Kennedy had “neither pointed to any source of law that prescribes and defines a duty to withdraw a candidate’s name from the ballot nor demonstrated his clear legal right to performance of this specific duty,” the court’s majority order said. Democratic-nominated Justice Elizabeth Welch penned a concurring statement, noting that Kennedy had waited “more than four months” after he was nominated for president before asking Secretary of State Jocelyn Benson’s office to remove his name. “When plaintiff made his request, defendant faced a deadline for ballot printing that was two weeks away,” Welch wrote. “Additionally, the Natural Law Party, which opposed plaintiff’s efforts to remove himself from the ballot, had no opportunity to field a candidate and faced considerable prejudice.” BREAKING – Robert F. Andrew Cuomo ‘Edited’ Report That Minimized COVID Deaths: Report

According to a new report, former New York Governor Andrew Cuomo “edited” a state report that minimized the death count in nursing homes from COVID-19. The House Select Subcommittee on the Coronavirus Pandemic, which will interview Cuomo on Tuesday, said Cuomo’s office made “demonstrably false” statements while engaging in a “cover-up,” the New York Post reported. In June 2024, Cuomo blamed federal and state health officials for the nursing home directive. “They [Cuomo and his then-staff] want to assert that that order is exactly the same as the federal CMS, which it is not,” Rep. Marc Molinaro said. “The state order says, ‘You shall take back individuals and you cannot deny them solely on the basis of COVID,’ which left them no option but to accept individuals that we knew would cause risk to the other patients.” “Andrew Cuomo was attempting to shift blame for what was a clear directive,” Molinaro continued. “When they identified and knew that the order was causing great loss, they subsequently cooked the books to suggest that the numbers of those who died in nursing homes were much less than we knew.” On March 25, 2020, the New York Department of Health issued an advisory that stated nursing homes had to accept residents returning from hospitals whether or not they had a diagnosis of COVID-19. The advisory stated: During this global health emergency, all NHs must comply with the expedited receipt of residents returning from hospitals to NHs. Residents are deemed appropriate for return to a NH upon a determination by the hospital physician or designee that the resident is medically stable for return.  Hospital discharge planners must confirm to the NH, by telephone, that the resident is medically stable for discharge. Comprehensive discharge instructions must be provided by the hospital prior to the transport of a resident to the NH. No resident shall be denied re-admission or admission to the NH solely based on a confirmed or suspected diagnosis of COVID-19. NHs are prohibited from requiring a hospitalized resident who is determined medically stable to be tested for COVID-19 prior to admission or readmission. In the fall of 2020, speaking to Finger Lakes Daily News, Cuomo defended himself from the charge that his policies caused more deaths from COVID in nursing homes, the New York Post reported. In response to a question about the issue, Cuomo blamed the federal government, attacked Florida’s state government, claimed that New York “flattened the curve effectively,” and said, “It just never happened in New York, where we needed to say to a nursing home, ‘We need you to take this person even though they’re COVID positive.’ It never happened.” New York State has reported “more than 6,600 nursing home COVID-19 related deaths,” Finger Lakes Daily News reported, “but that number is likely much higher since New York does not include residents who initially contracted the virus at a nursing home but died after being transferred to a hospital.” State Senator Tom O’Mara co-sponsored a bill requiring the Department of Health to provide the accurate death toll from those in nursing homes. “He said many believe that number could be twice as high,” the Daily News noted. The outlet asked Cuomo, “Governor, you said earlier that you lie down at night and you can sleep knowing that you saved lives. What would you say to New York residents who lost their loved ones in nursing homes due to your mandate back in late March regarding sending COVID-positive patients back to nursing homes?” “Yeah, I would say, first of all, that’s not why they lost a loved one,” Cuomo protested. “Your premise, the premise of your question, is just factually wrong. People who were lost in nursing homes were lost because that’s where the virus preys. The virus preys on senior citizens. The virus was introduced in this country in Washington, state of Washington in a nursing home. That’s who succumb to this virus, are immune-compromised senior citizens, and they’re predominantly located in nursing homes.” “Number two: you look at the nursing home deaths in this state; do you know what number we are by percentage before you made that statement? We’re number 46 out of 50 states,” Cuomo boasted. “And we had the worst problem, and we’re number 46 in terms of percentage of deaths in nursing homes.”

‘No Matter The Cost’: Biden-Harris Admin Pushed Afghanistan Withdrawal Despite Warnings, Committee Finds

The Biden-Harris administration pushed forward with a U.S. military withdrawal from Afghanistan in 2021 that led to disastrous consequences over concerns and warnings from numerous sources, according to a newly released report from the GOP-led House Foreign Affairs Committee. Chairman Rep. Michael McCaul (R-TX) released the findings of his years-long investigation on Monday, faulting President Joe Biden for pushing forward with the Afghanistan pullout and Vice President Kamala Harris for backing the decision. “The Biden-Harris administration was determined to withdraw from Afghanistan, with or without the Doha Agreement and no matter the cost. Accordingly, they ignored the conditions in the Doha Agreement, pleas of the Afghan government, and the objections by our NATO allies, deciding to unilaterally withdraw from the country,” the report says. The report also focuses on the timing of the administration’s declaration of a noncombatant emergency evacuation (NEO) in mid-August, well into the Taliban’s military reconquest of Afghanistan and after the group had reached Kabul. The lateness of the declaration threw evacuation plans for tens of thousands of stranded Americans and Afghan allies into chaos. “The Biden-Harris administration prioritized the optics of the withdrawal over the security of U.S. personnel on the ground,” the report says. “The Biden-Harris administration’s failure to prepare for a NEO and order a timely NEO created an unsafe environment at HKIA, exposing U.S. Defense Department and State Department personnel to lethal threats and emotional harm. “As a result, 13 U.S. servicemembers were murdered by a terrorist attack on August 26, 2021. It was the deadliest day for the U.S. military in Afghanistan since 2012,” the report continued, referencing the terror attack on Hamid Karzai International Airport’s Abbey Gate. A suicide bomber with the terror group ISIS-K detonated his device and killed 13 U.S. troops along with 170 Afghans. Democrats on the Foreign Affairs Committee, led by ranking member Rep. Gregory Meeks of New York, released a separate report to counter the GOP investigation’s findings. Meeks accused McCaul of playing politics with the Afghanistan withdrawal report. The chairman released the report just ahead of the first presidential debate between Harris and former President Donald Trump. Trump made the Afghanistan withdrawal a cornerstone of his attacks on Biden before he dropped out, and Trump has since shifted fire to Harris since she took up the Democratic nomination. Harris has bragged that she was “last” in the room when Biden made the decision to withdraw from Afghanistan, and that she supported that decision. McCaul’s report also faulted the Trump administration for negotiating the Doha agreement to withdraw from Afghanistan without input from the Afghan government. The White House attacked McCaul’s report as “partisan” and “based on cherry-picked facts, inaccurate characterizations, and pre-existing biases.” “As we have said many times, ending our longest war was the right thing to do and our nation is stronger today as a result,” White House spokeswoman Sharon Yang said in a statement, according to The Hill. McCaul’s investigation has been criticized by its former senior investigator, Jerry Dunleavy, who resigned from the investigation in protest. Dunleavy accused McCaul and the committee investigation of not pursuing leads and missing numerous chances to hold officials responsible for missteps and blunders during the withdrawal.

Kevin Costner publicly addressed the lackluster earnings from the first installment of his Western-themed film franchise, “Horizon,” claiming that even though the first film flopped and the second was delayed, he’s still counting on the movie standing “the test of time.” The 69-year-old actor spoke with reporters at the 2024 Venice Film Festival over the weekend, admitting that “Horizon: An American Saga – Chapter 1” didn’t perform well at the box office. “It didn’t have overwhelming success,” he said, per Variety. “I’ve had a lot of movies that way, that have stood the test of time,” Costner added. Originally, the second installment in the “Horizon” series was slated to come out just six weeks after the first one did, which he called a “studio decision.” He said the studio was also the reason for the release being delayed. “For me, it fell back into my plan, which was I always wanted to come out with movies about five-six months apart. And that was going to allow me to come to Venice,” Costner said, per the outlet. “I would have never come to Venice, because they won’t show the film here if it was already out.” “Part One” made just over $29 million in North America against an estimated production budget of $100 million. When I feel rejection, unlike anybody else, when I open my eyes from my disappointment, my desire is only increased.” He said in terms of making the third movie, he wants to “hurry and not let the rock fall back downhill, I gotta go put my hands on it again and start to push it up.” The “Dances with Wolves” actor also asserted that the movies don’t take sides in terms of politics, mentioning how “it’s not a message politically to anyone.” “‘Horizon’ is not a message to my country, it’s a reminder to my country of how difficult it was that people made this journey,” he said, per Variety.

A national security nonprofit is suing to obtain information about the State Department’s hiring of far-left activist Zakiya Carr Johnson as Chief Diversity and Inclusion Officer. The Center to Advance Security in America (CASA), “a nonpartisan organization dedicated to improving the safety and security of the American people,” filed the lawsuit after first submitting a Freedom of Information Act request to the State Department, requesting communications related to Johnson’s hiring. “The hiring of Zakiya Carr Johnson as the Chief Diversity and Inclusion Officer at the State Department deserves maximum transparency due to Ms. Johnson’s past extreme progressive advocacy and repugnant comments regarding America being a systemically racist country,” CASA Director James Fitzpatrick told The Daily Wire. “The Center to Advance Security in America filed a FOIA request for communications and records related to her hiring, and after waiting over 140 days, we were forced to file this lawsuit.” The request, which was sent on April 23rd, sought communications between Secretary of State Antony Blinken and other officials concerning Johnson’s hiring. Now, the suit from CASA seeks to compel the State Department to produce all non-exempt records in accordance with the Freedom of Information Act. “To date, CASA has received neither a further response nor any other further communication from DOS,” the suit explains. “Through DOS’s failure to make a determination within the time period required by law, CASA has constructively exhausted its administrative remedies and seeks immediate judicial review.” Johnson’s hiring sparked uproar as radical statements from her past began to resurface. Johnson embraced far-left Critical Race Theory and claimed that American society is “often riddled with racism, patriarchy and exclusion,” The Daily Wire reported in April. “These are chinks in the armor of traditional leadership that refuse to reconcile with a colonizing past, or recognize that time has run out for experimentation and tweaking of a failed historic model,” Johnson stated in a now-deleted article, also adding, “we cannot have equity without dismantling structural racism, patriarchy and heterosexism.” Johnson is the co-author of a guide called “Feminist Leaders for Feminist Goals,” a how-to playbook for feminists to usurp “a culture of male and/or white dominance” in organizations. Johnson’s hiring is part of a wide-reaching plan to embed the far-left diversity, equity, and inclusion (DEI) agenda throughout the State Department. The State Department has spent at least $77 million taxpayer dollars on DEI efforts in just two years, The Daily Wire exclusively reported in March. The department has also pushed transgenderism across the globe, employing former activist Jessica Stern as its “Special Envoy to Advance the Human Rights of Lesbian, Gay, Bisexual, Transgender, Queer, and Intersex Persons.” Stern has visited at least 22 countries across all six habitable continents, even attending a “transgender visibility” march in Brazil. Former president Donald Trump has said he would gut the federal bureaucracy through executive orders if elected. “We will pass critical reforms making every executive branch employee fireable by the President of the United States,” Trump said at a rally, touting the plan. “The deep state must be brought to heel.”
