Top Iowa Court Allows State’s Heartbeat Law To Take Effect After Planned Parenthood Lawsuit

The Iowa Supreme Court ruled on Friday that a law banning abortion when an unborn baby’s heartbeat can be detected can take effect in a victory for pro-life advocates. In a 4-3 decision, the court said that protecting unborn babies when their heartbeats can be detected is a legitimate state interest. The decision means that Iowa’s previous 20-week limit on abortion will soon be around six weeks once the court’s ruling officially takes effect. “We have previously held that abortion is not a fundamental right under the Iowa Constitution,” Justice Matthew McDermott wrote for the majority. “Applying our established tiers of scrutiny, we hold that abortion restrictions alleged to violate the due process clause are subject to the rational basis test. Employing that test here, we conclude that the fetal heartbeat statute is rationally related to the state’s legitimate interest in protecting unborn life.” “We thus reverse the district court order entering the temporary injunction blocking enforcement of the fetal heartbeat statute and remand for further proceedings,” McDermott wrote. The state was sued by Planned Parenthood and the American Civil Liberties Union after Governor Kim Reynolds signed the heartbeat bill into law after Republican lawmakers passed it during a special session last year. The law includes exceptions for rape and incest. In a dissenting opinion, Chief Justice Susan Christensen claimed the law was a setback for women. “Today, our court’s majority strips Iowa women of their bodily autonomy by holding that there is no fundamental right to terminate a pregnancy under our state constitution,” she wrote. “The majority’s rigid approach relies heavily on the male-dominated history and traditions of the 1800s, all the while ignoring how far women’s rights have come since the Civil War era.” CLICK HERE TO GET THE DAILYWIRE+ APP Iowa Republicans celebrated the ruling from the court. “There is no right more sacred than life, and nothing more worthy of our strongest defense than the innocent unborn,” Reynolds said in a statement. “As the heartbeat bill finally becomes law, we are deeply committed to supporting women in planning for motherhood, and promoting fatherhood and its importance in parenting.” House Speaker Pat Grassley said that courts had stood in the way of pro-life protections for a long time. “This ruling is a victory in the fight to protect unborn children in Iowa,” Grassley said. “The Legislature is elected by the people, and for too long, the courts have stood in the way of Iowans having their voices heard on this matter.”

Barstool founder Dave Portnoy called an “emergency press conference” and suggested the Democrats sent President Joe Biden out to debate because they “want to whack him.” In a video he posted on Friday on X, Portnoy told his millions of followers that he didn’t think it was an accident that the Democrats agreed to let Biden debate former President Donald Trump, suggesting it was the party’s way of removing him from the 2024 presidential ticket. The post has since gone viral with more than 1.5 million views at the time of this publication. “That was as good as Joe Biden could ever do in a debate. Before it started, I tweeted out ‘how are the Democrats allowing Joe Biden to do a debate?’” Portnoy said, playing clips of Biden, calling him “a vegetable” and saying he “belongs in a nursing home.” “The Democrats had to know that,” he added. “Why would you agree to a debate with Biden. At this stage, the earliest debate of all time, when you know he’s gone. I’m talking the Democrats, CNN, just shoveling dirt on him,” Portnoy said. “Being like, ‘He didn’t do what he had to do. He looked weak. We may have to make a change.’” In the clip, the founder of Barstool played several clips of members of the media reacting to Biden’s disastrous debate performance. One person in the video was CNN’s Chris Wallace, who said, “I think the question answers itself, he wasn’t capable of doing any better than he did.” CNN host Van Jones was another who added, “That was painful. We’re still far from our convention and there is time for this party to figure out a different way forward if he will allow us to do that.”

Biden’s Shaky Debate Performance Showcased 3 Bright, Shining Lies

“We finally beat Medicare.” That was just one of the many astonishing things that President Joe Biden said, or tried to say, in his Thursday night face-off with President Donald J. Trump. The de facto Democrat and Republican standard bearers parried for 90 minutes on CNN. The normally rabid, Trump-hating moderators, Dana Bash and Jake Tapper, rose to the occasion and asked both candidates tough, fair, and relevant questions. The opponents debated each other, not the anchors. Three cheers for that. Biden earned zero cheers, however, for his many lies. Three slices of disinformation were especially egregious: First, Biden said, “I’m the only president this century that doesn’t have any this—this decade, that doesn’t have any troops dying anywhere in the world, like he [Trump] did.” This is totally false. Just ask Biden. “Jill and I join the families and friends of our fallen— and Americans across the country — in grieving the loss of these warriors in this despicable and wholly unjust attack,” Biden declared after three US GIs were killed, and 34 wounded, in a Jan. 28 assault in Jordan. Biden added: “While we are still gathering the facts of this attack, we know it was carried out by radical Iran-backed militant groups operating in Syria and Iraq.” Biden’s lie also erased the 13 Marines whom a terrorist suicide bomber murdered outside Kabul’s airport during Biden’s shambolic Afghan retreat in August 2021. Things most assuredly would have gone far less fatally had a reelected President Trump exited, as he said, “with dignity, with strength, with power.” Second—regarding Charlottesville, Virginia’s race riots—Biden asked: “What American president would ever say, Nazis coming out of fields, carrying torches, singing the same anti-Semitic bile, carrying swastikas, were ‘fine people?’” Snopes’ non-mega-MAGA fact checkers demolished this lie. “No, Trump Did Not Call Neo-Nazis and White Supremacists ‘Very Fine People,’” Snopes announced June 20. It rated this claim “False.” Trump told journalists on Aug. 15, 2017: “But you also had people that were very fine people, on both sides,” some of whom wished to preserve a local statue of Confederate Gen. Robert E. Lee, and others who wanted it gone. Biden deliberately conceals Trump’s key sentence, in the same answer, 49 seconds later: “I’m not talking about the neo-Nazis and the white nationalists, because they should be condemned totally.” Trump’s words —“condemned totally”—turn Biden’s beloved “very fine people” talking point into a total lie.   Third, Biden said, “I was recently in France for D-Day…I went to the World War II cemetery—World War I cemetery he [Trump] refused to go to. He was standing with his four-star general, and he told him—he said, ‘I don’t want to go in there because they’re a bunch of losers and suckers.’ My son who served in Iraq was not a loser. He was not a sucker. You’re the sucker. You’re the loser.” Biden keeps repeating this lie despite the work of yours truly and other journalists who dismantled Jeffrey Goldberg’s lie-clogged “story” in Sept. 3, 2020’s The Atlantic. In short, Goldberg cited four anonymous sources who claimed that Trump avoided honoring these fallen American soldiers from the Great War because they were “losers” and “suckers,” and he did not want the rain to moisten his hair. My 16 named sources accompanied Trump in Paris. They said, on the record, that Trump never called these war dead “losers” or “suckers.” Trump’s military aides scotched the cemetery stop due to rain and low clouds. The Secret Service’s safety and logistical concerns nixed helicopter and motorcade travel. Trump postponed his Nov. 11, 2018, departure so he could visit the Suresnes American Cemetery near Paris. He laid a wreath there and inspected soldiers’ graves — in the rain. Sources: Murdock 16, Goldberg 4. Biden earned the Democrat nomination, fair and square and has every right to run for reelection. Iowa Supreme Court Upholds 6-Week Abortion Ban, Users Cry About Losing ‘Right’ to Abort

The Iowa Supreme Court decided Friday morning to uphold a six-week abortion ban. As a result, pro-aborts who want unrestricted abortion expressed their dissatisfaction on X.  The ban makes it so that when a woman reaches six weeks of pregnancy, she will no longer be allowed to murder her child, likely with a detectable heartbeat, in the womb. The ban makes special exceptions for some situations. In cases of rape, a woman will be legally allowed to abort her baby if the assault is reported to law enforcement within 45 days, in cases of incest if reported within 140 days and, of course, if necessary to save the life of the mother. The Iowa Supreme Court ruled in a 4-3 vote to remove an injunction that was blocking the fetal heartbeat abortion law, and the ban is expected to begin in about three weeks while the case is formally received by the district court. Until then, the former law of the land, a 20-week ban, will continue to apply. Applying our established tiers of scrutiny, we hold that abortion restrictions alleged to violate the due process clause are subject to the rational basis test. Employing that test here, we conclude that the fetal heartbeat statute is rationally related to the state’s legitimate interest in protecting unborn life. We thus reverse the district court order entering the temporary injunction blocking enforcement of the fetal heartbeat statute and remand for further proceedings. While the ban will save many babies from death by abortion, many individuals were less than pleased with the results. Iowa state auditor Rob Sand said the decision “strips reproductive freedom away from Iowa women.” That’s a common leftist phrase that’s a lie. The reproductive process is when a baby’s life is created, but abortion is when that life is ended. Abortion isn’t part of the reproductive process. One individual called it a “dark moment for our state.” A father noted that it was “disappointing and infuriating to watch my daughter’s rights repeatedly attacked and ripped away,” and added that the ruling is “restrictive and dangerous.” Sir, nobody has the “right” to kill an innocent baby. Full stop. Vice President Kamala Harris said the following in a tweet: The Iowa Supreme Court’s decision to uphold the state's dangerous abortion ban will lead to a health care crisis for women across the state. We must restore the protections of Roe so women in Iowa and every state have the freedom to make decisions about their own bodies. Others chimed in noting that the decision will “rob” women of their “right” to kill their babies and some called it “HORRIFIC” by idiotically claiming that the ban on abortion will “undoubtedly put lives at risk and worsen America’s already horrendous maternal health care crisis.” Goodness gracious these people are dramatic! This is a win for life. Get over yourselves!
