Attorney General Merrick Garland is withholding audio of President Joe Biden’s special counsel interview to protect the White House from a potentially embarrassing story, according to George Washington University law professor Jonathan Turley. Turley appeared on Fox News’ “Hannity” on Friday and told guest host Kayleigh McEnany that House Republicans are right to pursue Garland on his refusal to hand over the audiotapes. The House voted to hold the attorney general in contempt of Congress last week in a largely party-line vote. Garland “has a record now of running interference on potential cases or investigations that might embarrass the White House. This latest fight with Congress is particularly telling. The position of Merrick Garland withholding these audiotapes is not just unsupportable, it’s incomprehensible as a matter of constitutional law,” Turley said. “It’s absurd, and he’s going to go into a federal court and make an argument that I think most trial lawyers would blush in front of a judge,” he continued. “He’s arguing that we didn’t view the transcript as privileged but we do believe the audiotape of the same transcript to be privileged, as if this is the president who shall not be heard. No court has ever extended the privilege like that.” The department’s argument that releasing the audiotape will lead to a proliferation of AI deepfakes of Biden’s special counsel interview is nonsensical and counterproductive, according to Turley. “They made it even more absurd by saying that they have a type of deep fake privilege, that if we release the tape, AI will start to make fake audiotapes of the president’s voice. Well, here’s a flash for you Gordon, they already have the president’s voice and you’ve already given the transcript. A high school student could re-create a fake tape like that. If anything you make it more likely that would be accepted as true because you won’t release the actual audiotape,” he said. House Speaker Mike Johnson said in a statement Friday that the House would pursue the subpoena for the audiotapes in court. Turley applauded the step. “I commend Speaker Johnson in saying we’ll go to court. I represented the House of Representatives in prior litigation and it actually has a very good record, including in our case of prevailing in the federal courts to fight for Article 1 powers — and this is it. This is the hill that you need to fight on,” Turley said. The Justice Department issued a letter to the House on Friday two days after the contempt vote declining to prosecute Garland. Assistant Attorney General Carlos Felipe Uriarte, who wrote the letter, cited the “longstanding position and uniform practice” of the DOJ to decline to prosecute officials denying subpoenas because of a president’s claim of executive privilege.

Treasury Secretary Janet Yellen was pressed on Sunday to answer why voters are unhappy with the economy under President Joe Biden just months ahead of his expected rematch against former President Donald Trump in the 2024 election. Jonathan Karl, a co-anchor of ABC News’s “This Week,” set up the question by telling Yellen that she had “cited a lot of positive macroeconomic indicators” while commenting on the economic situation in the United States. “The rate of inflation is coming down. Unemployment is low. The economy’s growing. But why is it then that voters seem so unsatisfied?” Karl asked. “And in fact, in poll after poll, voters say they trust Donald Trump with the economy more than Joe Biden. What’s going on?” “Well, I think the pandemic was a profoundly difficult time,” Yellen replied. “But in the years leading up to the pandemic, Americans were really, many of them, working-class families just struggling with things like healthcare costs, the cost of energy, education costs, childcare costs.” She added, “And so they really feel the cost of living. Housing is particularly unaffordable in so many parts of the country. And I think the inflation that we experienced after the pandemic just compounded this feeling for them that life isn’t affordable. So it is the Biden administration’s top priority to address these costs where we possibly can.” Karl interjected to focus on inflation. “Yeah, and just to be clear, I mean, the rate of inflation is coming down, but overall inflation is up 19% since President Biden took office,” Karl said. “On some everyday goods, it’s much higher. The price of eggs is up 84% since President Biden took office; ground beef, up 30%; bread, up 27%. I mean, by and large, inflation rate may go down, but those prices aren’t returning to where they were. I mean, those prices are going to remain high.” Yellen said “it is true that, over the last roughly three years, there’s been a significant increase in the price level. It’s now rising at a very slow, close to normal rate. But, yes, Americans see that, and mainly it comes on top of concerns about costs that were making life very difficult. So it’s something the Biden administration absolutely wants to address. I would point out, of course, that wages have also gone up during this time, and government studies show that, for all — for households at all points in the income distribution — wages have gone up somewhat more than prices. So the typical American is somewhat better off.” Karl also asked Yellen to comment on Trump floating the idea of replacing federal income taxes with tariffs. “It would require tariffs well over 100%,” Yellen said. “The impact would be to make life unaffordable for working-class Americans and would harm American businesses.”

North Dakota Governor Doug Burgum, who is a 2024 veepstakes contender, vouched for former President Donald Trump’s approach to tariff policy. “I think if anybody looks at his actual record of negotiating with other countries, what he’s always looking for is balanced trade, and — not free trade, but balanced trade,” Burgum told “Fox News Sunday” anchor Shannon Bream, who had noted Trump’s proposal to replace income taxes with revenue from tariffs. “We’ve got the largest economy in the world, all kinds of countries around the world, and it’s not just China, but France and others — they put tariffs on American products going their way, and it’s pretty simple for President Trump: If you’re going to tariff our stuff, we’re going to tariff yours,” Burgum said. “And I think that he’s then negotiating on behalf of American workers and American companies when he does that,” he added. “And I think it’s also, again, he understands how to use power. You know, diplomatic, informational, our economic power is sometimes more powerful than military power. He knows how to wield that, and he’s going to be able to drive solutions that benefit America and benefit American workers.” Burgum also talked about changing his mind since he said last summer, when he was running for the GOP presidential nomination before dropping out and endorsing Trump, that he would not do business with the former president. “Since January, you know, when we endorsed him, when we dropped out, the first of the candidates to endorse him, had a chance to spend a ton of time with him since January, and I wish every American could see him the way Kathryn and I have got to know him in the last six months, because this guy is tireless, he’s committed, he’s smart, he’s funny. He’s nothing like he’s portrayed in the press,” Burgum said while mentioning his wife. “And so if you asked me that same question today, I’d be like, ‘Absolutely, I would do business with him,'” Burgum added. “Because think about how successful he’s been, whether it’s a — whatever it is, I mean, whether it’s in TV, real estate, politics, all the things that he’s done, the guy knows how to get it done. And I think every American should be, I don’t know, we should be grateful that we’ve got someone who’s willing, with that kind of talent from the private sector that’s willing to put himself back into the presidential race again.”
