Appeals Court Issues Ruling On Alina Habba Serving As Top Prosecutor In New Jersey

An appellate court ruled on Monday that Alina Habba is serving unlawfully as U.S. attorney for New Jersey. A three-judge panel for the 3rd Circuit Court of Appeals upheld a lower court ruling disqualifying Habba for the position. According to CBS News, the ruling stemmed from three men facing criminal charges in New Jersey challenging the validity of Habba’s appointment as a violation of the Federal Vacancies Reform Act. Federal appeals court rules Alina Habba, Trump's former personal lawyer, is unlawfully serving as the US attorney for New Jersey.https://t.co/XJJl3IVP5t pic.twitter.com/qrcvVnyXJY — CNN (@CNN) December 1, 2025 CBS News has more: U.S. District Judge Matthew Brann ruled in August that Habba has been serving without lawful authority since the beginning of July, when she was tapped to temporarily lead the U.S. Attorney’s Office in New Jersey. Brann said she must be disqualified from participating in ongoing cases. The Justice Department appealed that decision to the 3rd Circuit, which is now the first federal appeals court to weigh in on the administration’s scheme for installing certain U.S. attorneys. Habba was tapped to serve as interim U.S. attorney in New Jersey earlier this year, but her appointment to the role was limited to 120 days, unless the U.S. district court in New Jersey voted to extend her tenure or she was confirmed to the post by the Senate. Habba’s nomination, however, was unlikely to win approval in the upper chamber, as New Jersey’s two senators, Democrats Cory Booker and Andrew Kim, opposed her nomination. The Trump administration could request for a full panel from the 3rd Circuit to reconsider the decision or appeal to the Supreme Court, Fox News noted. Habba’s case was the furthest along in the court process, but Lindsey Halligan and Bill Essayli, temporary U.S. attorneys in Virginia and California, respectively, are among those also facing high-stakes court challenges to their appointments. A federal judge found last week that Halligan was unlawfully serving in her role, but the administration has vowed to appeal the decision. The panel that heard Habba’s case comprised two appointees of former President George W. Bush and an appointee of former President Barack Obama.

President Trump Warns Venezuela President Nicolas Maduro To Flee The Country

U.S. tensions with Venezuela is now at an all time high. Just days after President Trump announced that the United States may soon launch land strikes on Venezuela, a new report by the Miami Herald has revealed President Trump warned the President of Venezuela to leave the country. Maduro who has been labeled as the head of the “Cartel de los Soles” cartel which has been designated as a foreign terrorist organization, was reportedly told by Trump that the U.S. will offer him no security guarantees and his best option is to leave the country now. Fox News reported more on Trump’s call with Maduro: President Donald Trump delivered a stern ultimatum to Nicolás Maduro to leave Venezuela immediately before announcing the country’s airspace should be closed, according to a report. Per the Miami Herald, Washington’s warning was delivered in a phone call with Caracas and offered guaranteed evacuation for Maduro, his wife Cilia Flores, and their son, but only if the dictator agreed to resign on the spot. The conversation stalled, U.S. officials said, and within hours Washington escalated dramatically. The ensuing impasse, a source told the outlet, was over Maduro asking for “global amnesty for any crimes he and his group had committed, and that was rejected.” “Second, they asked to retain control of the armed forces — similar to what happened in Nicaragua in ’91 with Violeta Chamorro. In return, they would allow free elections.” The final issue was timing, according to the outlet, as Washington demanded that Maduro resign immediately – but Caracas refused. Trump went on to announce Saturday that Venezuelan airspace would be considered “closed in its entirety.” The Herald also reported that the Maduro government tried to schedule another call to Washington but received no response. U.S. pressure on Caracas stems from accusations that Maduro and senior officials are linked to narcotrafficking networks. Maduro denies that. Venezuelan leaders say the United States is intent on seizing their nation’s vast natural resources. Maduro has mobilized supporters and is framing the crisis as a battle for sovereignty, using rallies to project internal unity despite deep economic strain and international isolation. Trump, asked on Sunday if he had spoken to the Venezuelan leader, told reporters on Air Force One that he had. “I don’t want to comment on it. The answer is yes,” Trump said. “I wouldn’t say it went well or badly, it was a phone call,” Trump said of the conversation. Asked if his comment about Venezuela’s airspace being “closed” meant that a U.S. attack on the country was imminent, Trump said: “Don’t read anything into it.” The New York Times reported on Friday that Trump spoke with Maduro at an unspecified point late in the third week of November. Maduro and senior members of his administration have not commented on the call, which does not appear to have helped ease the situation.

After two National Guard members were shot — and one tragically lost her life — in an ambush attack by an Afghan national who was let in to the U.S. under the disastrous Biden regime, President Trump is furious. Now, he’s set to take official action to stop all migration from third-world countries. And, he’s going to crack down hard. While on board Air Force one, he told reporters that the ban on third-world immigrants will last a “long time.” USA Today has more: President Donald Trump doubled down on his anti-immigration policies on Nov. 30, saying his administration’s pause on processing of all asylum applications has “no time limit, but it could be a long time.” “We don’t want those people. We have enough problems,” Trump told reporters on board Air Force One. “Many of them are no good and they shouldn’t be in our country.” When asked about who “those people” are, the president said “people from different countries that are not friendly to us and countries that are out of control themselves.” He again referred to “Third World Countries,” a term used to refer to poor and less developed nations. “I don’t think they are all ‘Third World,’ but in many cases they are ‘Third World.’ They are not good countries. They are crime-ridden countries. They’re countries that don’t do a good job,” Trump said. “We frankly don’t need their people coming into our country telling us what to do.” Trump has previously vowed to halt migration from all “Third World Countries” following an attack in Washington, DC, that left a member of the West Virginia National Guard dead and another critically injured. The deadly shooting was allegedly carried out by a suspect identified as an Afghan national who entered the U.S. under a Biden-era refugee program in 2021 and was granted asylum in April of this year by the Trump administration. After the Nov. 26 attack, the Trump administration ordered widespread reviews of immigration policies, including a sweeping reexamination of green cards issued to people from 19 countries considered “high-risk.” Speaking on NBC’s “Meet the Press” and ABC’s “This Week,” Homeland Security Secretary Kristi Noem said Nov. 30 that immigration officials would consider deporting people with active asylum cases if it was warranted. Trump also threatened to possibly denaturalize some U.S. citizens. “If I have the power to do it, I’m not sure that I do, but if I do I would denaturalize, absolutely,” he said. Amid Minnesota’s gigantic fraud scandal, Gov. Tim Walz is flat-out refusing to take responsibility. Frankly, the extent of the fraud happening within Somali communities in Minnesota is just stunning. Even The New York Times admits: The fraud scandal that rattled Minnesota was staggering in its scale and brazenness. Federal prosecutors charged dozens of people with felonies, accusing them of stealing hundreds of millions of dollars from a government program meant to keep children fed during the Covid-19 pandemic. At first, many in the state saw the case as a one-off abuse during a health emergency. But as new schemes targeting the state’s generous safety net programs came to light, state and federal officials began to grapple with a jarring reality. Over the last five years, law enforcement officials say, fraud took root in pockets of Minnesota’s Somali diaspora as scores of individuals made small fortunes by setting up companies that billed state agencies for millions of dollars’ worth of social services that were never provided. Federal prosecutors say that 59 people have been convicted in those schemes so far, and that more than $1 billion in taxpayers’ money has been stolen in three plots they are investigating. That is more than Minnesota spends annually to run its Department of Corrections. Minnesota’s fraud scandal stood out even in the context of rampant theft during the pandemic, when Americans stole tens of billions through unemployment benefits, business loans and other forms of aid, according to federal auditors. Outrage has swelled among Minnesotans, and fraud has turned into a potent political issue in a competitive campaign season. Gov. Tim Walz and fellow Democrats are being asked to explain how so much money was stolen on their watch, providing Republicans, who hope to take back the governor’s office in 2026, with a powerful line of attack. Many people — even left-wing news outlets like the NYT — are wondering how in the world this could have happened under Gov. Walz’s watch. But, during an appearance on NBC News, Walz defended Somali immigrants and claimed that the state’s “generous” policies attracts criminals. In other words, according to Gov. Walz, Minnesota is just so well-run that even criminals prosper there! Or, something like that. There is a trend here and it’s simple: Somalians LEECH OFF THE TAXPAYER and must be sent packing. Now. Wow. President Trump is right. Walz's attempts to shirk responsibility, Minnesota government employees have a very different story to tell. Minnesota DHS workers are pinning the blame directly on Gov. Walz, saying that they warned him about the fraud happening early on. But, he ignored their warnings and did absolutely nothing instead. More from Fox News: More than 400 employees of the Minnesota Department of Human Services (DHS) accused Gov. Tim Walz of failing to act on widespread fraud warnings and retaliating against whistleblowers. The Minnesota Department of Human Service Employees account, which says it consists of more than 480 current staff members at the Minnesota DHS, wrote on X that Walz is "100% responsible for massive fraud in Minnesota." "We let Tim Walz know of fraud early on, hoping for a partnership in stopping fraud but no, we got the opposite response. Tim Walz systematically retaliated against whistleblowers using monitoring, threats, repression, and did his best to discredit fraud reports," the group claimed. "In addition to retaliating against whistleblower[s], Tim Walz disempowered the Office of the Legislative Auditor, allowing agencies to disregard their audit findings and guidance." Walz's office did not immediately respond to Fox News Digital's request for comment. The group’s claims come as federal prosecutors continue to unravel one of the nation’s largest COVID-era fraud cases. The Justice Department announced new charges last week against the 78th defendant in the Feeding Our Future fraud scheme, which prosecutors say involved more than $250 million in stolen funds from a federally-funded child nutrition program and has already resulted in over 50 convictions.
