Journalist Says First Amendment In Jeopardy As He Faces Punishment Over Reporting On Covenant Shooter

A Tennessee news executive says his First Amendment and due process rights are in jeopardy as he faces punishment over his publication of articles on the writings of the transgender-identifying shooter who killed six people at the Christian Covenant School in Nashville in March 2023.  Tennessee Star Editor-in-Chief Michael Patrick Leahy was ordered to show up in Davidson County court on Monday for a contempt hearing after his outlet published multiple articles quoting from the writings of the woman who killed three children and three adults at The Covenant School on March 27, 2023. The articles quoted from the writings of the shooter, disclosing that it had obtained images of the full journal that was recovered by police at the scene of the shooting.  In her order, Judge I’Ashea Myles said that Leahy must demonstrate why the “publication of certain purported documents” does not “violate the Orders of this Court subjecting them to contempt proceedings and sanctions.” On Wednesday, Leahy’s legal team filed an emergency appeal in response arguing that Myles’ order endangers freedom of the press and violates his right to due process. The appeal, which has since been denied, argued that the hearing should be set aside because it violates Tennessee laws protecting reporters and rules on contempt proceedings.  “Tennessee has enacted a robust media ‘shield law’ that protects reporters from being compelled to reveal any information—or the source of any information—procured for publication or broadcast,” the court filing says. “Such compulsion would also seriously undermine freedom of the press and news gathering generally.” The Tennessee Star has not disclosed the details of how it obtained the documents, which is standard practice in the journalism profession. On Friday, Axios reported that a retired Nashville police lieutenant has been singled out regarding the leak of records regarding the shooting investigation. Those records have been kept hidden from the public for more than a year. The lieutenant, Garet Davidson, has filed a whistleblower complaint regarding mismanagement at the department, and has appeared on Leahy’s Tennessee Star show in recent weeks. Myles did not specify in her order what specific court orders she was referring to that might lead to Leahy and Star Digital Media being held in contempt.  “By failing to identify the previous orders — or the provisions within them —  that this Court believes Mr. Leahy may have violated, though, this  Court’s Show Cause Order does not afford Mr. Leahy meaningful notice of the concerns that he is being ordered to address,” Leahy’s legal filing says.  If Myles’ order did restrict Leahy “from publishing lawfully obtained documents to his readership,” that order is constitutionally suspect, the filing says.  “None of this Court’s earlier orders appears — at least to the undersigned — to contemplate such a drastic restriction,” the filing says. “If this Court  interprets one of its earlier orders that way, though, then the order is a  prior restraint that suffers from serious constitutional infirmities and is  presumptively unconstitutional.” For well over a year, Nashville police have refused to release the writings of the shooter arguing that the investigation into the shooting is ongoing. In response, there are two ongoing lawsuits, one against the FBI and the other against the city, pushing for the release of all the shooter’s writings. On Wednesday, The Daily Wire published photos of the attacker’s journal obtained by a source familiar with the Covenant investigation. The entries show that she had a deep-seated hatred for Christianity and her parents for pushing back against her desire to identify as a male.

7 Sublime Summer Movie Classics Worth A Rewatch

Summer is meant to be experienced outdoors, but there’s a catch. Rainy days make that all but impossible. Plus, affordable HD projectors let us watch classic movies on our porches on cool summer nights. And some movies capture the season so well it’s darn near criminal to watch them in the fall or winter. So, in no particular order, consider revisiting the following seven films to soak in those summertime vibes. “Jaws” (1975) Universal History Archive/UIG via Getty images The film unofficially kicked off the summer blockbuster film season in 1975. It also perfectly captures the sounds, the sights, and the grit of beach sand between your toes. Director Steven Spielberg’s second feature nailed every detail about the season, from kids frolicking on the beach to parents wondering what they’ll do when Friday’s five-o-clock whistle whines. Oh, and there’s a killer shark stalking the beaches of Amity Island. Sun. Surf. Sand. Scares. There’s no better way to catch it all on screen than with “Jaws,” even if Bruce the robotic shark couldn’t stop malfunctioning on the film’s set. “The Way Way Back” (2013) Fox Searchlight Pictures. A Sycamore Pictures. Walsh Company. It’s the best summer movie you missed during its theatrical bow. The 2013 dramedy follows a sad-sack teen named Duncan (Liam James) forced to spend his summer with his Mum (Toni Collette) and her unctuous beau (Steve Carell, playing way against type). Things look grim until a local waterpark worker (Sam Rockwell, sublime) provides Duncan with the life lessons, and father figure presence, he craves. It’s witty and wise, brimming with sunblocked bodies and bittersweet memories of summers gone by. “Sweet Liberty” (1986) Universal Pictures. Alan Alda’s directorial career didn’t last long. His debut, 1981’s “The Four Seasons,” wowed fans but by the time he helmed 1990’s “Betsy’s Wedding” Hollywood lost interest in his wry directorial chops. So did audiences. In between, he gave us 1986’s “Sweet Liberty,” a winning comedy with a killer cast, including Alda, Bob Hoskins, Michael Caine, and Michelle Pfeiffer. Alda plays a professor whose book on the American Revolution is getting the Hollywood treatment. He’s invited to watch the film’s production but realizes the crew has little interest in telling the story he committed to the page. That’s being kind. The comedy, shot on sunny Long Island, is as breezy as an early June day. The chemistry between the key performers, plus a scene-stealing Lillian Gish as Alda’s elderly mum, make this summer sleeper worth a look. (Except you’ll have to pick up the 2021 Blu-ray edition since it hasn’t been available for streaming for some time). ”Vacation” (2015) Warner Bros. New Line Cinema. BenderSpink. David Dobkin Productions. Chevy Chase’s 1983 comedy epitomizes what can go wrong on a family vacation. Spoiler alert – everything. Chase and co. hit the road in that grotesque station wagon, finding trouble at every stop in their trek to Walley World. The laughs are constant, and so are the reminders of summer vacations of yore. Kids bickering in the back seat. Oppressive heat. Relatives you only see once a year, if that. And summer beauties who you spot on the highway and you can’t get out of your head. The 2015 sequel/update/reboot didn’t snag the pop culture attention of its predecessor, but it deserves a fresh evaluation. Why? Ed Helms may be the most underrated comic actor around. He’s a comic chameleon who channels Chase’s EveryDad frustrations to near perfection. The bad news? The film’s hard-R-rated antics and sexually charged sight gags clash with the original film’s more all-American tone. “Do the Right Thing” (1989) Universal. 40 Acres & A Mule Filmworks. A Spike Lee Joint. IMDB. Spike Lee knows there’s a dark side to summer. That relentless heat brings out the worst in us, especially when a city’s temperature refuses to leave the 90s. The director’s best film seizes on that truth, whether it’s Lee’s Mookie gliding an ice cube over his lover or the rage served up hot in Sal’s pizza joint. The film’s controversial ending is the culmination of all that heat, but it’s (still) impossible to look away as violence swarms the pizza shop. “Stand By Me” (1986) Columbia Pictures. Act III Production. Four pre-teens explore the world and learn some harsh life lessons in this poignant tale from horror maestro Stephen King. The lads boast potty mouths and bravado to burn, but it doesn’t take long to see the emotional bruises underneath the surface. Director Rob Reiner’s gentle touch makes this nostalgic story spring to life. He’s gifted a talented quartet of stars who nail what it means to be young and burdened by too much summer time on their hands. There’s danger afoot, but it’s the unspooling conversations on those dry summer afternoons that land best. “Grease” (1978) Paramount Pictures. “Summer lovin’ … had me a blast,” sings John Travolta in the ‘70s musical “Grease.” The film catapulted Travolta and Olivia Newton-John to superstardom, and it all starts with a summer fling. Can true love survive peer pressure, cooler temperatures and the mischievous Rizzo? The film’s cheery canvas, brightly-lit music numbers and beachside walks make it perfect viewing for this time of the year. A new study has raised alarms about the potential for widespread blackouts resulting from the Biden administration’s proposed Environmental Protection Agency (EPA) regulations. These rules, aimed at reducing carbon dioxide emissions from power plants, are predicted to destabilize the U.S. electric grid, according to a report by the Center of the American Experiment. Last August, four major electric grid operators warned that the new EPA regulations would undermine the reliability of the U.S. electric system. These operators highlighted the lack of a basic reliability analysis in the EPA's proposal, calling it a significant oversight​. The study found that during periods of low wind and solar output, the grid would face severe shortages, leading to extensive blackouts. The MISO grid serves 45 million people across several states, including Minnesota and Wisconsin​. One of the most concerning scenarios projected by the study involves a blackout affecting 20% of the grid, which could simultaneously plunge entire states into darkness during the harsh winter months. Such a situation mirrors the deadly Texas blackouts of 2021, where hundreds of people died due to the loss of power and heating​.The study also criticized the EPA's modeling for not including enough natural gas peaking plants to replace the retiring coal plants, which would be necessary to meet the growing demand for electricity. The heavy dependence on weather-dependent renewable energy sources without adequate backup could lead to frequent and prolonged outages​​. Complying with the EPA’s emissions reductions without causing blackouts would require significant investments in new infrastructure, including more wind turbines, solar panels, and battery storage. The study estimates that these costs would amount to $246 billion through 2055, translating to an average annual increase of $683 in electricity bills for a typical family of four​. The North American Electric Reliability Corp. (NERC) also echoed these concerns in its Winter Reliability Assessment, warning that more than half of the U.S. is at an elevated risk of blackouts this winter due to increased demand and insufficient power generation capacity. NERC identified the Biden administration’s energy policies as a key threat to grid reliability, citing the premature closures of coal and gas-fired power plants and delays in building new infrastructure​. While the EPA argues that the new regulations are essential for tackling climate change and protecting public health, critics contend that the plan’s reliance on unproven technologies and unrealistic timelines poses a significant risk to the nation’s power grid. The NERC emphasized that the current federal energy policies are reckless and endanger the reliability and affordability of electricity for all Americans. This debate underscores the broader conflict between advancing environmental goals and maintaining energy reliability, with significant implications for American consumers and the economy. As the administration pushes forward with its green agenda, the challenge will be to ensure that the lights stay on for millions of Americans.
