Animal rescue workers in Queens, NY made a shocking discovery this week. After being notified that an apartment owner had been evicted and needed to surrender his dogs, the workers showed up at the property to take them in. However, instead of just two or three dogs living there, animal rescue found 48! And, they weren’t small dogs either; they were all Belgian Malinois, a large and very intelligent breed of dog. The poor animals were completely stuffed into the filthy apartment with little room to move and zero access to fresh air or sunlight. Some were discovered hidden in cabinets or crammed behind furniture. Sadly, three of the dogs had to be euthanized. The rest have been moved to an animal shelter for rehabilitation due to their severe lack of socialization. No walks. No sunlight. No human contact. Just years of total confinement in filth and silence. These aren’t small lap dogs — Belgian Malinois are elite working dogs used by the military and police. Highly intelligent. Built for speed, strength, and stimulation. Instead, they spent their lives trapped in the dark, side by side, terrified of the world they’d never seen. Rescue teams from ACC and the ASPCA spent 2 days pulling them out. The apartment’s resident had just been evicted, triggering the discovery. A criminal investigation is now underway. The dogs aren’t adoptable yet — they’re severely undersocialized and need long-term rehab. But the crisis is bigger: NYC shelters are already triple capacity, with over 340 large dogs waiting for homes. At this time, we do not know the identity of who did this to these poor, abused dogs. Police are currently investigating. I have to ask, though: how was this not discovered far earlier? You’d think someone would have noticed nearly 50 dogs crammed into a tiny apartment. There’s no way those dogs were quiet all the time, was there? Apparently, some neighbors did notice the smell and suspected that the man living in the apartment was abusing his pets. The New York Post has more details: “These dogs have reportedly lived in total confinement for their entire lives,” said Tara Mercado, ACC’s director of behavior and shelter operations. “We found full-grown Malinois hidden in cabinets and crammed behind furniture.” A criminal investigation has been opened, the source said. The owner hasn’t been publicly identified. The dogs lived in an apartment on the 7th floor, according to neighbors, who said the entire floor reeked and the pet owner frequently tossed feces off his balcony. “He worked at the airport security, and the dog was his [bomb] sniffing dog, that’s why he was allowed to be here with the dog,” one neighbor said, adding the man sometimes walked a second dog of another breed. “We always wondered, ‘Why does it smell so bad, if it was that dog that just peed all around?’” the man, who declined to provide his name, said. “We all assumed there were two or three dogs in there, we would never have imagined that they were that many, we never saw them ever, anywhere.” He wondered how the dogs survived in the squalid conditions. “It seems like a hell hole,” he said. “They never saw the light of day, because we would know if they were walked.” Neighbor Natalia Ruales was relieved the dogs were rescued. “I think he had abused [the dogs] and I don’t like it,” she said. “Because there’s a lot of doggies in one apartment … no good.” Another neighbor, who identified herself as Sharon, said the floor always smelled bad. “It always smells like that here and I always hear them barking, barking, and he throws poop out of his balcony,” she said. “As far as I know, as we all know, he neglects his dogs. … If he takes them out in the elevator, it smells so bad, they pee on the staircase.” Hopefully, all of these animals can find good homes with loving owners in time. As for their previous owner, let’s pray that he faces the fullest extent of the law for his extremely cruel and neglectful treatment of puppies. This is so sickening. I can’t even comprehend the mentality it would take to do something like this to these poor dogs. The Judicial Appointment Train Is Leaving the Station

President Donald Trump has announced his intention to nominate Whitney Hermandorfer to the U.S. Court of Appeals for the 6th Circuit. She will be Trump’s first judicial nomination of his second term and will replace Judge Jane Branstetter Stranch, appointed in September 2010 by President Barack Obama. Congress can use its legislative authority under Article I of the Constitution to create “Tribunals inferior to the supreme Court.” These include the U.S. Tax Court, U.S. Court of Appeals for the Armed Forces, and U.S. Court of Federal Claims. Judges on these courts serve for specific terms. In Article III, the Constitution itself created the Supreme Court and gave Congress authority to establish “inferior Courts.” These are the U.S. District Court, U.S. Court of Appeals, and U.S. Court of International Trade. Together, these Article III courts exercise the “judicial Power of the United States.” Article III judges serve during “good Behaviour,” or until they are removed by impeachment. The Heritage Foundation’s Judicial Appointment Tracker follows the appointment process for Article III judges under Trump and under the previous seven presidents. The judicial appointment situation is different from when Trump first took office, in 2017. Republicans had controlled the Senate during Obama’s last two years in office and confirmed 22 judges in two years, less than one-fourth the average. Those 22 judges constituted just 2.6% of the judiciary, the lowest percentage appointed in a two-year Congress since 1789. As a result, 106 positions on federal district and appeals courts were vacant when Trump took office and began making nominations in March 2017. The opposite scenario exists today. Democrats controlled the Senate during President Joe Biden’s last two years and confirmed 139 judges, the third-highest total in American history. As a result, just 5.3% of the judiciary is currently vacant, the lowest percentage during a new presidency in more than 40 years. Since 1980, an average of 45 judicial positions become vacant each year, three-fourths of which resulted from the incumbents’ taking “senior status,” remaining a federal judge with a reduced caseload but vacating his or her seat for a new appointment. If that pattern continues for the next four years, and Trump appoints the average number of judges (as measured by the past several presidencies), he will have appointed more than 400 judges during his two terms, more than any president in history. If Hermandorfer’s nomination is any indication, Trump will take the same approach, and use the same priorities and criteria, to judicial appointments as he did in his first term. She received her law degree from George Washington University Law School, where she was editor in chief of the law review, and has clerked for judges at all three levels of the federal judiciary: Richard Leon on the U.S. District Court for the District of Columbia; Brett Kavanaugh on the U.S. Court of Appeals for the D.C. Circuit and the Supreme Court; and Supreme Court Justices Samuel Alito and Amy Coney Barrett. During her stint in private practice at Williams & Connelly, the Legal 500 named her a “rising star” in the appellate category. She is now the director of the Strategic Litigation Unit in the Office of the Tennessee Attorney General. As expected, liberal groups immediately attacked Hermandorfer’s nomination as “appalling” and as a signal of a “dangerous direction for the judiciary.” As they no doubt will regarding each of Trump’s judicial nominations, they claim that the president “seeks to stack the judiciary with those who will do his bidding.” These are the same groups that urged incoming President Biden to appoint judges who would further his political agenda and supported “packing” the Supreme Court with justices who would do the same. Expect more of this mantra, with the name of the current nominee cut and pasted, in the months ahead. The ‘N’ in SNAP Means Nutrition

SNAP, or the Supplemental Nutrition Assistance Program, also known as food stamps, is one of the nation’s largest welfare programs. And, like all welfare programs, it is massive, it has grown prodigiously over the years and it is inefficient. One glaring issue, which is gaining attention as a result of new Health and Human Services Secretary Robert F. Kennedy Jr.’s Make America Healthy Again campaign, is the kinds of foods that recipients of SNAP funds can purchase. And here we have convergence of bodily health and fiscal health. The “N” in SNAP stands for nutrition. The point of the whole program is to help poor Americans eat and not forgo nutrition as result of insufficient funds to buy food. So why should government funds be used to purchase foods that are not fundamental to meeting the requirements of basic nutrition? The program is funded by the federal government but administered by the states. Now three Republican governors—governors of Arkansas, Idaho, and Indiana—are joining the governor of West Virginia in seeking waivers from the federal government to permit them to remove soda, candy, and other sweets from the foods that can be purchased with SNAP funds. SNAP funds flow from the Department of Agriculture, and new Agriculture Secretary Brooke Rollins showed her support for this move by appearing alongside Arkansas Gov. Sarah Huckabee Sanders when she announced that her state would seek a waiver to eliminate soda and candy. According to the Foundation for Government Accountability, “Soda is the number one commodity purchased with food stamps. More food stamp money is spent on soda, candy, snacks, ice cream, and cakes than on fruit, vegetables, eggs, pasta, beans, and rice. Purchases of sweetened beverages, desserts, salty snacks, and candy exceed the program’s combined sales of fruits and vegetables by $9.4 billion a year.” The foundation goes on to point out that the incidence of obesity is higher among food stamp recipients than among those not on food stamps at similar income levels and that food stamp participants are “more likely to be at very high or extremely high risk” of the many health problems that result from obesity. Per the Federal Reserve Bank of St. Louis, in 1975, federal funding to the SNAP program was $4.6 billion. By 2000, it was $14.6 billion. In 2023, it was up to $111.2 billion. Per Pew Research, in 1974, there were 12.9 million Americans receiving SNAP funds. In 2023, it was up to 42.4 million. Most recipients are adults—63% are over the age of 18—and of adults receiving food stamps, 62% had not been employed at all during the year, 24% were employed over the year and 14% were employed part of the year. Among children receiving food stamp payments, 56% were in homes with one or no parent. Much discussion about reform of SNAP involves a more rigorous application of work requirements to receive funding. This points back to the importance of health. If SNAP funds permit purchase of foods that are unhealthy, or damage health, so it seems SNAP funds contribute to undermining the ability of recipients to work. Needless to say, as this initiative gains momentum, as it should, and as more states seek waivers to streamline their SNAP funding to foods that clearly aim to fundamental nutritional needs, the beverage and candy industry can be expected to be all over Congress to block the change. The Wall Street Journal reported last December about ramped up lobbying by Coke, Pepsi and the American Beverage Association to leave their soft drinks in the purview of SNAP funding. Some concerns have been expressed by grocers that increased specificity regarding what can be purchased can make administration and monitoring difficult. But surely technology can deal with this. Removing non-nutritious foods and beverages from SNAP won’t balance our federal budget. But it is a no-brainer for our fiscal and physical health.
