Americans Must Criticize Our Corrupt Courts

Editor’s Note: The group quota regime is a revolutionary threat which aims to overthrow the political order of the United States and the Constitution that underlies it. In its maneuvers for political power, this revolutionary enemy already operates on a set of legal and constitutional principles entirely different from those on which our country was founded. Nowhere is this more apparent than in the corrupt prosecution of President Donald Trump, and the attendant, authoritarian insistence that criticism of the machinations of “justice” is unwelcome in a democratic society. In the wake of his conviction in a New York court, President Trump has complained that the process was rigged against him, that the whole proceeding was a corrupt effort to persecute him with a view to influencing the 2024 presidential election. In response, many of his opponents have criticized him for undermining public confidence in our system of criminal justice and thus harming our democracy—a criticism that has been magnified by many in the media. These critics, however, are missing the point and undermining a principle that is in fact essential to preserving our republic: namely, that criticism of the justice system when it errs or overreaches is necessary to preserving freedom under the rule of law. Those who founded our nation were aware of this necessity. Alexander Hamilton, representing the defendant in the famous libel case People v. Croswell, warned that “the most dangerous, the most sure, the most fatal of tyrannies” operated “by selecting and sacrificing single individuals, under the mask and forms of law, by dependent and partial tribunals.” “Against such measures,” Hamilton continued, “we ought to keep a vigilant eye and take a manly stand. Whenever they arise, we ought to resist, and resist till we have hurled the demagogues and tyrants from their imagined thrones.” No sensible American would look back on these remarks and think that, by them, Hamilton was undermining democracy. Hamilton’s great rival, Thomas Jefferson, acted on a similar view. As president, Jefferson pardoned publishers who had been convicted under the Sedition Act of 1798. Jefferson’s course of action here was inseparable from his belief that the Act was unconstitutional and that the courts of the United States had made themselves party to serious injustices by convicting defendants under it. Indeed, the pardoning power is included in the United States Constitution, and in many state constitutions, and is used routinely, precisely because prosecutors and courts can make mistakes and sometimes even willfully abuse their power over the lives and liberties of citizens. These dangers are also recognized in federal law. Title 18 of the United States Code prohibits and punishes “deprivation of rights under color of law.” By its very terms this provision acknowledges that sometimes those entrusted with the administration of justice are themselves guilty of behaving lawlessly and abusively. The United States Department of Justice’s website observes that this provision may be applied not only against “police officers, sheriff’s deputies, and prison guards” but also, as appropriate, against “judges, district attorneys,” and “other public officials.” This important provision is itself an acknowledgment by the government that all the proceedings of our justice system are not entitled to uncritical acceptance. Everyone conversant with American history knows that the problem of politicized and corrupt abuses of the justice system has not disappeared in the modern era, that it continues to rear its ugly head precisely when political passions run high and communities are inflamed against leaders for whom they harbor deep animosities. In the 1960s, Alabama state authorities brought Dr. Martin Luther King, Jr. to trial on charges that he had committed perjury in relation to his tax filings. This prosecution was a transparently cynical attempt to deprive an important American political and social movement of its most effective leader. In that case, however, even the Alabama jury, composed exclusively of white men, perceived the abusive character of the case and returned an acquittal. Afterwards, Dr. King thanked the jury for their “fair, honest, and just verdict” and commended the Alabama judge for the “high and noble manner” in which he had conducted the case. If criticism of prosecutors and courts is permissible and necessary in certain circumstances, the only important question at present is whether such criticism is justified in the case of President Trump’s New York conviction. Would it be reasonable for impartial Americans today to echo Dr. King’s words and congratulate the Manhattan jury for a “fair” verdict and commend Judge Merchan for his “high and noble” handling of the case? For an answer to that question, we need not rely on Trump or his aggrieved supporters. We need only look to the evaluation of respected CNN legal analyst and former federal prosecutor Elie Honig, writing in New York Magazine: “Prosecutors Got Trump, But They Contorted the Law.” This article was made available by RealClearWire. Stephen Colbert’s fans have little interest in the truth, so the “Late Show” host avoids it at all costs. Inflation? The border? Hamas? Crime? Oct. 7? Name the hot-button topic, and Colbert will spin it to benefit Team Biden. He, like Jimmy Kimmel, literally fundraises for the elderly president. What Colbert did last week on behalf of the 81-year-old should have come with a six-figure DNC check. This kind of spin requires a Herculean effort, and Colbert gave it his comic all. Bottom of Form The subject? The Wall Street Journal’s shocking report detailing just how far President Biden’s age has impacted his mental state. We’ve seen this before, of course. The embarrassing gaffes. The meandering public appearances. Others in attendance recalled that it took Biden about 10 minutes from when he entered the room to get the meeting started, and when he did, he used note cards to make obvious points that everyone was already in agreement with and participants could barely hear him. In a February follow-up with House Speaker Mike Johnson, the Louisiana Republican expressed his concern to the president over the administration’s liquid natural gas export policy — fearing it was benefiting Russia. Biden didn’t seem to know the policy was actually in effect and falsely claimed it was “only a study,” according to the report…. Biden would “ramble” and mumble, and his ability to command the room varied from day to day during tense negotiations over raising the debt ceiling last May, former House Speaker Kevin McCarthy (R-Calif.) recalled. Had the report arrived out of the blue it would be stunning. It didn’t. The Biden White House is furiously attempting to stop the audio from Biden’s interview with Special Counsel Robert Hur from going public months before Election Day. We just read a startling Biden interview with Time Magazine which featured more confused comments. President Biden forgot key facts about the economy, foreign policy and his time in public office during a sit-down interview with Time magazine last month — even mixing up Chinese President Xi Jinping and Russian President Vladimir Putin. Not Biden. Something is seriously wrong with the leader of the free world. It’s not a partisan matter. And the press is (mostly) covering it up. So, too, are Democrats eager to drag Biden over the finish line a second and final time. Like Colbert. The comedian covered the blistering WSJ report and flat-out misled his audience. They like that. Still, the people watching it at home and via YouTube were likely less pleased. They know the best political satire is served with a serious helping of the truth.     “A reputable newspaper like The Wall Street Journal would never run a headline like, ‘Behind Closed Doors, Biden Shows Signs of Slipping,’ unless they had the receipts,” Colbert said, setting up the spin. Colbert then cherry-picked quotes from the report, leaving the damning bits out to protect His Precious. For example, he extensively riffed on the fact that Biden relied on notes during some of his important meetings, a potentially innocent scenario without the full, brutal context. The Wall Street Journal delivered said context. Not Colbert. Later, he read a portion of the story sharing how Biden would speak softly at times and often paused before talking. Why, that could be the sign of a leader using his voice for emphasis and taking time to collect his thoughts. Except we know the fuller meaning behind the WSJ article. He left it out for comic effect, and the audience cheered in response. We call that … clapter. Watch the full clip to grasp just how far he stretches the truth for his master. Colbert owes the WSJ reporters behind that story an apology. He’ll never utter one, though. Heck, he spent three years telling his audience Donald Trump colluded with Russia to steal the 2016 election. We’re still waiting for a mea culpa on that front.

The result of the first major abortion case to be brought to the Supreme Court since Roe v. Wade was overturned in 2022 has disheartened many in the pro-life movement. The case, FDA v. Alliance for Hippocratic Medicine, was an organization of physicians challenging the FDA’s loosened regulations on the abortion pill — which women can now get by mail without an in-person doctor’s office visit. The Supreme Court rejected the lawsuit. “I do know enough about law to be dangerous,” Sara Gonzales comments, noting that the Supreme Court’s decision was “more about whether or not this group even had the standing to sue, rather than all of the nuts and bolts of it.” The opinion was written by Justice Brett Kavanaugh, and according to his opinion the court found that the plaintiffs had not met the threshold for a lawsuit in the first place. One of the reasons was that they hadn’t proved that the FDA’s relaxed regulatory requirements could result in injury. “So they’re not saying ‘we don’t understand the problem that you have with this,'" Gonzales explains. “This is why it was unanimous, because the decision wasn’t about the morality of it; it was of course just about the technicality.” However, Gonzales believes the abortion pill shouldn’t be so available. “What they are doing, particularly with this drug, is in my opinion criminal,” Gonzales says. “If you go by their own label, go by the FDA’s own label, okay, roughly one in 25 women who take these chemical abortion drugs have to end up going to the emergency room, and that is of course assuming that they don’t bleed out on the bathroom floor first.” “The FDA under the direction of the Biden-Harris regime is allowing these women to take these high-risk drugs without being under care of a doctor, without even physically going in to a doctor,” she continues, relating it to the back-alley coat-hanger abortions the left has threatened. “What is so different about this?” she asks. President Joe Biden, in his speech at the Everytown for Gun Safety's annual training conference, did what he always does any time he steps on the stage: made a complete fool of himself. Pat Gray and the “Unleashed” team unpack the speech — from the butchered Thomas Jefferson quote to the wildly inaccurate assertion that Biden was once a constitutional professor (plus every absurdity in between). “There is so much here in 2 minutes and 11 seconds,” sighs Pat, playing the clip. At one point during his speech, Biden referenced a “school shooting in Iowa that killed a student and a teacher.” “My predecessor was asked about it,” Biden stated, referencing Trump. “He said, ‘You have to get over it.”’ “That’s way out of context,” criticizes Pat. “More children are killed in America by guns than cancer and car accidents combined,” Biden then stated. “You have to really bend over backwards to try to make that stat work,” says Pat, noting that “you have to include suicides and accidental gun deaths” to justify those numbers. In one of his worst moments, Biden claimed that after he was vice president, he “became a professor at the University of Pennsylvania” where he “taught a constitutional law class.” “No, no you didn’t,” corrects Pat. “It's been fact-checked by all the liberal agencies; everybody has said it's not true, it didn't happen, and he keeps saying it anyway.” Biden then went on to horribly butcher the famous line from Thomas Jefferson’s letter to William Stephens Smith in which he stated, “The tree of liberty must be refreshed from time to time with the blood of patriots and tyrants.” But Biden’s version was: “the blood of liberty.” That’s it. “I’ve never heard that phrase,” says Pat. “He wasn’t even close.” To hear more of Biden’s bumbling speech and Pat’s commentary, watch the clip below. Major League Baseball has announced that it is disciplining umpire Pat Hoberg for alleged unspecified violations of the league's gambling policy. Almost all of the details regarding the suspension - including the length of the suspension and the nature of the violation - remain shrouded in mystery. Hoberg has denied betting on baseball and is appealing the suspension.In a statement, MLB said, "During this year's Spring Training, Major League Baseball commenced an investigation regarding a potential violation of MLB's sports betting policies by Umpire Pat Hoberg. Mr. Hoberg was removed from the field during the pendency of that investigation. While MLB's investigation did not find any evidence that games worked by Mr. Hoberg were compromised or manipulated in any way, MLB determined that discipline was warranted. Mr. Hoberg has chosen to appeal that determination. Therefore, we cannot comment further until the appeal process is concluded."Hoberg did not return requests for comment to multiple media outlets, but he did issue a statement in response to MLB's statement. "I am appealing Major League Baseball's determination that I should be disciplined for violating the sports betting policies. While that appeal is pending, it would not be appropriate to discuss the case. That said, I have devoted my adult life to the profession of umpiring, and the integrity of baseball is of the utmost importance to me. I look forward to the appeal process, and I am grateful that the Major League Baseball Umpires Association is supporting me in the appeal."Hoberg is widely regarded as one of the best ball-strike calling umpires in the game, being consistently rated near the top in accuracy ratings by Umpire Scorecards and other independent internet services that grade umpire accuracy. The suspension comes as baseball and other sports continue to wrestle with the expansion of legalized sports gambling in the United States. Baseball's most famous player, Shohei Ohtani, was implicated in a major gambling scandal earlier this year when millions of dollars was transferred from his accounts to cover gambling debts placed with an unlicensed bookie. The FBI, MLB, and Ohtani have all stated that they believe this action was done without Ohtani's knowledge by Ohtani's interpreter, who has pled guilty to federal charges in connection with the incident. The MLB also banned Padres infielder Tucupita Marcano for life after an investigation allegedly revealed that Marcano had bet on Pirates games while playing with the team. Earlier this year, Toronto Raptors forward Jontay Porter was banned for allegedly manipulating games at the behest of gamblers.
