Malliotakis, who is the lone Republican representative in New York City, filed an emergency application to keep her district in place for the 2026 midterm elections. It marks a victory for Republicans, who had been bracing for the possibility that the district would swing to Democrats if it was redesigned ahead of the midterm elections. A state judge had ordered the boundaries be redrawn after ruling the district dilutes Black and Latino voting strength in violation of the state constitution. The Supreme Court granted Malliotakis’s emergency application to block that ruling as the litigation proceeds, effectively restoring her existing district lines for the midterms. The ruling appeared to split along ideological lines, with the three liberal justices publicly dissenting. Justice Samuel Alito voted in Malliotakis’s favor, saying the state judge’s order “blatantly discriminates on the basis of race,” while the other conservatives did not publicly disclose their votes. “Despite having a voter registration advantage in New York’s 11th Congressional District, Democrats can’t beat me on merit, policy and debate. They argued that state voters were entitled to “conduct their congressional elections under the lawful map that the New York Legislature adopted starting on February 24, free from a judicial mandate that violates multiple provisions of the United States Constitution.” Democrats urged the Supreme Court to stay out of the case and countered that the dispute dealt with state law. “It is New York courts, not federal courts, that should decide how to balance competing interests in minimizing disruptions to state-law election-calendar dates and in ensuring that the state’s election district map is lawful,” Democrats told the Supreme Court in written briefing. New York’s primary election will take place on June 23. A state appeals court sided with the Democrats in the dispute, clearing the way for the commission to redraw the district.
