U.S. District Judge John Bates said in a written opinion it was likely that government was correct that DOGE was an agency, allowing it to detail its staff to other government departments. However, Bates called his finding a “close question,” noting that the government did not want DOGE to be considered an agency for purposes of another federal law, which would subject it to open records requests. Bates, who was appointed by Republican President George W. Bush, said DOGE was a “Goldilocks entity: not an agency when it is burdensome but an agency when it is convenient.” Bates asked the parties to propose a schedule for determining if he should issue a longer-term preliminary injunction blocking DOGE from the agencies. Now that the path is clear, I can’t wait to see what DOGE uncovers in the coming days and weeks… I hope this new trend of federal judges shutting down attempts to stop DOGE’s mandate to rid the federal government of waste and corruption continues. And…it looks like that might be the exact direction we’re headed in. The latter is clearly a lie and fake, but some reports also say the procurement is not going forward anyway. PBS reported today that, in fact, the Marco Rubio-led State Department has decided to NOT go forward with the procurement, so that would in fact by President Trump cancelling an order initially placed by Joe Biden for $400M worth of Tesla Cybertrucks: The State Department said Thursday it is abandoning plans of purchasing $400 million worth of armored Tesla vehicles after a public document detailing federal contracts for fiscal year 2025 gained wide attention. That expected purchase of Teslas, which was slated for September of this year, is now on hold, according to the State Department, which now says it has no plans of fulfilling the contract. The potential federal purchase drew scrutiny since Tesla Chief Executive Elon Musk is also a top White House official who has been leading the Department of Government Efficiency, a unit focused on shrinking the federal workforce and ferreting out corruption. The document did not specify what Tesla vehicles would be purchased by U.S. officials, but Musk's Cybertruck, with its militaristic design and stainless steel exterior, could have been an option. After reports circulated Wednesday night of the State Department's intent to purchase Tesla vehicles, NPR noticed that the document was edited, at 9:12 p.m., to say the federal contract is for $400 million worth of "armored electric vehicles," but the word "Tesla" was removed. Responding to a segment by MSNBC's Rachel Maddow about the $400 million contract, Musk wrote on X on Wednesday night: "Hey @Maddow, why the lie?" The Tesla contract started in the Biden administration "to explore interest from private companies to produce armored electric vehicles," a State Department spokesperson said on Thursday. Tesla was the only company to express interest in the department's request at the time. Typically the next step would be "an official solicitation" for vehicle manufacturers to compete for the contract. But now, the solicitation is on hold, according to the State Department spokesperson. Musk did not return a request for comment. Will Rachel Maddow correct the record? Will she report honestly? (Would need windows etc.) • Technology and UI integration would be next level. • They could function autonomously if needed.

The Trump administration has just cut over 400 employees from the Department of Homeland Security. Over half of the firings came from the Federal Emergency Management Agency (FEMA). The other half came from the Cybersecurity and Infrastructure Security Agency, U.S. Citizenship and Immigration Services, and the DHS Science and Technology Directorate. A dozen DEI Coast Guard members were also affected by the order. This massive DHS culling is meant to “eliminate egregious waste and incompetence that has been happening for decades at the expense of the American taxpayer,” according to a spokesperson from the agency. Officials at DHS said they had fired hundreds of employees across several of its agencies after supervisors identified “non-mission critical personnel in probationary status” within the nation’s top cybersecurity agency, known as CISA, the Federal Emergency Management Agency, and U.S. Citizenship and Immigration Services, which administers the nation’s legal immigration system, among others. “Under President Trump’s leadership, we are making sweeping cuts and reform across the federal government to eliminate egregious waste and incompetence that has been happening for decades at the expense of the American taxpayer,” DHS spokesperson Tricia McLaughlin said in a statement to CBS News. McLaughlin said the personnel cuts will result in roughly $50 million in savings, and be “incalculably valuable” to the administration’s efforts to cut red tape, adding that the department is “actively identifying other wasteful positions and offices that do not do not fulfill DHS’ mission.” In total, over 200 personnel have been fired from FEMA, the nation’s disaster relief agency. The eliminations follow DHS’ announcement earlier this week that four FEMA employees would be terminated over payments to reimburse New York City for hotel costs for migrants. The workers were accused of circumventing agency leadership to make the transactions, which have been part of a routine reimbursement program that offsets costs to care for a spike in migration along the southern border. The mass firings also include over 130 cuts within the Cybersecurity and Infrastructure Security Agency. Among the newest federal agencies, CISA was established during the first Trump administration in 2018 to spearhead a national effort to oversee cyber and physical risk to U.S. critical infrastructure. Among other duties, the top cyber agency partners with states and local jurisdictions to secure U.S. election infrastructure. ABC News added: The bulk of the cuts were at the Federal Emergency Management Agency, which saw over 200 people cut, and then the Cybersecurity and Infrastructure Security Agency, which saw 130 people cut. U.S. Citizenship and Immigration Services saw under 50 people cut, and DHS Science and Technology Directorate saw 10 people cut. Additionally, 12 Coast Guard members who work on diversity, equity and inclusion were affected by the reduction in force, with an offer to support border security efforts at the southwestern border. All of these people are based out of Washington, D.C., and are currently on administrative leave. “Under President Trump’s leadership, we are making sweeping cuts and reform across the federal government to eliminate egregious waste and incompetence that has been happening for decades at the expense of the American taxpayer,” a DHS spokesperson told ABC News.

New York City Mayor Eric Adams, who just recently had a corruption case against him ordered to be dropped by the DOJ, is now planning to sue the Trump administration. The lawsuit pertains to the Trump administration clawing back over $80M from New York City that was used to house illegal immigrants in luxury hotels. Counsel for the Adams administration issued a letter to city Comptroller Brad Lander Friday stating that the city’s Law Department is looking to take legal action by Feb. 21 to recoup the $80.5 million Federal Emergency Management Agency payments taken by the feds on Tuesday. “The Law Department is currently drafting litigation papers with respect to this matter,” the letter, penned by corporation counsel Mureil Goode-Trufant, said. “We intend to initiate legal action by February 21, 2025. As the Law Department is representing the City of New York in this matter, there is no need for an authorization for the Comptroller’s Office to engage external legal counsel.” The letter was sent just hours after Lander demanded the Adams administration either file a lawsuit or grant him permission to hire his own attorneys to bring a case against Trump and Department of Government Efficiency honcho Elon Musk. Eric Adams has been in the news a lot lately, especially regarding the DOJ ordering prosecutors to drop all charges in a corruption case against him. Keep in mind that the reason the DOJ wants prosecutors to drop the case is so that Mayor Adams can focus his efforts on working with ICE to get rid of the illegal criminal aliens plaguing his city.
