Joe Biden’s White House Physician Refuses To Answer Questions In Closed-Door Deposition, Pleads The Fifth

Former White House physician Kevin O’Connor declined to answer questions Wednesday during a closed-door deposition with the House Oversight and Government Reform Committee. O’Connor pleaded the Fifth Amendment to questions regarding his time with Joe Biden in the White House and his health while in office. “Earlier today, Dr. Kevin O’Connor asserted the physician-patient privilege, as well as his right under the Fifth Amendment to the U.S. Constitution, in declining to answer questions from the staff of the House Committee on Oversight and Government Reform regarding his service as Physician to the President during the Biden Administration,” a statement from O’Connor’s legal counsel said, according to The Hill. “On the advice of his legal counsel, Dr. O’Connor refused to answer questions that invaded the well-established legal privilege that protects confidential matters between physicians and their patients. His assertion of his right under the Fifth Amendment to decline to answer questions, also on the advice of his lawyers, was made necessary by the unique circumstances of this deposition,” the statement added. “President Joe Biden’s physician, Dr. Kevin O’Connor, just pleaded the fifth at his deposition before Congress today,” House Oversight Chairman James Comer (R-KY) said. “It’s now clear there was a conspiracy to cover up President Biden’s cognitive decline after Dr. Kevin O’Connor, Biden’s physician and family business associate, refused to answer any questions and chose to hide behind the fifth amendment. The American people demand transparency but Dr. O’Connor would rather conceal the truth. Dr. O’Connor took the fifth when asked if he was told to lie about President Biden’s health and whether he was fit to be President of the United States. Congress must assess legislative solutions to prevent such a coverup from happening again. We will continue to interview more Biden White House aides to get the answers Americans deserve,” he continued. Revealing confidential patient information would violate the most fundamental ethical duty of a physician, could result in revocation of Dr. O’Connor’s medical license, and would subject Dr. O’Connor to potential civil liability.” Schertler also noted President Trump has directed the Department of Justice to conduct an investigation into Biden’s mental acuity while in office, arguing the Oversight panel should pause its investigation until any criminal investigation concluded. And Schertler said O’Connor’s decision to assert his Fifth Amendment privilege “does not imply that Dr. O’Connor has committed any crime.” Asked about doctor-patient confidentiality before heading into the interview, Comer told reporters: “I don’t believe that he can hide behind doctor-patient confidentiality, because this is the president of the United States, and people expect the White House physician to be truthful and transparent about the president of the United States’ health.” A source clarified that O’Connor did not plead the fifth due only to doctor-patient privilege, and invoked his Fifth Amendment rights for every answer, aside from stating his name, even questions that would not have implicated doctor-patient privilege. “Kevin O’Connor, Joe Biden’s White House physician, pled the Fifth to all questions—except his name—during his deposition. Biden’s allies have denied such allegations. But Comer suggested to reporters that O’Connor’s invocation of the Fifth Amendment could have been evidence to the contrary. “Most people invoke the fifth when they have criminal liability. And so that’s what would appear on the surface here,” he said. “We’re going to continue to move forward. Obviously, I think his actions today speak loud and clear.” But O’Connor’s lawyers wrote in their statement, “We want to emphasize that asserting the Fifth Amendment privilege does not imply that Dr. O’Connor has committed any crime. In fact, to the contrary, as our Supreme Court has emphasized: ‘One of the Fifth Amendment’s basic functions is to protect innocent men who otherwise might be ensnared by ambiguous circumstances.'” Meanwhile, Rep. Jasmine Crockett, D-Texas, who made a surprise appearance at the interview and was the only lawmaker there, save for Comer, defended O’Connor’s use of the Fifth Amendment. “As someone who has served as a criminal defense attorney and actually been in courtrooms, it’s kind of astounding to hear someone say, if you invoke the Fifth Amendment, that is only because you are guilty,” Crockett said.

A federal appeals court on Wednesday unanimously overturned the conviction of Douglass Mackey, the man prosecuted for sharing satirical memes ahead of the 2016 presidential election. The Justice Department in 2023 sentenced Mackey to “7 months in prison for his role in a conspiracy to interfere with potential voters’ right to vote in the 2016 election for the Office of the President of the United States.” The 2nd U.S. Circuit Court of Appeals in Manhattan ordered a lower court to enter a judgment of acquittal for Mackey, The Telegraph noted, saying the court found that trial evidence failed to prove the government’s claim that he conspired with others to influence the election. “Douglass Mackey went to prison for posting (not even creating) a Hillary meme in 2016. The federal prosecutors’ office in Brooklyn that brought the case declined to comment. In charging Mackey, prosecutors alleged that he conspired with others between September and November of 2016 to post memes, such as a photo of a woman standing in front of an “African Americans for Hillary” sign. “Avoid the Line. Vote from Home,” the tweet said. “Text ‘Hillary’ to 59925.” About 5,000 people followed the meme’s instructions, according to trial testimony. Nearly all of them received an automated response indicating that the social media posts were not associated with the Clinton campaign, and there was “no evidence at trial that Mackey’s tweets tricked anyone into failing properly to vote,” the 2nd Circuit found. Mackey was convicted of the charge in March 2023 following a three-week trial. Breon Peace, United States Attorney for the Eastern District of New York, Acting Assistant Attorney General Nicole M. Argentieri of the Justice Department’s Criminal Division, and James Smith, Assistant Director-in-Charge, Federal Bureau of Investigation, New York Field Office (FBI), announced the sentence. “One of the foundational rights we hold as Americans, a right that many fought so hard to obtain, is the right to vote. The defendant weaponized disinformation in a dangerous scheme to stop targeted groups, including black and brown people and women, from participating in our democracy,” stated United States Attorney Peace. “This groundbreaking prosecution demonstrates our commitment to prosecuting those who commit crimes that threaten our democracy and seek to deprive people of their constitutional right to vote.” As proven at trial, by 2016, Mackey had established an audience on Twitter with approximately 58,000 followers. A February 2016 analysis by the MIT Media Lab ranked Mackey as one of the most significant influencers of the then-upcoming presidential election. Between September 2016 and November 2016, Mackey conspired with other influential Twitter users and with members of private online groups to use social media platforms, including Twitter, to disseminate fraudulent messages that encouraged supporters of presidential candidate Hillary Clinton to “vote” via text message or social media which was legally invalid. For example, on November 1, 2016, in or around the same time that Mackey was sending tweets suggesting the importance of limiting “black turnout,” the defendant tweeted an image depicting an African American woman standing in front of an “African Americans for Hillary” sign. The ad stated: “Avoid the Line. Vote from Home,” “Text ‘Hillary’ to 59925,” and “Vote for Hillary and be a part of history.” The fine print at the bottom of the deceptive image stated: “Must be 18 or older to vote. One vote per person. Must be a legal citizen of the United States. Voting by text not available in Guam, Puerto Rico, Alaska or Hawaii. Paid for by Hillary For President 2016.” The tweet included the typed hashtag “#ImWithHer,” a slogan frequently used by Hillary Clinton. On or about and before Election Day 2016, thousands of unique telephone numbers texted “Hillary” or some derivative to the 59925 text number, which had been used in multiple deceptive campaign images tweeted by Mackey and his co-conspirators. Several hours after tweeting the first image, Mackey tweeted an image depicting a woman seated at a conference room typing a message on her cell phone. This deceptive image was written in Spanish and mimicked a font used by the Clinton campaign in authentic ads. The image also included a copy of the Clinton campaign’s logo and the “ImWithHer” hashtag. This case was investigated by the FBI.
