Alabama Supreme Court Rules in Favor of Embryonic Human Life

In a landmark decision‚ the Alabama Supreme Court ruled Friday in favor of protecting embryonic human life from wrongful death. Embryos are created routinely through in vitro fertilization‚ a process by which ova are fertilized with sperm in a laboratory rather than in a woman’s body. The process of creating and cryopreserving embryos can be dangerous for embryonic children‚ who often are destroyed intentionally or through neglect. In the case heard by the Alabama Supreme Court‚ three sets of parents suffered an unimaginable loss: the death of their embryonic children due to a fertility clinic’s negligence. A hospital patient wandered into the unsecured embryo storage facility and removed a container of embryos from a sub-zero freezer. The intruder dropped the embryos in pain‚ resulting in the deaths of the embryonic children within. The parents brought two lawsuits against the fertility clinic and the hospital under Alabama’s Wrongful Death of a Minor Act. At the behest of the fertility clinic and medical association‚ however‚ a lower trial court had dismissed the case‚ ruling that the “cryopreserved‚ in vitro embryos involved in this case do not fit within the definition of a ‘person’ or ‘child.’” Therefore‚ the trial court held‚ the loss of the embryos “could not give rise to a wrongful-death claim.” The Alabama Supreme Court rightly reversed this ruling. In a powerful opinion by Justice Jay Mitchell and a concurring opinion by Chief Justice Tom Parker‚ the state’s highest court argued that the Wrongful Death of a Minor Act “applies to all unborn children‚ regardless of their location.” Mitchell rejected the notion that an extrauterine embryo “is not a minor child‚ but is instead property‚” as the trial court had concluded. Rather‚ the three sets of parents suffered a grievous loss when their embryonic children were killed. In his concurring opinion‚ Parker argued that Alabama laws about the sanctity of human life should be applied to the sanctity of unborn life‚ too. His opinion boldly appealed to the theological and natural law premises of state law. “In summary‚” he argues‚ BLOCK QUOTE the theologically based view of the sanctity of life adopted by the People of Alabama encompasses the following: (1) God made every person in His image; (2) each person therefore has a value that far exceeds the ability of human beings to calculate; and (3) human life cannot be wrongfully destroyed without incurring the wrath of a holy God‚ who views the destruction of His image as an affront to Himself. END BLOCK This decision rightly places the well-being of children front and center in how clinics practice in vitro fertilization and embryo cryopreservation. Moreover‚ Parker recognizes that each child is created in the image of God and therefore deserves the full force of the law’s protections. As Josh Craddock‚ an affiliated scholar with the James Wilson Institute points out‚ this specific case deals only with wrongful death claims involving cryopreserved embryos‚ not necessarily any embryo created through IVF. “This [decision] has implications for the destruction of embryos held in frozen storage more generally‚ Craddock told me. “You could see a scenario where this decision could be used in the future to help protect those human lives from destruction by the IVF clinics themselves … or by the other parent‚ for example.” Craddock said the ruling by Alabama’s high court could help clarify what to do with frozen embryos after a divorce. In some cases‚ for example‚ one parent wants to use the embryos and the other parent wants to destroy them. “A lot of courts have wrestled with how to deal with that situation‚ whether it should be determined by contract [and] whether the embryos should be considered marital property rather than persons‚” Craddock told me. This case‚ although the first of its kind‚ provides a strong precedent for other states’ supreme courts. Many states have a similar law protecting minors from wrongful death that could be applied to embryonic children‚ as the Alabama Supreme Court did. When asked about the strength of the Alabama ruling‚ Craddock seemed optimistic about the ongoing viability of the decision. “I think it’s definitely going to stick around because it recognizes a basic moral truth that’s written on our hearts and backed up by basic science found in any basic science textbook‚” he said. As noted by Parker‚ Alabama’s chief justice‚ “each person has a value that far exceeds the ability of human beings to calculate.” Alabama has taken the first step toward extending personhood to all human beings‚ no matter how small. A Prayer for Hope SecuredBy Laura Bailey “But as for me‚ how good it is to be near God! I have made the Sovereign LORD my shelter‚ and I will tell everyone about the wonderful things you do.” – Psalm 73:28 NLT Have you ever taken a spiritual gifts assessment? The first time I took one of these tests‚ I was about to graduate high school. Our Sunday School teacher encouraged us to use the unique gifts and talents the Lord blessed us with as we went off to college and into the world. As a know-it-all teenager‚ I confidently whispered to my gal pal I didn't need to take this test; looking at the list of giftings‚ I knew which ones I had. And‚ while I was accurate on my gifting strengths‚ the areas where I scored the lowest came as a shock. How did faith rank as one of my lowest giftings? I'd grown up in church‚ accepted Christ as a young child‚ and was active in our youth group‚ reading my Bible and leading small groups. This test was mistaken. In reality‚ these assessments should be held with an open hand. They are guidelines‚ not definite answers to how the Lord has created us. However‚ they can be valuable tools to open our eyes to areas we need to improve or give more attention to fostering. And the hard truth was that I did struggle with my faith. I am a results-driven kind of girl‚ and when I don't see things happening‚ life moving forward‚ or tangible improvements‚ I tend to give up. I wrestle with God‚ asking Him to show me where He's working. My faith is shaky at best in times of uncertainty and almost non-existent when I can't see God at work. My lack of faith quickly turns into hopelessness and‚ eventually‚ if I stay there long enough‚ despair. In the book of Psalms‚ we find a man named Asaph‚ a temple leader who was having issues with a wavering faith and waning hope in God's plan (Psalm 73). Asaph was faithful‚ living a righteous life‚ but things weren't going all that great for him. Meanwhile‚ the people around him–who openly rejected God– were prosperous in their lives (outwardly‚ at least). We see Asaph presenting his complaints before the Lord in the first few verses of Psalm 73‚ but then we see a shift. Instead of looking around him‚ he started looking up‚ and as he began to draw near to God‚ his faith renewed and hope restored. And that same comfort and hope is available to us‚ too! We read in Psalm 73:26-28 that being in the presence of God renews our faith and restores our souls: "My flesh and my heart may fail‚ but God is the strength of my heart and my portion forever. Those who are far from you will perish; you destroy all who are unfaithful to you. But as for me‚ it is good to be near God. I have made the Sovereign LORD my refuge; I will tell of all your deeds." Friend‚ I don’t know exactly what you are going through right now‚ but I do know that God sees you‚ and even when it feels like He has checked out‚ I can assure you He is there with you. And here's the other good news: even if‚ like me‚ faith doesn't come naturally to you‚ we can ask God to help us in our unbelief (Mark 9:24). Let's pray: Heavenly Father‚ we come before you in reverent worship. You alone are worthy of our praise and adoration. Forgive us when we doubt and question you; we are thankful you are a God of grace and mercy. Help us to call out to you in our unbelief. When our faith is wavering and our hope dwindling‚ give us strength to fight the good fight and finish the race set before us. We thank you for the gift of community; help us to seek counsel and prayer from our brothers and sisters in Christ when we feel our faith is especially vulnerable. We ask that you guide us as we look for ways to strengthen others‚ build up one another‚ and bond with one another. We love you‚ Lord. How to love those who ridicule you Above all‚ you must understand that in the last days scoffers will come‚ scoffing and following their own evil desires. They will say‚ "Where is this ‘coming' he promised? Ever since our ancestors died‚ everything goes on as it has since the beginning of creation." – 2 Peter 3:3-4 In 1818‚ Ignaz Philipp Semmelweis was born into a world of dying women. The finest hospitals lost one out of six young mothers to the scourge of "childbed fever." Back then‚ a doctor's daily routine began in the dissecting room where he performed autopsies. From there the doctor made his way to the hospital to examine expectant mothers without ever pausing to wash his hands. Dr. Semmelweis was the first man in history to associate such examinations with the resultant infection and death. His own practice was to wash with a chlorine solution‚ and after eleven years and the delivery of 8‚537 babies‚ he lost only 184 mothers-about one in fifty. He spent the vigor of his life lecturing and debating with his colleagues. Once he argued‚ "While we talk‚ talk‚ talk‚ gentlemen‚ women are dying. I am not asking anything world shaking. I am asking you only to wash…. For God's sake‚ wash your hands." Virtually no one believed him‚ and Semmelweis died insane at the age of 47‚ his colleagues laughing in his face. It wasn't until years later that hand washing became a common‚ life-saving practice among medical professionals. There will come a day when all will be made known‚ and those who have scoffed at the gospel will see their error. But until then‚ stay vigilant in sharing God's message of salvation with a dying world! Prayer Challenge Pray that God would give you the resolve to be vigilant in sharing His message of hope with a dying world. Psalm 143:8b (NIV) My two favorite (though unrelated) questions are: "How old are these leftovers I'm about to eat for lunch?" and "Why?" I'm a single gal in my late 30s‚ and my life hasn't turned out how I thought it would. My résumé is full of plot twists‚ my hair is turning white faster than I'd like‚ and I never did marry Prince William (or Harry). Of course‚ a certain February holiday has me thinking about my relationship status more than usual. I can't help but wonder: Why is my reality not matching my desires? Should I be doing more‚ praying harder‚ or caring about it all less? Is God still moving if this area of my life isn't? Sometimes the answer to our "why am I still single" question is obvious: God is protecting us‚ preparing us‚ or has a purpose for us elsewhere. But sometimes we don't get an answer to our "why." So we're left with a choice: continue the search for eligible royalty or ask some different questions. God‚ what do You want me to do now? Instead of asking why you're here‚ ask God what He wants you to do here. Create a prayer from our key verse‚ Psalm 143:8b: "Show me the way I should go‚ for to you I entrust my life." You have influence right where you are‚ ring on your finger or not. How can you use your time‚ talents and energy today to serve the people you're with and the places you're in? How can I grow my relationship with God in this? Do you think of God as a cold‚ unapproachable being who is withholding something incredible from you? Or is He a friend who loves you unconditionally and wants a relationship with you‚ even if you don't understand everything that happens in your life? Today is as good a day as any to dig‚ cry and wrestle your way to a richer and deeper understanding of God's character and heart. As I reflect on my life until now‚ in what ways can I trace God's faithfulness?  I thought the plans I had for myself 15 years ago were great‚ but hindsight shows God's plans were infinitely better. Even if God feels quiet today‚ I can reflect back and see how He's used heartbreaks‚ jobs‚ relationships‚ health problems‚ communities‚ and cities I've been in for some type of good. Today might be hard‚ but let’s allow God's faithfulness from yesterday to give us hope for tomorrow. Jesus‚ instead of only wondering why‚ help us to ask for more of who You are and how we can partner with Your plans. Write Psalm 143:8 on our hearts as a reminder of Your loving faithfulness‚ and guide our lives according to Your plans‚ not ours: "Let the morning bring me word of your unfailing love‚ for I have put my trust in you.
