Protection not only has been overwhelmed by the impossible task it has been given‚ its agents also have been maligned by the administration just for doing their jobs. Unfortunately‚ it doesn’t appear that any kind of crisis on the border will provoke Biden and company into adopting policies that actually slow down illegal immigration. They will continue insisting that their hands are tied unless Congress passes an amnesty bill and that this is not their fault. The Constitution created three branches in the federal government: the legislature to make the laws‚ the executive branch to enforce the laws‚ and the judiciary to settle disputes about the laws. Yet the federal government we know and very much do not love doesn’t operate the way the Constitution says it should. Instead‚ unelected bureaucrats write more rules than Congress does‚ the president cannot fire bureaucrats who oppose his efforts to keep his promises to the people‚ and the Supreme Court has unilaterally rewritten the Constitution on issues like abortion‚ same-sex marriage‚ and gender ideology. Conservatives have launched many efforts to restore the federal government to the way the Constitution says it should work‚ but the Left has increasingly demonized those efforts as backward‚ racist‚ or—more recently—a form of authoritarianism. In The New York Times‚ Maggie Haberman wrote: “Why a Second Trump Presidency May Be More Radical Than His First.” Among other things‚ Haberman warned that former President Donald Trump‚ were he to win the presidential election next year‚ “would seek to expand presidential power in myriad ways—concentrating greater authority over the executive branch in the White House‚ ending the independence of agencies Congress set up to operate outside of presidential control and reducing civil service protections to make it easier to fire and replace tens of thousands of government workers.” Haberman seems not to remember how Trump’s administration fought against him in unjustified ways‚ operating as a “deep state” to prevent him from fulfilling his campaign promises. Preventing the executive branch from operating in this way is not a form of authoritarianism but an effort to bring bureaucrats back under the control of the voters’ elected representative. Trump’s Agenda 47 and Project 2025‚ a conservative movement project led by The Heritage Foundation‚ aim to empower a conservative president to fire executive branch workers who would oppose the president’s goals. Another key conservative reform‚ the Regulations from the Executive in Need of Scrutiny Act‚ or REINS Act‚ would require Congress to pass regulations that would significantly impact the U.S. economy. President Joe Biden’s White House pledged to veto the REINS Act if Congress were to pass it. The Office of Management and Budget said the act “would undermine agencies’ efforts by inserting into the regulatory process an unwieldy‚ unnecessary‚ and time-consuming hurdle that would prevent implementation of critical safeguards that protect public safety‚ grow our economy‚ and advance the public interest.” While the Left frames these conservative reforms as “authoritarian‚” Biden tried to cancel up to $20‚000 in student debt for certain borrowers‚ with the stroke of his pen. The Education Department estimated that this would cost $305 billion in the next 10 years. Had the Supreme Court not ruled the plan unconstitutional‚ the student loan bailout would have inflated college costs‚ hindered economic growth‚ rewarded increasingly woke universities‚ and benefitted upper-income earners at the expense of those who didn’t go to college or who paid off their loans. Biden has made similarly unilateral moves to push his transgender orthodoxy and his climate alarmist agenda. Ironically‚ the president faces his own kind of “deep state‚” bureaucrats who are opposing his pro-Israel rhetoric. Meanwhile‚ the Left has orchestrated a campaign to delegitimize the Supreme Court‚ with outfits like ProPublica targeting justices such as Clarence Thomas. The Left has attacked Thomas in part because the court’s majority now supports originalism‚ the view that the Supreme Court should uphold the original public meaning of the Constitution‚ as opposed to reinterpreting the text to achieve the Left’s goals. Originalism grew as a reaction to the court’s decisions in cases such as Roe v. Wade (1973) and Obergefell v. Hodges (2015)‚ which twisted passages in the Constitution out of recognition to create new rights that the Founders and those who later amended the Constitution at the time of the 14th Amendment would have opposed. Sen. Ed Markey‚ D-Mass.‚ unwittingly revealed why the Left opposes originalism. He tweeted in 2020‚ “Originalism is racist. Originalism is sexist. Originalism is homophobic. Originalism is just a fancy word for discrimination.” Markey’s problem isn’t Originalism—it’s that he isn’t willing to get his efforts opposing “racism‚” “sexism‚” “homophobia‚” and “discrimination” through Congress‚ the body that makes law‚ according to the Constitution. He’d rather have the Supreme Court dictate his preferred agenda‚ and he opposes the good-government reforms that make it harder for nine unelected judges to create new laws. Originalism is racist. The Biden administration announced Monday that it is spending more than $500 million to help state and local governments adopt green building codes‚ a strategy that amounts to a backdoor attempt to phase out gas stoves and other fossil fuel-powered appliances‚ energy experts told the Daily Caller News Foundation. The Department of Energy announced that it is spending up to $530 million to help states and cities adopt and implement new building codes that are aligned with “zero energy codes‚” which are defined as “a building energy policy requiring buildings to demonstrate net zero energy use based on measured building performance outcome‚” according to the New Buildings Institute. The administration touts the initiative as a way to counter climate change while also delivering savings to consumers via energy-efficient appliances‚ but the funding will actually facilitate an effort to phase out more affordable fossil fuel-powered appliances that has proven toxic at the federal level so far‚ energy experts told the Daily Caller News Foundation. “A big reason for federal meddling in state and local building codes is to pursue an agenda that puts climate change activism above the best interests of homeowners‚” Ben Lieberman‚ a senior fellow specializing in environmental policy for the Competitive Enterprise Institute‚ told the Daily Caller News Foundation. “A big part of this is the effort to use building codes to push people away from abundant and affordable natural gas in favor of electrifying everything.” The administration has made considerable efforts to nudge Americans toward adopting more efficient—and often electric—appliances in their homes over the coming years‚ proposing or finalizing two dozen new regulations to that end‚ according to the DOE. At the same time‚ the administration is also engaging in a broad effort to help subnational governments advance policies that “decarbonize” buildings‚ which centers on reducing the use of fossil fuels‚ primarily natural gas‚ to power crucial appliances like water heaters and furnaces. The DOE announced in September that it will spend $225 million to help state and local governments adopt building codes that are in line with its electrification push. New buildings built under “decarbonized” code would not have natural gas hookup lines‚ which would thereby effectively mandate electric stoves and other electric appliances‚ according to The Washington Post. The Consumer Product Safety Commission reportedly considered proposing a ban on gas stoves early in 2023 after a dubious study published by conflicted authors linked childhood asthma to the appliances‚ with CPSC Commissioner Richard Trumka Jr. saying in January that “any option is on the table” when it comes to regulating and banning “products that can’t be made safe‚” according to Bloomberg News. Those comments on a prospective gas stove ban sparked considerable backlash‚ but the administration proposed an “energy conservation” regulation for stoves in February anyway. The DOE now states that it is a “myth” that “the federal government wants to ban gas stoves.” The administration has not stopped proposing energy-efficiency standards that would effectively force cheaper fossil fuel-powered appliances off the market. In its announcements of new proposals‚ the administration consistently touts the energy-efficient appliances it promotes as a source of savings for consumers‚ even though most of these appliances have higher up-front costs than their less efficient counterparts. “This is an example where the administration is not only wasting taxpayer money with a national debt of $33 trillion‚ but is also subjecting residents to ongoing costs that are not covered by their initial grants‚” Diana Furchtgott-Roth‚ the director of The Heritage Foundation’s Center for Energy‚ Climate‚ and Environment‚ told the Daily Caller News Foundation. (The Daily Signal is The Heritage Foundation’s news outlet.) “It’s $530 million of wasted money—it is not going to reduce emissions‚ but it will increase the deficit‚” Furchtgott-Roth continued‚ adding that the new spending will “pressure governments of states and cities into forcing consumers to do things they do not want to do and buy products that they do not want to buy.” Americans “should always be suspicious when governments talk about ‘investing.’ It’s not an investment‚ it’s an expenditure that adds to the deficit‚” she concluded. Advocates of sweeping government action on climate change often point to buildings as a major source of emissions. The use of fossil fuels attributable to residential and commercial buildings accounts for nearly 30% of American emissions‚ according to the Center for Climate and Energy Solutions. “Just the way [President Joe] Biden’s disastrous border policy is felt most acutely at the state and local levels‚ Biden’s green policies will not be the burden of the federal government which has no electric grid responsibility‚” Daniel Turner‚ the founder and executive director of Power The Future‚ told the Daily Caller News Foundation. “If these policies were so beneficial‚ if these electric appliances were such a preferred alternative to gas powered ones‚ the Biden administration would not need to use the power of government to force them upon us. If they can get local governments to do their bidding for them‚ then everyone is equally guilty for plunging the nation into energy poverty.” Neither the DOE nor the White House responded immediately to requests for comment. FIRST ON THE DAILY SIGNAL—A government and corporate watchdog group filed a complaint Tuesday with the Securities and Exchange Commission against Berkshire Hathaway in connection with the arrest of the group’s chairman at a shareholder meeting for raising issues linking the names of Warren Buffett‚ Bill Gates‚ and Jeffrey Epstein. National Legal and Policy Center Chairman Peter Flaherty spoke at a shareholder meeting in May in support of a resolution requiring Berkshire Hathaway to have two different people hold the jobs of CEO and chairman of the board. Buffett currently holds both positions.  When Flaherty brought up Buffett’s financial support of the Bill and Melinda Gates Foundation‚ he noted that Gates‚ the billionaire founder of Microsoft‚ had traveled with Epstein‚ a convicted sex offender.  At that point‚ Buffett called for Flaherty’s ouster from the meeting‚ and Flaherty was arrested and charged with criminal trespass by police in Omaha‚ Nebraska‚ even though his name was on the list of attendees for the Berkshire Hathaway shareholder meeting.  Berkshire Hathaway‚ a multinational conglomerate holding company‚ is based in Omaha. Police detained Flaherty for about three hours. He waited‚ not in a cell‚ but on a bench with others who had been arrested. He paid a bond of $2‚500 to be released. Nebraska prosecutors dropped the charges shortly after the arrest.  “The almost instantaneous silencing of Mr. Flaherty at the very mention of Epstein obviously struck a nerve with the public that transcends political ideology‚ underscoring the widely held belief that the rich and powerful play by a different set of rules than ordinary citizens‚” says the SEC complaint filed by NLPC counsel Paul Kamenar.  “At the same time‚ however‚ Mr. Flaherty suffered great humiliation for publicly being manhandled‚ hauled out of the arena before thousands of Berkshire shareholders and arrested‚” the complaint continued. “His right to fully present his views to the shareholders who still had an opportunity to vote for the [National Legal and Policy Center’s] proposal and their right to hear his presentation were improperly curtailed by Berkshire‚ Mr. Buffett and his agents.” Flaherty said he has been involved in shareholder activism for 19 years‚ and had never before been arrested or had his microphone cut off when making a proposal.  The SEC has the jurisdiction to enforce its rules to prevent publicly traded companies from silencing shareholders‚ Flaherty said.  “The point of the complaint is to ask for relief from the SEC‚” Flaherty told The Daily Signal in a phone interview Tuesday. “We are asking for Berkshire Hathaway to cease and desist from doing this in future shareholder meetings‚ to acknowledge their actions constitute a violation of the rules‚ and order that my full remarks be posted on the website.” A Berkshire Hathaway spokesperson did not immediately respond to phone and email inquiries on Tuesday.  SEC-NLPC-BerkshireDownload Epstein is a convicted sex offender whose 2019 death in a New York jail while awaiting trial on sex-trafficking charges was ruled a suicide. He had close ties to elites in politics‚ business‚ and entertainment.  Buffett‚ the billionaire chairman and CEO of Berkshire Hathaway Inc.‚ is well-known for taking political stances on the Left‚ including for higher taxes on the nation’s top earners.  The National Legal and Policy Center was the sponsor of Proposal No. 8 at the May shareholder meeting. The proposal would have “[required] hereafter that two separate people hold the office of the chairman and the office of the CEO.”  At the meeting‚ Flaherty said that under the proposed change‚ Berkshire “would be less identified with Mr. Buffett’s personal political activities” and pointed to Buffett’s support for the Bill and Melinda Gates Foundation‚ among other factors.  Under the meeting rules‚ shareholders have three minutes to speak for or against a resolution. Gates’ reported association with Epstein has been a subject of controversy.   During the May meeting‚ a Berkshire Hathaway employee interrupted Flaherty shortly after about a minute into his remarks. Then‚ someone cut off his microphone after Flaherty said‚ “We know how much Bill Gates cares about children.
