EFF to Court: Young People Have First Amendment Rights

Utah cannot stifle young people’s First Amendment rights to use social media to speak about politics, create art, discuss religion, or to hear from other users discussing those topics, EFF argued in a brief filed this week. EFF filed the brief in NetChoice v. Brown, a constitutional challenge to the Utah Minor Protection in Social Media Act. The law prohibits young people from speaking to anyone on social media outside of the users with whom they are connected or those users’ connections. It also requires social media services to make young people’s accounts invisible to anyone outside of that same subgroup of users. The law requires parents to consent before minors can change those default restrictions. To implement these restrictions, the law requires a social media service to verify every user’s age so that it knows whether to apply those speech-restricting settings. The law therefore burdens the First Amendment rights of both young people and adults, the friend-of-the-court brief argued. The ACLU, Freedom to Read Foundation, LGBT Technology Institute, TechFreedom, and Woodhull Freedom Foundation joined EFF on the brief. Utah, like many states across the country, has sought to significantly restrict young people’s ability to use social media. But “Minors enjoy the same First Amendment right as adults to access and engage in protected speech on social media,” the brief argues. As the brief details, minors use social media for to express political opinions, create art, practice religion, and find community. Utah cannot impose such a severe restriction on minors’ ability to speak and to hear from others on social media without violating the First Amendment. “Utah has effectively blocked minors from being able to speak to their communities and the larger world, frustrating the full exercise of their First Amendment rights,” the brief argues. Moreover, the law “also violates the First Amendment rights of all social media users—minors and adults alike—because it requires every user to prove their age, and compromise their anonymity and privacy, before using social media.” Requiring internet users to provide their ID or other proof of their age could block people from accessing lawful speech if they don’t have the right form of ID, the brief argues. And requiring users to identify themselves infringes on people’s right to be anonymous online. That may deter people from joining certain social media services or speaking on certain topics, as people often rely on anonymity to avoid retaliation for their speech. Finally, requiring users to provide sensitive personal information increases their risk of future privacy and security invasions, the brief argues.

The rumors about Megan and Riley started after both of them left some vacation breadcrumbs where they were seemingly together. Moroney confirmed they happened to be on vacation in the same place, but also shut down the thought that they were seeing each other in a romantic capacity. “He was individually on his vacation with his friends. St. Barts is a popular place! It’s one of those things where if you know someone on a small island, you’re like, ‘Oh, sh*t, you’re here too.’ So it was fun. Just because we’re hanging out doesn’t mean we’re romantically dating. You know what I mean?” They have had the rumor mill GOING since then, and have been spotted in his hometown of Jacksonville, Alabama, and at different airports together here and there, though publicly, the two have consistently denied that they’re an official couple. Yesterday, during a radio interview on Country Nights Live with Bev Rainey yesterday, Riley was asked about some of the biggest rumors he’s seen about himself on social media. He of course mentioned all the rumors about his dating life, and also laughed about how the status of his signature mustache is a hot topic, too: “I find out who I’m dating weekly, you know, on social media. That’s a pretty big on there. But I think a lot of stuff I see is so outlandish that it keeps me humble a little bit, then don’t have to worry about. I’m like, okay, don’t say anything on there. It’s interesting. how things like shaving your mustache can become viral now, I never thought that would be a thing.” Rainey straight up asked Riley if he was dating anyone since he mentioned it in the previous response, and it’s the question everyone wants an answer to… Riley once again confirmed that he’s “not” dating anyone right now, though he’s “rumored to have dated a lot of people.” He explained, like he has before, that with Ella in particular, fans want to believe that the songs are so real to the artists true lives, similar to country power couples like Tim and Faith and Johnny and June, which he understands. He didn’t mention or allude to the Megan rumors, but he did straight up say he’s single… so there you have it, ladies: “I’m not, no. I’m rumored to have dated a lot of people… but I kind of understand that. You know, people always long for that like Tim and Faith, Johnny and June, you know, George and Tammy thing. So you know, you know me and Ella have two giant songs together and I think fans kinda wanna believe that what you’re singing about is real, and follow those lyrics and think there’s a story there. So I can comprehend people that are thinking there’s something going on. She was very vague with her response, saying that she just “wanted the T-shirt,” and hopes to be “getting it soon”: “I said I wanted the T-shirt. Hopefully I’ll be getting it soon. Maybe that girl will send me hers.” I mean, it’s a cool shirt, but I think fans are looking for a straight yes or no response here. LET’S GO. Zach Top is about to give us all the songs of the summer, at the end of the summer. It’s been no secret that Zach Top has been in the studio working on his sophomore record. During a Q&A session at the Houston Livestock Show & Rodeo, the “Cold Beer & Country Music” singer confirmed that he was finishing up a new record, noting it would come out at some point this year. “I just went in and tracked a few more songs to round out the second record. So we got that finished up and are getting it mixed right now. It’ll come out at some point in the summer. They make you want to kick your feet by the pool or beach and crack open a Corona. Both of them sound like the songs of summer to me. And according to what he told a Scranton, Pennsylvania crowd at the end of May, we are about to get a new Zach Top single, and he confirmed the month his forthcoming record is due for release. “Alright, I’m gonna sing you a summer song here. I’m gonna try to. It’s a brand new one, actually. It’s coming out on June 9th… I think. I hope I said that right. Chris from the label is here and I’m going to get my butt whooped if I said it wrong. But I think that’s right.  So June 9th… It will be included on my next record, which is coming out in August. I’m excited about that as well, and hope you all are ready for new music. Two things I love just about as much as anything in the world is ‘Good Times & Tan Lines.” With that, Zach Top then dives into an unreleased song, which he had previously described as a “goofy little summertime song.” The tune, “Good Times & Tan Lines,” has a “Chattahoochee” feel as Top sings about spending time at the local watering hole. Like Alan Jackson once said: everyone has their own “Chattahoochee,”  and this song instantly transports you to the creek or lake you spent your youth going to (and probably getting into a bit of trouble at). “Talkin’ about good times and tan lines Cold beer and summer nights That was all there was to life Good times and tan lines Good, good times and tan lines.”  If this single’s release date is accurate, we are three days away from new Zach Top music, and I can’t wait. This single is the perfect release to kick off summer, keeping that nostalgic ’90s country sound with a bit of a No Shoes Nation flair.
